"Perkawinan berbeda kewarganegaraan menyebabkan persatuan harta dikemudian waktu. Banyak peraturan peraturan di negara ini, yang membedakan Warga Negara Asing dan Warga Negara Indonesia untuk sistem kepemilikan suatu harta benda, jika menikah tanpa Perjanjian Perkawinan, maka harta tersebut akan menjadi bulat, oleh karna itu dibuatlah Perjanjian Perkawinan, untuk melindungi masing masing pihak. Berlakukanya Perjanjian Perkawinan setelah dicatatkan oleh Pegawai Pencatat Perkawinan dan semenjak perkawinan berlangsung. Oleh karna itu, Perjanjian Perkawinan berlaku apabila Perkawinan yang dijalani oleh pasangan berbeda kewarganegaraan berjalan dengan sah, tetapi dalam analisa kasus ini pasangan yang menikah berbeda kewarganegaraan ini tidak menjalani beberapa aturan dan ada beberapa keterangan yang tidak diterangkan. Permasalahan yang timbul dalam penulisan ini adalah, Bagaimana Pengaturan pelaksanaan pencatatan Perjanjian Perkawinan yang dibuat di Indonesia oleh pasangan berbeda kewarganegaraan, permasalahan berikutnya, Bagaimana pengaturan Pencatatan Perkawinan yang dibuat oleh pasangan yang berbeda kewarganegaraan dengan yang perkawinannya tidak sesuai dengan undang undang yang berlaku di Indonesia, serta pencatatan perkawinan agar perjanjian perkawinan tersebut tercatat dan sah.
Metode yang digunakan dalam penulisan tesis ini adalahanalisis data yang ada secara kualitatif. Metode yang menekankan pada peraturan perundang undangan teoritis. Dan bentuk penelitian adalah yuridis Normatif, penelitian yang menekankan pada penggunaan norma hukum secara tertulis.pengaturan dan pelaksanaan, pembuatan perjanjian perkawinan sebelum perkawinan dilangsungkan. Perkawinan yang dilaksanakan oleh Warga Negara Oleh Warga Negara Indonesia di luar negeri Harus mendapatkan surat bukti perkawinan warga negara Indonesia,untuk jadi alat bukti pencatatan. Pengaturan Pencatatan Perkawinan yang dibuat oleh pasangan yang berbeda kewarganegaraandalam penulisan ini melalui, konsorsium penetapan pencatatan perkawinan yang dikeluarkan oleh Kantor Catatan Sipil agar perjanjian perkawinan tersebut tercatat dengan sah dengan dasar Asas Lex Loci Celebrationis.

A different nationality marriage, cause of a unity property in the future. Many regulation in this country differentiate between an Indonesian and the foreign citizens in the system to ownthe property. If someone married without prenuptial agreement then the property between a marriage couple will be united, then it's better to make prenuptial agreement to protect each property.Prenuptial agreement is valid since its registered by marriage officers, and during the marriage. Therefore the prenuptial agreement is valid when the marriage different nationality do the procedure of regulation and legitimate. But in this case the both couple different nationality not did the procedure, and some identity is being hiden, the problem in this case is how the regulation and implementation to register the prenuptial agreement which is made in Indonesian, by the marriage different nationality in other country, next problem is how the regulation and implementation to register the prenuptial agreement which is made in Indonesia but the marriage against the regulation Indonesia, also how to make the prenuptial agreement register and legimate.
The method in this thesis is use analysis data by qualitative, and using the regulation theory, the form of the research yuridical normative, which is use regulation. Regulation and implementation of register Prenuptial agreement before marriage begin, marriage with different nationality in other country has been prove with letter to prove their marriage in other country for to as based to register marriage and prenuptial agreement. Register and implementation in this case by marriage different nationality, is using consortium is issued by Register Office Indonesia, also the prenuptial agreement is legimate based on Lex Loci Celebrationis.

