"Moratorium penempatan TKI informal diberlakukan oleh Pemerintah Indonesia ke negara-negara di Kawasan Timur Tengah sejak Tahun 2015 dalam rangka meminimalisir permasalahan yang terjadi kepada TKI di Luar Negeri. Tujuan dari pemberlakuan moratorium tersebut adalah agar tercipta suatu sistem perlindungan baru antara Indonesia dengan Negara-negara yang diberlakukan penghentian sementara penempatan itu. Akan tetapi, dalam pelaksanaannya kebijakan moratorium TKI membawa dampak yang cukup signifikan yaitu meningkatnya jumlah TKI ilegal. Pada skripsi ini dijelaskan mengenai faktor-faktor apa saja yang memengaruhi implementasi moratorium penempatan TKI informal di Kawasan Timur Tengah untuk mengetahui bagaimana faktor-faktor tersebut mempengaruhi kebijakan dan apa yang penyebab permasalahan meningkatnya TKI ilegal setelah diberlakukan moratorium. Skripsi ini merupakan penelitian dengan pendekatan positivist menggunakan teori Grindle yaitu dilihat dari segi konten dan konteks dari kebijakan. Simpulan yang dapat diambil dari penelitian ini adalah bahwa pada implementasinya, masih ditemui beberapa kendala yang kemudian menyebabkan jumlah TKI ilegal meningkat. Berdasarkan 9 faktor yang mempengaruhi implementasi kebijakan, hanya 6 yang memenuhi indikator faktor yang menunjang pelaksanaan implementasi. 3 faktor yang mengalami kendala diantaranya dari sisi jangkauan perubahan yang diharapkan, sumber daya yang memadai, dan adanya kepentingan serta tumpang tindih kekuasaan antar pihak. Rekomendasi pada penelitian ini adalah bahwa pemerintah perlu segera melakukan evaluasi dan membuat sistem perlindungan baru bagi TKI, memperbanyak sumber daya yang berkualitas untuk mendukung pelaksanaan moratorium, dan meninjau ulang undang-undang agar tidak terjadi tumpang tindih antar pihak, serta meningkatkan pengawasan pada pelaksanaan kebijakan.

The moratorium on placement of informal migrant workers in middle east region has been enforced by the government of Indonesia since 2015 in order to minimalize problems which has happened to Indonesia migrant workers abroad. The purpose of moratorium enforcement is so that it can form a new protection system between Indonesia and the countries that is being given temporary placement dismissal. However, in the implementation, migrant workers moratorium policy brought such adverse impact that it made the number of illegal migrant workers increasing. This thesis explains about the factors which affecting the implementation of moratorium on placement of informal migrant workers in the middle east region to find out how those factors affect the policy and the cause of illegal migrant workers increasement after the moratorium being applied. This thesis is a research with positivist approach with Grindle theory which seen from context and content side of the policy. The conclusion of this thesis is that in the implementation, there are hindrances which cause the increasing of illegal migrant workers. Based on 9 factors that affect policy implementation, only 6 factors that fulfill the indicators which support them. 3 factors that facing problems are from the range of expected changes side, adequate resources, and the existence of interest and also overlapping powers between parties. The recommendation in this research are that the government needs to do an evaluation immediately and formulate a new protection system for migrant workers, incerase qualified resources to support the implementation of moratorium, and review the related policy so that there is no overlapping authority between parties, and also increase supervision on the implementation."
