"Pengangkutan barang melalui laut telah menjadi pondasi utama dalam perdagangan internasional. Menjadikan transportasi sebagai komponen penting dalam pertumbuhan ekonomi. Dalam pelaksanaannya kerugian pada kargo merupakan kejadian yang sering dijumpai, dalam waktu yang sama juga mengakibatkan kerusakan dan biaya yang tidak diingankan untuk para pihak dalam industri transportasi. Sebagaimana yang terjadi pada kapal M/V APL England yang mengalami kecelakaan dimana terdapat 40 kargo yang jatuh ke laut di Pantai Timur New South Wales, Australia. Pengaturan tanggung jawab pengangkut telah diatur lewat 3 rezim peraturan international yaitu Den Haag-Visby Rules, Hamburg Rules,dan Rotterdam Rules, sedangkan pada pengaturan maritim nasional telah tertuang dalam Undang-Undang No.17 Tahun 2008 Tentang Pelayaran. Melalui 4 peraturan tersebut akan dilakukan analisis terhadap pertanggungjawaban pengangkut terhadap kerusakan dan kehilangan barang pada kasus M/V APL England dan keberlakuan Undang-Undang No.17 Tahun 2008 Tentang Pelayaran terhadap kasus M/V APL England. Hasil penelitian menunjukan bahwa berdasarkan 4 peraturan yang ada diatas tanggung jawab atas kerusakan dan keterlambatan barang berada pada pengangkut. Selain itu Undang-Undang No.17 Tahun 2008 Tentang Pelayaran belum mencakup beberapa ketentuan pada Den Haag-Visby Rules, Hamburg Rules,dan Rotterdam Rules sehingga masih perlunya unifikasi tehadap peraturan pengangkutan laut di Indonesia.

The transportation of goods by sea has become a major foundation in international trade. Making transportation an important component of economic growth. In practice, loss of cargo is a common occurrence, at the same time causing damage and unfortunate costs for parties in the transportation industry. As happened to the M/V APL England which had an accident where 40 cargoes fell into the sea on the East Coast of  New South Wales, Australia. The regulation of carrier responsibility has been regulated through 3 international regulatory regimes namely The Hague-Visby Rules, Hamburg Rules, and Rotterdam Rules, while the national maritime regulation has been contained in Undang-Undang No.17 Tahun 2008 Tentang Pelayaran. Through these 4 regulations, an analysis will be made of the carrier's liability for damage and loss of goods in the M/V APL England case and the applicability of Undang-Undang No.17 Tahun 2008 to the M/V APL England case. The results showed that based on the 4 regulations above, the responsibility for damage and delay of goods lies with the carrier. In addition, Undang-Undang No.17 Tahun 2008  has not included several provisions in the Hague-Visby Rules, Hamburg Rules, and Rotterdam Rules so that there is still a need for unification of sea transportation regulations in Indonesia."

"Penelitian ini mengkaji pertanggungjawaban para pihak dalam pengangkutan barang melalui laut, terutama pada kasus ketidakakuratan pendeklarasian barang berbahaya oleh pengirim, yang menyebabkan kerugian pada pengangkut. Penelitian ini bertujuan untuk menjelaskan regulasi mengenai pengangkutan barang berbahaya melalui laut dan batasan tanggung jawab para pihak berdasarkan hukum Indonesia dan konvensi internasional yang berlaku, serta menjelaskan pengalihan pertanggungjawaban dari American President Lines, Ltd. selaku carrier kepada CV Dua Sekawan Sejati selaku shipper/seller/merchant pada kasus ketidakakuratan pendeklarasian barang berbahaya pada konosemen berdasarkan Putusan Nomor 648/Pdt.G/2021/PN.Sby. Penelitian ini disusun menggunakan metode penelitian doktrinal dengan menyatukan, mengolah, dan menganalisis bahan hukum primer, sekunder, dan tersier melalui studi pustaka. Pokok-pokok pembahasan penelitian ini menekankan pada betapa krusialnya pemberitahuan dan pendeklarasian barang secara akurat pada konosemen oleh pengirim terhadap realita barang berbahaya yang dimuat agar pengangkut dapat memberikan penanganan yang sesuai demi meminimalisir risiko yang mungkin terjadi. Kewajiban pengirim untuk bersikap transparan atas barang yang dimuat diatur secara eksplisit dalam berbagai konvensi internasional, seperti The Hague Rules, The Hague-Visby Rules, The Hamburg Rules, dan The Rotterdam Rules. Konvensi-konvensi internasional tersebut juga menegaskan bahwa pertanggungjawaban atas ketidakakuratan deskripsi paket dan barang dibebankan pada pengirim. Akan tetapi, fakta bahwa pengangkut merupakan pihak yang menerbitkan konosemen membuat pengangkut dianggap harus bertanggung jawab atas ketidaksesuaian antara realita barang dengan deskripsi pada konosemen yang diterbitkannya. Maka dari itu, pengalihan pertanggungjawaban terhadap ketidaksesuaian paket dan barang pada konosemen harus dituliskan secara eksplisit dalam indemnity clauses pada bill of lading dan bill of lading terms and conditions. Indemnity clauses tersebut memberi kepastian bahwa pihak yang menyebabkan kerugian akan bertanggung jawab atas segala kerugian, biaya, dan denda yang disebabkan olehnya.

