"Pesawat udara secara sifat aslinya adalah moda yang tidak aman. Ia tidak bisa berhenti seketika diudara semaunya, dan bisa jatuh. Namun statistik menunjukkan, bahwa pesawat udara merupakan moda transportasi yang paling aman. Hal ini disebabkan karena adanya regulasi yang ketat dan ditaati. Oleh karena itu, peraturan penerbangan nasional harus ditegakkan secara ketat dalam rangka mewujudkan penerbangan yang aman dan selamat. Sejalan atas kepentingan tersebut, maka hukum dalam konteks implementasi kebijakan kriminal (criminal policy) diperlukan, sebagai alat untuk melindungi manusia agar bisa hidup dengan selamat tanpa ancaman dari tindakan yang membahayakan dan kondisi yang membahayakan.
Berdasarkan latar belakang yang telah disampaikan diatas, maka muncul permasalahan yang harus diteliti yakni apakah implementasi kebijakan kriminal dalam UU No. 1 Thn. 2009 tentang Penerbangan dapat dilaksanakan, dan bagaimana kebijakan Perundang-Undangan dalam konteks implementasi kebijakan kriminal di bidang Penerbangan di masa yang akan datang.
Metode penelitian dalam tesis ini menggunakan Metode Penelitian Sosio-Legal yang merupakan penelitian interdisipliner terhadap hukum, dilaksanakan dengan menggunakan metode kualitatif deskriptif, dengan pendekatan yuridis normatif. Metode pengumpulan data yang dipakai adalah: studi kepustakaan dan wawancara.
Berangkat dari hasil penelitian yang telah dilakukan, penelitian ini menghasilkan kesimpulan: (1) bahwa kebijakan perundang-undangan yang menerapkan kebijakan kriminal sebagaimana yang diatur dalam UU No. 1 Tahun 2009 tentang Penerbangan, akan sangat sulit untuk diterapkan; (2) Untuk masa yang akan datang, agar kebijakan perundang-undangan yang menerapkan dimensi kebijakan kriminal di bidang penerbangan harus benar-benar selaras, seiring, sejalan, sinkron, dan harmonis dengan ketentuan perundangan lain yang berlaku, mentaati asas-asas hukum pidana, memperhatikan efek keberlakuan dan upaya penegakan hukumnya, serta dapat menunjang sistem peradilan pidana terpadu di Indonesia. Karena dengan demikian, barulah dimensi dan implementasi kebijakan kriminal yang diatur/dianut dalam UU Penerbangan dapat diterapkan penegakan hukumnya, sehingga kemudian pendekatan kebijakan kriminal di bidang penerbangan dapat memberikan kontribusi berguna, dalam kaitan peningkatan faktor keamanan dan keselamatan penerbangan.

Aircraft in its original nature represents unsafe mode. It cannot stop instantly in the air at will, and can fall down. But statistic data show that the aircraft is the safest mode of transportation. This is due to strict regulations and adhered to. Therefore, the national aviation regulations must be enforced strictly in order to realize a secure and safe aviation. In line with the interest, the law in the context of the implementation of criminal policy is required, as a means to protect people to live safely without the threat of dangerous actions and conditions.
Based on the background as presented above, it appears that the problems should be investigated whether the implementation of criminal policy in Law No. 1 Year. 2009 on Aviations can be implemented, and how policy legislation in the context of the implementation of criminal policy in the field of aviation in the future will be.
Method of research in this thesis uses the Socio-Legal Research Methods which represents interdisciplinary study of laws, executed by using descriptive qualitative methods, with a normative juridical approach. The employed data collection method is literature study and interviews.
Departing from the results of research that has been done, the study concludes: (1) that the legislation policy that applies criminal policy as stipulated in Law No. 1 Year 2009 on Aviation will be very difficult to implement, (2) In the future, the legislation policies that apply criminal policy dimension in the field of aviation should be in tune, in concomitant with, in line, synchronized to, and harmonized with other prevailing provisions, adhering to the principles of criminal law, considering the applicability effect and law enforcement efforts, and able to support integrated criminal justice system in Indonesia. And hence, the dimensions and implementation of criminal policies which are governed / adopted in the law of Aviation becomes applicable, so that the approach to criminal policies in the field of aviation can provide useful contributions, in terms of improving aviation safety and security factors.