"Perjanjian perkawinan merupakan suatu kesepakatan yang dituangkan oleh calon pasangan suami isteri untuk mengatur harta benda yang mereka miliki masing-masing setelah dan selama perkawinan berlangsung. Landasan dari suatu perjanjian perkawinan ialah perkawinan. Oleh karena itu dalam pembuatan perjanjian perkawinan harus dilihat status dari perkawinannya. Permasalahan yang timbul dalam penulisan ini adalah, bagaimana keabsahan suatu perjanjian perkawinan yang berlandaskan perkawinan beda agama, sedangkan hukum di Indonesia tidak mengenal jenis perkawinan tersebut. Metode yang digunakan dalam penulisan tesis ini adalah analisis data secara kualitatif. Dengan bentuk penelitian yuridis normatif, dan menggunakan jenis data sekunder serta data pendukung data sekunder berupa hasil wawancara dengan Informan. Keabsahan perjanjian perkawinan yang dilandaskan dari perkawinan beda agama jika dipandang dari ketentuan Pasal 1868 Kitab Undang-Undang Hukum Perdata, maka perjanjian perkawinan tersebut merupakan akta otentik, karena telah sesuai dengan kriteria yang disebutkan dalam ketentuan tersebut. Namun akta perjanjian perkawinan itu tidak dapat disahkan dan batal demi hukum karena perkawinan yang melandasinya melanggar syarat material khusus perkawinan yaitu ketentuan Pasal 8 huruf (f) Undang-undang Nomor 1 Tahun 1974 tentang Perkawinan. Dikarenakan perkawinan tersebut mengandung cacat hukum maka berlakulah ketentuan Pasal 29 ayat (2) Undang-undang Nomor 1 Tahun 1974 tentang Perkawinan.

Prenuptial agreement is an agreement entered into by and between prospective husband and wife so as to manage their respective properties during and after their marriage. Basis for the prenuptial agreement is a marriage. Therefore, drafting of a prenuptial agreement shall consider the status of the marriage. This work attempts to study the legality of a prenuptial agreement between prospective husband and wife of different religions since Indonesian laws do not recognize such inter-religion marriage. Method used herein is qualitative data analysis in the form of normative juridical and using secondary data and supporting data thereof in the form of interviews with informan. According to Article 1868 of Indonesia Civil Code, a prenuptial agreement between prospective husband and wife of different religions constitutes an authentic deed as it meets the criteria specified therein. However, deed of prenuptial agreement can not be authenticated and shall be void at law as the inter-religion marriage does not meet the special material requirement as set out in Article 8(f) of Law No. 1/1974 concerning Marriage. As such marriage is legally defective, the provisions of Article 29(2) of Law Number 1/1974 concerning Marriage shall apply."

"[Perkawinan campuran sebagaimana diatur dalam Undang-Undang Nomor 1 Tahun 1974 adalah perkawinan antara dua orang yang di Indonesia tunduk pada hukum yang berlainan, karena perbedaan kewarganegaraan dan salah satu pihak berkewarganegaraan Indonesia. Perkawinan campuran dapat dilaksanakan di Indonesia maupun di luar Indonesia. Dalam hal perkawinan campuran dilaksanakan di luar Indonesia adalah sah bilamana dilakukan menurut hukum yang berlaku di Negara di mana perkawinan itu dilangsungkan dan bagi Warga Negara Indonesia tidak melanggar ketentuan-ketentuan Undang-Undang Perkawinan. Dalam jangka waktu 1 (satu) tahun sejak sekembalinya mereka ke Indonesia, bukti perkawinan mereka harus didaftarkan di Kantor Pencatatan perkawinan tempat tinggal mereka. Pasangan perkawinan campuran yang hendak melangsungkan perkawinan campuran di luar negeri juga dapat membuat perjanjian perkawinan. Perjanjian perkawinan adalah perjanjian tertulis yang dibuat oleh calon suami isteri sebelum atau pada saat perkawinan dilangsungkan untuk mengatur akibat-akibat perkawinan terhadap harta kekayaan mereka. Pentingnya pembuatan perjanjian perkawinan bagi pasangan yang hendak melangsungkan perkawinan campuran adalah terkait dengan perlindungan hukum terhadap hak milik atas tanah di Indonesia yang hanya dapat dimiliki oleh Warga Negara Indonesia, sebagaimana diatur dalam Undang-Undang Pokok Agraria. Penulisan tesis ini menggunakan metode yuridis normatif, yaitu dilakukan dengan menelusuri bahan hukum sekunder berupa norma-norma dari peraturan perundang-undangan yang berkaitan dengan permasalahan. Prosedur pembuatan perjanjian perkawinan dalam perkawinan campuran yang dilangsungkan di luar negeri, tetap mengacu pada ketentuan Undang-Undang Perkawinan yaitu dibuat sebelum atau pada saat perkawinan dilangsungkan dan berdasarkan pada hukum yang berlaku di Indonesia. Dalam hal setelah perkawinan dilangsungkan di luar negeri dan mereka kembali ke Indonesia namun tidak mendaftarkan perkawinannya tersebut dan kemudian mereka membuat perjanjian perkawinan, maka perjanjian perkawinan tersebut menjadi batal demi hukum karena melanggar ketentuan Undang-undang yaitu dibuat setelah perkawinan berlangsung.

