"Cedera tentunya menjadi salah satu hal menakutkan dan sangat merugikan bagi seorang atlet, bukan hanya menjadi penghalang untuk mengejar gelar namun juga bisa memaksa seorang atlet mengakhiri karirnya. Oleh karena itu cedera atlet harus segera diobati dengan benar. Pada kenyataannya, tidak jarang terjadi perbedaan pendapat perihal siapa dan bagaimana pertanggungjawaban atas pengobatan atlet yang cedera tersebut. Kasus yang digunakan dalam skripsi ini memperlihatkan bahwa tidak ada regulasi yang jelas perihal pertanggungjawaban terhadap cedera atlet amatir. Walaupun demikian, Majelis Hakim demi keadilan mempertimbangkan bahwa harus adanya kewajiban yang bertimbal balik dan seimbang antara PERBASI Banyuwangi, KONI Banyuwangi, dan Pemerintah Daerah Banyuwangi dengan atlet yang telah bertanding mewakili kepentingannya, sehingga mereka dihukum untuk melakukan pemulihan kondisi kesehatan atlet tersebut hingga sembuh. Ada beberapa hal dalam putusan ini yang menurut penulis kurang tepat. Pemerintah seharusnya segera membuat peraturan yang jelas perihal pertanggungjawaban terhadap cedera atlet, khususnya bagi atlet amatir yang tidak memiliki kontrak kerja yang jelas seperti atlet profesional.
An injury becomes one of the horrifying and harmful thing for an athlete, not only becomes a barrier to pursue a title but also can force an athlete to end his her career. Therefore, an injured athlete has to be treated immediately. In fact, there are disagreements about who and how the responsibility takes on the injured athlete treatment. On the case used by this thesis shows that there is no clear regulation about the responsibility. Besides that, the tribunal consider that there should be a reciprocal obligation between PERBASI the Indonesian Basketball Organization Banyuwangi, KONI the Indonesian Olympic National Committee Banyuwangi, and the local government of Banyuwangi with the athlete who has competed representing its hometown, and so the judge convict PERBASI Banyuwangi, KONI Banyuwangi, and the local government of Banyuwangi to treat the athlete until normally fit. In the author rsquo s opinion, there are things in the judgment that are not correct. The local government should regulate about the responsibility on an injured athlete treatment immediately specially on amateur athlete that has no contract unlike a professional athlete."
