"Banyaknya yayasan yang telah melampaui batas waktu penyesuaian anggaran dasarnya dengan Undang-Undang Yayasan nomor 16 tahun 2001 Juncto Undangundang nomor 28 Tahun 2004 serta dikaitkan dengan Peraturan Pemerintah Nomor 63 Tahun 2008 tentang Pelaksanaan Undang-undang tentang Yayasan menjadi latar belakang penulisan tesis ini. Pokok permasalahan adalah mengenai status yayasan, akibat hukum terhadap harta kekayaan yang dimiliki yayasan serta tanggung jawab pengurus yang anggaran dasarnya telah melampaui batas waktu penyesuaian menurut undang-undang nomor 28 tahun 2004 dikaitkan dengan Peraturan Pemerintah nomor 63 tahun 2008. Penelitian ini dilakukan berdasarkan penelitian hukum normatif yang bertujuan untuk mengadakan sistematisasi terhadap bahan-bahan hukum tertulis guna memudahkan pekerjaan analisa dan kontruksi hukumnya serta menemukan hukum m concreto dengan tipe penelitian yang digunakan adalah eksplanatoris dan berfokus masalah sehingga dapat diperoleh jawaban permasalahan bahwa yayasan yang telah melapaui waktu penyesuaian anggaran dasarnya dengan Undang-Undang yayasan nomor 16 tahun 2001 Juncto Undang-undang nomor 28 Tahun 2004 serta dikaitkan dengan Peraturan Pemerintah Nomor 63 Tahun 2008 tentang Pelaksanaan Undangundang tentang Yayasan berakibat pada hilang status hukum atas badan hukum yayasan tersebut yang berdampak pada harta kekayaan yayasan serta tanggung jawab pengurus terhadap yayasan.

The number o f foundations which have exceeded the time o f the statutes adjustment with Law on Foundations Number 16 o f 2001 Juncto Law Number 28 of 2004 correlated to Government Regulation Number 63 o f 2008 about the Implementation of The Law on Foundations is the background o f this thesis. The subject of problems are concerning about the status o f the foundation, resulting from the law of the assets owned by foundation, and the management's responsibility that its foundations statutes exceeded the adjustment deadline in accordance with Law No. 28 of 2004 correlated to Government Regulation Number 63 of 2008. This research based on the normative law research that purposed to hold the systematization of written law materials in order to facilitates analysis and construction o f the law also find the law in concrete with the type of the research that is used explanatories and focus on the problem so it is able to get the answer of the problem that the foundations which have exceeded the time of the statutes adjustment with the Law on Foundations Number 16 of 2001 Juncto Law Number 28 o f 2004 correlated to Government Regulation Number 63 of 2008 about the Implementation of The Law on Foundations as the result, the law status of the law on foundation is lost it is impact on the foundation?s assets and the management's responsibility of the foundation."