"Perkawinan merupakan suatu peristiwa yang merubah status seseorang dan memiliki arti yang sangat penting dalam kehidupan masyarakat luas. Oleh karena itu, di Indonesia yang memiliki keanekaragaman suku, agama dalam masyarakatnya memungkinkan timbulnya perkawinan antar suku maupun agama. Dalam hal perkawinan, Undang - Undang Perkawinan di Indonesia mendasarkan pelaksanaan perkawiman pada agama yaitu dalam pasal 2 ayat (1), sehingga sah atau tidaknya suatu perkawinan didasarkan pada pemenuhan ketentuan agama yang diyakini pihak-pihak yang berkehendak menikah. Sementara itu, akibat adanya keanekaragaman agama yang ada di Indonesia, perkawinan antar pasangan yang berbeda agama tidak dapat dihindari. Berdasarkan hal tersebut, dewasa ini pasangan yang berbeda agama tersebut mencari celah hukum dalam melangsungkan perkawinannya agar dipandang sah dan yang terpenting adanya pengakuan dari Negara terhadap perkawinan yang mereka laksanakan, yaitu dengan melangsungkan perkawinan di Luar Negeri. Perkawinan yang dilakukan di Luar Negeri diatur dalam pasal 56 UU No. tahun 1974 tentang Perkawinan. Dimana dalam pasal tersebut merumuskan bahwa perkawinan yang dilakukan di luar negeri adalah sah dan dapat didaftarkan di Kantor Catatan Sipil di Indonesia. Hal tersebut menimbulkan suatu permasalahan dalam pencatatannya di Indonesia karena pelaksanaan perkawinan yang tidak sesuai dengan UU No. 1 tahun 1974 sehingga apakah pencatatan tersebut bertentangan atau tidak dan bagaimana dengan "certificate of marriage " dapat menjadi akte autentik di Indonesia atau tidak. Adapun Metode penelitiannya adalah kepustakaan dan peninjauan ke Kantor Catatan Sipil DKI Jakarta. Oleh karena, pelaksanaan perkawinan tersebut dapat dikatakan sebagai Penyelundupan Hukum namun perkawinan tersebut tetap sah menurut Negara dan "Certificate of marriage" dapat menjadi Akte Autentik di Indonesia. Oleh karena itu penerapan sanksi serta pengaturan yang tegas terhadap pelaksanaan Undang-undang Perkawinan sangat diperlukan dalam menyikapi perkawinan pada pasangan WNI yang berbeda agama di Luar Negeri."

"Menurut ketentuan Pasal 29 ayat (1) Undang-Undang Nomor 01 Tahun 1974 tentang Perkawinan diatur bahwa perjanjian perkawinan dibuat pada waktu atau sebelum perkawinan dilangsungkan oleh pasangan calon suami isteri. Akan tetapi karena kurangnya pengetahuan masyarakat Indonesia mengenai pembuatan perjanjian perkawinan, maka banyak pasangan suami isteri yang membuat perjanjian perkawinan setelah perkawinan dilangsungkan dengan alasan permohonan perlindungan Hukum terhadap harta pribadi masing-masing terkait resiko tanggung jawab pekerjaan atau berakhirnya perkawinan karena suatu perceraian. Di dalam penelitian ini, penulis menggunakan metode penelitian yuridis normatif dengan tipe penelitian analitis deskriptif. Data yang dipergunakan adalah data sekunder, yaitu
data yang berupa studi kepustakaan dan studi terhadap penetapan Pengadilan Negeri Jakarta Timur Nomor : 2173/Pdt.P/2012/PNJkt.Tim. Penelitian ini dilakukan untuk mengetahui dan menganalisis dasar pertimbangan Hakim dalam menetapkan Penetapan Pengadilan tersebut, mengingat bahwa permohonan Penetapan perjanjian perkawinan setelah perkawinan dilangsungkan bertentangan dengan ketentuan pasal 29 ayat (1) Undang-Undang Nomor 01 Tahun 1974 tentang Perkawinan. Dari hasil penelitian ini penulis mengambil kesimpulan bahwa Pasal 29 Undang-Undang Nomor 01 Tahun 1974 adalah satu-satunya peraturan yang berlaku di Indonesia yang mengatur mengenai pembuatan perjanjian perkawinan, namun atas dasar-dasar pertimbangan hukum Hakim yang penulis uraikan dalam penelitian ini maka Hakim mengabulkan permohonan pasangan suami isteri Junaida dan Kazuo Sawachi dalam Penetapan Pengadilan Negeri Jakarta Timur Nomor : 2173/Pdt.P/2012/PNJkt.Tim.,
dan setelah tanggal ditetapkannya maka penetapan Pengadilan tersebut dapat dijadikan sebagai dasar hukum dalam menjalankan pemisahan harta bersama di dalam perkawinan mereka