This research examines the liability of parties involved in the carriage of goods by sea, particularly in the case of misdeclaration of dangerous goods by the shipper, which results in losses to the carrier. This research aims to explain the regulations regarding the carriage of dangerous goods by sea and the limitations of the parties' liability based on applicable Indonesian law and international conventions, as well as to explain the transfer of liability from American President Lines, Ltd. as the carrier to CV Dua Sekawan Sejati as the shipper/seller/merchant in the case of misdeclaration of dangerous goods on the bill of lading based on Decision Number 648/Pdt.G/2021/PN.Sby. This research employs a doctrinal research method utilizing primary, secondary, and tertiary legal materials through library research. This research highlights the importance of notification and accurate declaration of dangerous goods on the bill of lading by the shipper so that the carrier can take appropriate measures to mitigate potential risks. The shipper's obligation to be transparent is explicitly regulated in various international conventions, such as The Hague Rules, The Hague-Visby Rules, The Hamburg Rules, and The Rotterdam Rules. These international conventions also emphasize that liability for inaccurate description of goods is imposed on the shipper. However, the fact that the bill of lading is issued by the carrier makes the carrier liable for any discrepancy between the actual goods and the description on the bill of lading issued. Therefore, the transfer of liability for the said discrepancies must be explicitly written in the form of indemnity clauses on the bill of lading and bill of lading terms and conditions. These indemnity clauses ensure that the party causing the loss will be liable for all damages and expenses incurred."

"Bill of lading dan sea waybill adalah dokumen pengangkutan yang diterbitkan oleh pengangkut untuk membuktikan adanya perjanjian pengangkutan barang melalui laut. Skripsi ini menganalisis penggunaan bill of lading dan sea waybill dalam menagih penyerahan atas barang pada pengangkutan barang melalui laut dan alasan bank hanya menerima bill of lading sebagai syarat dokumen untuk menerbitkan letter of credit. Dengan menggunakan metode yuridis normatif, skripsi ini menyimpulkan bahwa penggunaan bill of lading untuk menagih penyerahan atas barang dalam kegiatan pengangkutan barang melalui laut adalah dengan menyerahkan satu rangkap lembar asli bill of lading kepada pengangkut. Hal tersebut disebabkan karena bill of lading termasuk ke dalam kategori surat berharga yang hak tuntutan utangnya melekat pada lembar asli surat berharga. Adapun penggunaan sea waybill cukup dengan menunjukkan tanda identitas yang membuktikan orang yang menagih penyerahan barang muatan adalah orang yang namanya tercantum sebagai penerima barang pada sea waybill. Penelitian ini juga menyimpulkan bahwa setidaknya terdapat dua alasan bank hanya menerima bill of lading sebagai syarat dokumen untuk membuka letter of credit. Alasan pertama adalah karena bill of ladingmemiliki fungsi sebagai dokumen kepemilikan barang. Oleh karenanya bank dapat menahan bill of lading sampai pembuka letter of credit melunasi kreditnya. Alasan kedua adalah bill of lading sebagai surat berharga memiliki sifat yang mudah untuk diperjualbelikan. Sifat bill of lading yang mudah untuk diperjualbelikan tersebutlah yang dapat memberikan jaminan kepada bank penerbit letter of credit. Berdasarkan hasil penelitian, saran yang dapat diajukan adalah perbankan perlu mempertimbankan untuk menerima sea waybill sebagai syarat dokumen untuk menerbitkan L/C karena adanya peningkatan penggunaan sea waybill.

Bill of lading and sea waybill are transport documents issued by the carrier as evidence of a contract carriage of goods by sea. This thesis analyzes the use of bill of lading and sea waybill in billing for delivery of goods in the carriage of goods by sea and the reasons banks only accept bills of lading as a required document for issuing letters of credit. By using the normative juridical method, this thesis concludes that the use of a bill of lading to bill the delivery of goods is to hand over one set original bill of lading to the carrier. This is because the bill of lading classified as a negotiable instrument which the billing right is attached to the original paper. Otherwise for the use of the sea waybill, it is enough to show an identity letter proving that the person who bill the delivery of goods is the person whose name is listed as the consignee. This thesis also concludes that there are at least two reasons why banks only accept bills of lading as a required document for issuing letter of credit. The first reason is because the bill of lading has a function as a document of title. Therefore, the bank can withhold the bill of lading until the applicant pays off the loan. The second reason is that bill of lading as a negotiable instrument are easy to trade. That matter causes bill of lading can provide guarantees to the bank. Based on the results of the research, the suggestion is that banks need to consider accepting sea waybill as a required document for issuing L/Cs due to an increase in the use of sea waybill."
