"Tesis ini membahas mengenai pengaturan jaminan kesehatan yang diselenggarakan oleh Badan Penyelenggara Jaminan Sosial yang menerapkan prinsip kepersertaan wajib bagi seluruh penduduk di Indonesia, sementara penyelenggara jaminan kesehatan di Indonesia, secara garis besar terdiri dari negara dan swasta. Selain itu, ketentuan kepesertaan wajib tersebut juga disertai dengan sanksi berupa sanksi administratif bagi pemberi kerja selain penyelenggara negara dan bagi setiap orang yang tidak melaksanakan kewajiban sebagaimana ketentuan yang dimaksud. Ketentuan tersebut dianalisis dengan menggunakan pendekatan yuridis normatif, salah satunya yaitu dengan paradigma hukum persaingan usaha, di Indonesia diatur dalam UU No.5 Tahun 1999 tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat. Berdasarkan ketentuan UU No. 5 Tahun 1999, maka BPJS kesehatan menguasai lebih dari 50% (lima puluh persen) pangsa pasar jaminan kesehatan, namun monopoli BPJS tersebut berdasarkan pasal 50 dan pasal 51 UU No.5 Tahun 1999, tidaklah bertentangan dengan UU No.5 Tahun 1999 atau disebut state action doctrine, yang dimaksudkan untuk mewujudkan kesejahateraan sosial bagi seluruh rakyat Indonesia.

This thesis discusses the health insurance arrangements organized by the Social Security Administrators to apply the principle of compulsory membership for the entire population in Indonesia, while the insurance carrier in Indonesia, generally consist of state and private. In addition, the provisions of the membership shall also be accompanied by sanctions in the form of administrative sanctions for employers other than state officials, and for every person who does not carry out its obligations as the provisions in question. The provision is analyzed using juridical normative, one of them is the paradigm of Antitrust Law, in Indonesia as stipulated in Law Concerning Prohibition of Monopolistic Practices And Unfair Business Competition. Under the provisions of Law No. 5, 1999, the health BPJS controls more than 50% (fifty percent) share of the health insurance market, but monopoly BPJS under article 50 and article 51 of Law No. 5 of 1999, it is not contrary to the Law No. 5 of 1999 or the so-called state action doctrine, which is intended to achieve social welfare for all Indonesian people."