Under the terms of Article 29 paragraph (1) of Law Number 1 of 1974 on Marriage, it is stipulated that a prenuptial agreement shall be made on or before the performance of the marriage by the bride and groom. However, because of the lack of public knowledge regarding the creation of a prenuptial agreement, many married couples in Indonesia enter into a prenuptial agreement after the marriage takes place on the grounds of legal protection of each of their personal properties associated with occupational responsibility risks or the dissolution of a marriage by divorce. In this study, the author used the juridical normative research method with the descriptive analytical research type. The data used is secondary data, i.e. data in the form of literature studies and studies on the Court Order of the East Jakarta District Court No. 2173/Pdt.P/2012/PNJkt.Tim. This study was conducted to determine and analyze the basis of the judges' considerations in determining the aforementioned Court Oder, given that the petition of the Court Order to legitimize the prenuptial agreement after the officiation of the marriage was contrary to the provisions of Article 29, paragraph (1) of Law Number 01 Year 1974 on Marriage. From the result of this research, the author concludes that Article 29 of Law Number 1 of 1974 is the only rule in Indonesia that regulates the creation of prenuptial agreements. Nevertheless, on the grounds of the legal considerations of the judge that the author describes in this research, the judge granted the request of the couple Junaida and Kazuo Sawachi through East Jakarta District Court Order Number 2173/Pdt.P/2012/PNJkt.Tim., and after the date of its enactment, the aforementioned court order may be used as a legal basis in the dividing of the joint property in their marriage."

"Tesis ini membahas mengenai tinjauan akta perjanjian perkawinan yang dibuat di Indonesia oleh notaris di Indonesia untuk perkawinan campuran beda kewarganegaraan antar Warga Negara Indonesia dengan Warga Negara Australia yang mana perkawinannya itu dilangsungkan di negara bagian New South Wales - Australia berdasarkan hukum perkawinan Australia. Maka timbul permasalahan mengenai kedudukan akta perjanjian perkawinan yang dibuat di Indonesia dalam hukum perkawinan di Australia. Apakah akta perjanjian perkawinan tersebut berlaku dan diakui kedudukannya sebagai perjanjian perkawinan di Australia atau tidak. Permasalahan ini diteliti dengan menggunakan pendekatan metode yuridis normatif dan deskripsi analitis, yaitu berupa kajian terhadap asas-asas dan norma hukum yang terdapat dalam ketentuan perundang-undangan Indonesia yang berkaitan dengan perjanjian perkawinan campuran beda kewarganegaraan dan dilihat dari teori-teori Hukum Perdata Internasional yang terkait dengan masalah perjanjian perkawinan yang bersifat internasional ini. Serta peraturan dan perundang-undangan Australia yang mengatur mengenai perkawinan, perjanjian perkawinan dan pengakuan perjanjian perkawinan yang dibuat di luar Australia. Sebagai hasil dari penelitian ini, bahwa Australia hanya mengakui perjanjian perkawinan asing bilamana segala persyaratan tentang tata cara pembuatan perjanjian perkawinan Bindin Financial Agreement di Australia. Jadi dalam kasus tesis ini akta perjanjian perkawinan yang dibuat oleh notaris di Indonesia tidak diakui dan secara hukum tidak mengikat. This thesis is the review of a prenuptial agreement deed that made in Indonesia by Indonesian Public Notary for a mixed marriage with different nationalities between an Indonesian nationality and an Australian nationality, where the wedding was held in New South Wales - Australia. Is the prenuptial deed above valid and recognise as prenuptial agreement in Australia. The above conflicts, has been reviewed and obsereved by the writer using a yuridis normative method and deskriptive analitic, law principles rules by Indonesian regulation related with mixed marriage prenuptial agreement subject, also using the principles by International Private Law, Australian Acts and regulation that rules international mixed marriage on how foreign prenuptual agreement is recognise in Australia. The result has come up that Australian only recognise foreign prenuptial agreement as long as it meet with all the requirements on how Australian make a binding financial agreement. So in this case, the prenuptial agreement deed made by Indonesian public notary in Indonesia does not recognise and does not binding in Australian. Its use for the judge in Family Court for a concideration only. "