"Seiring dengan berkembangnya kejahatan-kejahatan terorganisasi khususnya Narkotika, merupakan kejahatan yang berdampak merugikan bangsa dan negara secara luas sehingga dikategorikan kejahatan serius atau disebut juga sebagai "extra ordinary crime". Bangsa Indonesia siaga terhadap penanggulangan kejahatan-kejahatan tersebut dengan memberlakukan kebijakan-kebijakan kriminal. Salah satu kebijakan tersebut dengan Moratorium/Pengetatan Hak-hak Narapidana mendapatkan Remisi, Asimilasi dan Pembebasan bersyarat, hal ini ditujukan untuk efek jera bagi pelaku kejahatan tersebut dan memenuhi rasa keadilan bagi masyarakat luas. Dengan semangat tersebut maka diberlakukan Peraturan Pemerintah yang mengatur tentang moratorium syarat mendapatkan Remisi, Asimilasi dan pembebasan bersyarat, yaitu PP No 99 Tahun 2012. Namun pemberlakuan PP No 99 Tahun 2012 tersebut menimbulkan polemik karena dianggap diskriminatif, melanggar HAM dan bertentangan dengan tujuan pemidanaan serta Hierarki perundang-undangan, selain itu pertentangan yang terjadi timbul pada salah satu syarat moratorium hak mendapatkan Remisi dan pembebasan bersyarat adalah harus bersedia bekerjasama dengan penegak hukum membongkar kejahatan yang dilakukanya ( Justice Collaborator) serta pertentangan bahwa pada saat seseorang telah berstatus sebagai narapidana harusnya telah memasuki tahap pembinaan dan mendapatkan perlakuan yang sama tanpa membicarakan lagi tentang kejahatan yang dilakukan.

The development of organized crime especially for Narcotics and Drugs Crimes inflict such destruction impact into our nation, so this crime is being called as serious crime and also called an Extra Ordinary Crime. Indonesia is preparing to prevent these crimes by applying some criminal policies. One of the criminal policy which applied by the Indonesian Government is the Moratorium of Inmates Rights to obtain the remission, assimilation, and parole. This policy aims to give the detterent effect to those narcotics and drugs offender and to reach the values of justice for society as well. With the spirit as mentioned above, the Indonesian Government enact The Government Ordinance No. 99/2012. But in other side, the enactment of this regulation evoke a polemic. The polemic raise because this regulation has been considered as a discriminative regulation, breached the universal values of human rights, contradictive with the sentencing purpose and also contradictive with the hierarchy of regulations as well. Another unappropriate rule in this regulation is the requirement for the inmate to become a justice collaborator. An inmate of these crimes should be in rehabilitation and development phase, not in the phase of arguing the crime itself which is past in the pra-ajudication and ajudication phase.

"Kebijakan Penanggulangan Kejahatan (Criminal Policy) terhadap Tindak Pidana Pronografi di Dunia Maya (Cyberporn) melalui Pembaruan Kitab Undang-Undang Hukum Pidana (KUHP) Indonesia Tesis ini membahas permasalahan utama mengenai bentuk kebijakan penanggulangan kejahatan (criminal policy) yang dapat diterapkan terhadap tindak pidana pornografi di dunia maya (cyberporn), prospek bentuk criminal policy terhadap tindak pidana cyberporn dalam KUHP Nasional di masa mendatang, serta implikasi dari keberadaan KUHP Nasional terhadap undang-undang lainnya dalam pengaturan tindak pidana cyberporn. Dengan menggunakan metode penelitian hukum normatif (yuridis-normatif), maka berdasarkan data sekunder yang diperoleh melalui studi dokumen seperti: bahan hukum primer, bahan hukum sekunder dan bahan hukum tertier, telah dihasilkan suatu kesimpulan bahwa bentuk criminal policy yang dapat dilakukan dalam upaya penanggulangan tindak pidana cyberporn melalui sarana penal adalah dengan menerapkan ketentuan undang-undang, seperti: Kitab Undang-Undang Hukum Pidana (KUHP), Undang-Undang Nomor 40 Tahun 1999 tentang Pers, Undang-Undang Nomor 32 Tahun 2002 tentang Penyiaran, Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik, Undang-Undang Nomor 44 Tahun 2008 tentang Pornografi, dan Undang-Undang Nomor 33 Tahun 2009 tentang Perfilman, sementara bentuk kebijakan non-penal yang dapat dilakukan adalah melalui berbagai pendekatan seperti: pendekatan teknologi (techno prevention), pendekatan budaya/kultural, pendekatan moral/edukatif, dan pendekatan global (kerjasama internasional). Di dalam RUU-KUHP telah dimuat beberapa ketentuan baru berkaitan dengan tindak pidana cyberporn, antara lain meliputi: pengaturan mengenai ruang lingkup berlakunya peraturan perundang-undangan pidana Indonesia terhadap tindak pidana di bidang teknologi informasi, pengaturan mengenai tindak pidana pornografi anak (child pornography) melalui komputer, serta pengaturan khusus mengenai tindak pidana pornografi. Keberadaan KUHP Nasional di masa mendatang dapat menimbulkan suatu implikasi terhadap udang-undang lainnya dalam pengaturan tindak pidana cyberporn berupa adanya tumpang tindih (overlaping) diantara KUHP Nasional dengan berbagai undang-udang tersebut, namun persoalan ini dapat diatasi dengan melakukan pencabutan sebagian atau seluruh ketentuan dari undang-undang di luar KUHP Nasional atau dengan menerapkan azas ?lex specialis derogat legi generalis? secara kasuistis.

