"ABSTRAK
The Concept of Private Finance Initiative (PFI) or Public Private Partnership
(PPP) has been internationally implemented over the last two decades. In Malaysia, even though the involvement of the private sector in assisting with the provision of public services and facilities is not new, only recently under the Ninth Malaysia Plan the government officially announced the implementation of projects using P FI scheme in order to promote greater involvement of the private sector in delivering public services (Ninth Malaysia Plan, 2006). Consequently, a series of PFI projects is now being implemented including some already under construction. However, little is known on the real nature of the Malaysian PFI One of the aspects
considered critical in the implementation of a P FI project is the need for a public sector comparator (PSC) to demonstrate that the project can achieve value for money through comparing the public sector comparator (PSC) with the bid or bids submitted by the private sect01: The study being reported herein focuses on the concept of PFI as practiced in Malaysia and the construction of a PSC. Given that under the Malaysian PFI, the PSC is yet to be established there is an urgent need for one to be constructed. In addition, critical issues concerning the transfer of risks and the determination o.f discount rate are also discussed. The study combines literature review on P Fl and interviews with civil servants involved in the implementation of P FI in Malaysia."

"Perwujudan tata kelola global tidak selalu berupa institusi supranasional, melainkan dapat berupa transmisi gagasan global di tataran domestik. Gagasan tersebut seringkali dianggap banal tanpa mempertanyakan kepentingan di baliknya. Skripsi ini berusaha menelusuri gagasan public private partnership yang marak dipromosikan sebagai skema pendanaan infrastruktur di Indonesia, terutama periode 2005-2015. Fenomena ini diteliti menggunakan perspektif kritis neogramscian dalam memahami tata kelola global di tingkat domestik dengan fokus aktor utama World Bank. Skripsi ini menemukan bahwa terdapat hegemoni kebijakan neoliberalisme Post-Washington Consensus World Bank dalam manajemen sektor public goods di Indonesia.

The concept of global governance is not exclusively embodied as supranational institution global ideas might be transferred to domestic level instead. Yet, it has been neglected and taken for granted despite underlying interest. This thesis scrutinize the infamous public private partnership as Indonesia infrastructure financing scheme in particular period 2005-2015. Applying neogramscian critical perspective of global governance, this thesis aims to apprehend global governance within domestic institutions in particular World Bank as the main actor. This thesis suggest that there is a hegemon of World Banks Post Washington Consensus neoliberalism prescribed policy in Indonesias public goods management sector."

"ABSTRAK
Sukuk atau obligasi syariah sering dianggap sebagai alternatif obligasi yang lebih stabil. Namun faktanya pada pasar, jumlah sukuk yang ada masih kecil angkanya dan bahkan mengalami perlambatan pertumbuhan. Di satu sisi, return dan risiko melekat erat dengan investasi. Oleh sebab itu, penulis meneliti risiko diantara kedua instrumen dengan tujuan untuk membuktikan secara empiris bahwa sukuk dan obligasi berbeda dari sudut pandang resiko. Selain itu, penulis juga akan meneliti apakah sukuk memiliki fungsi diversifikasi terhadap obligasi. Value-at-risk dengan pendekatan delta-normal dan uji beda menjadi metode yang dipakai dalam mengolah data return harian obligasi dan sukuk Malaysia bertenor 7 tahun. Penulis menemukan bahwa obligasi memiliki return yang lebih tinggi, namun sukuk memiliki resiko kerugian yang lebih kecil. Sukuk juga memiliki fungsi diversifikasi terhadap obligasi yang baik untuk diterapkan dalam melakukan investasi pada portofolio.

ABSTRACT
Sukuk or Islamic bond has been discussed as a more stable alternative to conventional bonds. But in facts, the number of sukuk issued is still small and even has been decreasing in growth. In other hand, return and risk are highly related to investment. That being mentioned, the risk between two instruments is being researched with the purpose to prove empirically that sukuk are different to conventional bonds from risk perpective. The diversification function of sukuk to bonds is also being researched. Value at risk with delta normal approach and t test are the methods used to process the daily return data of 7 years sukuk and bonds in Malaysia. Results revealed bonds tend to have higher mean return, while sukuk is proven to have less risk. Sukuk is also proven to have diversification function to bonds, which is good to be invested on portfolio."

"Kitab Undang-Undang Hukum Perdata di Indonesia yang menganut sistem hukum Civil Law dan menggunakan kodifikasi hukum sebagai sumber hukum primer pada kenyataannya masih terdapat kekosongan pengaturan mengenai beberapa konsep ganti rugi yang dapat ditemukan di dalam berbagai kasus wanprestasi yang terjadi. Skripsi ini akan membandingkan hukum kontrak khususnya pada penentuan ganti kerugian akibat wanprestasi di Indonesia dengan Malaysia dimana dalam hal ini sebagai negara penganut sistem hukum Common Law. Penelitian ini merupakan penelitian yuridis normatif dan hasil dari penelitian ini berisi bahwa terdapat persamaan dan perbedaan diantara pengaturan konsep ganti rugi di Indonesia dan Malaysia.

Indonesian Civil Code which adheres to Civil Law legal system and uses legal codification as the primary source of law, in fact there is still a lack of regulation regarding several compensation concepts that can be found in various cases of default or breach of contract. This thesis compares the law of contracts especially about determination of default damages in Indonesia and Malaysia. This study is a normative juridicial research and the result of this study indicate that there are similarities and differences between the regulation of the concept of compensation in Indonesia and Malaysia."