"Ketidakjelasan muncul terkait keabsahan perjanjian kawin pasangan suami istri pemeluk agama Katolik yang perceraiannya tidak didaftarkan pada Dinas Kependudukan dan Pencatatan Sipil. Dapat dikatakan, bahwa pasangan suami istri yang tidak mendaftarkan perceraiannya pada Dinas Kependudukan dan Pencatatan Sipil masih terikat perkawinan yang sah, walaupun telah mendapatkan putusan pengadilan. Permasalahan menjadi semakin kompleks, manakala pasangan suami istri tersebut ingin melakukan perkawinan kembali dengan pasangannya terdahulu. Penelitian menggunakan bahan hukum primer berupa perundang-undangan yang berkaitan dengan perkawinan menurut hukum negara dan agama Katolik serta mengenai perjanjian kawin. Bahan hukum sekunder berupa buku-buku dan wawancara dengan romo dan hakim. Bahan-bahan hukum tersebut kemudian dianalis secara kualitatif. Perjanjian kawin pasangan suami istri pemeluk agama Katolik pada perceraian yang tidak didaftarkan dalam hal terjadi perkawinan kembali tetap sah, kecuali pasangan suami istri tersebut telah membatalkan terlebih dahulu. Notaris selaku pembuat perjanjian kawin juga hendaknya memberikan penyuluhan hukum terkait pentingnya pendaftaran perceraian, dimana dalam perkawinan tersebut diikuti dengan perjanjian kawin.

Unclear status prenuptial agreement arise in catholic marriage if the divorce is not registered in civil registrar. In Indonesia, divorce will be legalized if the couple register their divorce in the civil registrar after the judge grant their request on court proceeding. However, complex situation arise whenever the couple want to do remarriage since catholic does not allow divorce. Furthermore, the notary as the one who create the prenuptial agreement should give clear understanding on legal consequences after creating prenuptial agreement in relation to catholic and Indonesian marriage.A critical question posed in this scene is, does the remarriage process legal under Indonesian law? Does the prenuptial agreement still valid? To answer those questions The research will based on primer sources of law which are indonesia marriage law and catholic marriage law; and secondary sources of law which are books & interview with Churchmans and judges. In addition to that. The research method will based on qualitative approach."

"Penelitian ini membahas mengenai jual beli tanah dan bangunan di Indonesia yang dilakukan oleh pasangan kawin campur yang merupakan harta bersama. Hal ini dikarenakan banyaknya pasangan kawin campur yang tidak melakukan perjanjian pemisahan yang tidak mengetahui mengenai pengaturan jual beli tanah dan bangunan di Indonesia yang diperbolehkan bagi pasagan kawin campur menurut hukum tanah nasional. Dalam penelitian ini penulis mengambil contoh kasus pasangan kawin campur yaitu nyonya X yang berkewarganegaraan Indonesia yang menikah dengan Tuan Y yang berkewarganegaraan Amerika Serikat, yang membeli rumah dengan hak berupa HGB dengan harta bersama atas nama nyonya X. Permasalahan yang dibahas dalam penelitian ini mengenai apakah pasangan kawin campur dapat melakukan jual beli tanah dan bangunan di Indonesia dengan harta bersama terkait pengaturan hak atas tanah tertentu dalam UUPA, dan bagaimana keabsahan jual beli tersebut serta upaya yang dapat dilakukan oleh pasangan kawin campur tersebut untuk dapat memiliki tanah di Indonesia. Penelitian ini menggunakan metode penelitian yuridis normatif. Hasil penelitian menunjukan menurut UUPA, hak yang dapat dimiliki oleh orang asing (WNA), termasuk dalam hal ini mereka yang menikah dengan WNI dan tidak melakukan pemisahan harta, adalah hanya Hak Pakai. Sehingga apabila tanah dan bangunan yang hendak dibeli tidak sesuai seperti Hak Milik dan HGB maka harus dilakukan perubahan hak terlebih dulu sebelum dilakukan jual beli.