This thesis discusses the main problems of the criminal policy that can be applied to combat cyberporn activities, the prospect of the cyberporn criminal policy in the future Indonesian Criminal Code, and the implication regarding to the existence of the new Indonesian Criminal Code with the other regulations relating with cyberporn offences. Using the normative legal research method (normative-juridical) based on the secondary data that consist of primary legal material, secondary legal material and tertiary legal material wich were gain through documentation study, concludes the cyberporn criminal policy that can be effort with the penal policy is by applying several regulations, such as: The Indonesian Penal Code, The Press Act No. 40/1999, The Broadcasting Act No. 40/1999, The Information and Electronic Transaction Act No. 11/2008, The Pornography Act No. 44/2008, and The Movie Act No. 33/2009, in the other part using the non penal policy can be submit with several approaches, for instance: technological approach, educational approach, cultural approach, and global approach. The new Indonesian Penal Code concept have several new regulations regarding to cyberporn offences, consisting: the regulation of Indonesian jurisdiction involving technology and information crimes, the regulation of child pornography using computers, and the special regulation of pornography offences. "Tesis ini membahas tahapan formulasi kebijakan kriminal (politik kriminal) pada masa pemerintahan Presiden Megawati Soekarnoputri dalam upaya memerangi korupsi di Indonesia. Penelitian menggunakan pendekatan kwalitatif dengan disain diskriptif.
Hasil penelitian menyimpulkan bahwa formulasi kebijakan kriminal pemerintahan Presiden Megawati Soekarnoputri berupa perundang-undangan dan perangkat hukum yang dibuat sebagai cukup untuk memerangi korupsi, sekaligus menunjukkan keseriusannya. Hasil penelitian menyarankan bahwa produk perundang-undangan dan perangkat turunannya segera diimplementasikan agar dapat diketahui output dan outcome-nya.

This thesis to be aimed for discussing phase of a policy formulation (criminal politic) in President Megawati Soekarnoputri era for fighting against corruption in Indonesia. The research used a qualitative approachment with to be completed description desaign.
The research shows that policy formulation on criminology in President Megawati Soekarnoputri era consisted of legislation and law sets to be made as something enough and appropriate for fighting against corruption besides of showing its seriousness. The research suggests that production of legislation and its sets have to be implemented as soon as possible to be known output and outcome of it."

"This article aims at discussing 2 main problems: 1) in how far harm done by corporate crime in Indonesia; and 2) how is the criminal policy passed in overcoming corporate crime in Indonesia? The result of this discussion points: First, corporate crime is a kind of crime that makes society restless and that is risks the interests of State. The harm done is in the form of material an immaterial things for citizens, State and other corporations. Second, corporate crime should be included in the Code of Criminal Laws as a criminal act by the offender. In line with this, the subject of offence in the Code of Criminal Laws should be widened to include corporations with a threat of either grave punishment by prison or fine punishment, or both of them. However, said penal efforts should be integrated with the overcoming of non penal ones."