This study explains about the sale and purchase of land and property in Indonesia that is conducted by mixed marriage couple which is a community property. It is because of there are so many mixed marriage couple who did not make a prenuptial agreement before their marriage and also do not know anything about the provisions that regulate about sale and purchase on land and properties in Indonesian Law. In this study, the writer take a mixed marriage couple as the case sample in which, there is Mrs. X who is an Indonesian citizen and his husband, Mr. Y, who is an American citizen. This sample couple has bought the right of building even though they did not make a prenuptial agreement first before their marriage. The problem in this study is about whether a mixed marriage couple which did not make a prenuptial agreement can conduct a sale and purchase agreement on land and properties in Indonesia or not, and also about the impact of such agreement and what they could do to have an ownership right on land and properties in Indonesia. By using normative juridical method, this study gives a conclusion that the only rights on land and properties in Indonesia that can be owned by a mixed marriage couple who did not have a prenuptial agreement is only The Right to Use. So, if the mixed marriage couples want to purchase a land or properties on which the right is The Ownership Right or The Right of Building, they should change it into The Right to Use first."

"Penulisan ini membahas mengenai kedudukan hukum akta perjanjian perkawinan yang dibuat oleh Notaris terhadap pelaku perkawinan beda agama di Indonesia (studi kasus Notaris X di Jakarta Barat). Adanya perkembangan mengenai pengesahan pencatatan perkawinan beda agama di Indonesia dan juga pengalaman Notaris X yang seringkali membuat akta perjanjian perkawinan yang para penghadapnya beda agama menjadi dasar bagi Notaris X untuk membuat akta perjanjian perkawinan bagi Tuan A yang beragama Kristen dan Nyonya B yang beragama Buddha. Hal tersebut menimbulkan pertanyaan mengenai kedudukan akta perjanjian perkawinan beda agama yang dibuat oleh Notaris X dan mengenai batasan hukum serta langkah hukum bagi seorang Notaris dalam membuat akta perjanjian perkawinan beda agama di Indonesia. Bentuk penelitian ini adalah yuridisnormatif dengan tipe penelitian eksplanatoris. Pada akhirnya akta perjanjian perkawinan beda agama yang dibuat oleh Notaris X ialah batal demi hukum dikarenakan tidak memenuhi ketentuan syarat objektif perjanjian. Selanjutnya akta perjanjian perkawinan yang dibuat oleh seorang Notaris tidak boleh bertentangan dengan ketentuan agama, kesusilaan dan ketertiban umum sebagaimana ternyata dalam Pasal 29 ayat (2) UndangUndang Nomor 1 Tahun 1974 tentang Perkawinan. Adapun seorang Notaris dalam menghadapi akta perjanjian perkawinan beda agama, seorang Notaris harus mengedepankan prinsip kehati-hatian dalam menjalankan tugas jabatannya.

This writing discusses the legal position of the marriage agreement deed made by a Notary against interfaith marriage actors in Indonesia (case study of Notary X in West Jakarta). The developments regarding the legalization of the registration of interfaith marriages in Indonesia and also the experience of Notary X who often makes marriage agreement deeds where the parties are of different religions becomes the basis for Notary X to make a marriage agreement deed for Mr. A who is a Christian and Mrs. B who is a Buddhist. This raises questions about the position of the interfaith marriage agreement deed made by Notary X including the legal limitations and legal steps for a Notary in making the interfaith marriage agreement deed in Indonesia. The form of this research is juridical-normative with explanatory research type. In the end, the deed of interfaith marriage agreement made by Notary X was null and void because it did not meet the provisions of the objective conditions of the agreement. Furthermore, the marriage agreement deed made by a Notary may not conflict with the provisions of religion, morality and public order as stated in Article 29 paragraph (2) of Law Number 1 of 1974 concerning Marriage. As for a Notary in dealing with an interfaith marriage agreement deed, a Notary must prioritize the principle of prudence in carrying out his duties."
