"Kemajuan yang begitu pesat dalam teknologi membuat dunia mengalami pergeseran. Saat ini, teknologi telah berperan sangat besar dalam kehidupan manusia dengan memberikan kemudahan bagi manusia dalam berbagai hal, salah satunya adalah dalam sektor transaksi. Perkembangan teknologi melahirkan online marketplace sebagai media bagi manusia melakukan transaksi secara online. Keberadaan dari online marketplace memberikan kemudahan karena manusia dapat melakukan transaksi dimanapun dan kapanpun. Salah satu transaksi yang dapat dilakukan pada online marketplace adalah transaksi obat. Namun, perlu diketahui bahwasanya transaksi obat tidak dapat dilakukan secara sembarangan karena Indonesia sebagai negara hukum telah mengatur regulasi untuk peredaran obat keras. Online marketplace sebagai pihak ketiga dalam transaksi obat keras perlu berperan untuk mengatur transaksi obat keras tanpa izin edar. Penelitian ini bertujuan untuk memahami mengenai peran online marketplace dalam penjualan obat keras tanpa izin edar, karena hingga saat ini masih terdapat oknum yang tidak bertanggung jawab dengan sengaja menjual obat keras tanpa izin edar di platformonline marketplace, dengan menggunakan Tokopedia sebagai bahan analisis. Penelitian ini dilakukan dengan metode penelitian yuridis normatif, yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau bahan sekunder. Setelah dilakukan analisis, kemudian dapat disimpulkan bahwasanya online marketplace berperan terhadap produk yang dipasarkannya dengan membuat peraturan mengenai syarat dan ketentuan yang berlaku terhadap produk yang diperbolehkan dan tidak dijual di platformnya dan melakukan pengecekan terhadap produk yang dipasarkan pada platformnya. Selain itu, penulis menemukan bahwa Indonesia telah menetapkan regulasi untuk mengatur izin edar obat keras, bahwa obat keras dapat dibeli jika menggunakan resep dokter saja dan hanya fasilitas pelayanan kefarmasian yang memiliki Surat Izin Apotek (SIA). Penulis juga menemukan bahwasanya online marketplace tidak berperan secara langsung dalam penjualan obat, sehingga online marketplace hanya akan menerima aduan dari pembeli dan meneruskan aduan tersebut kepada penjual atau kepada pihak ekspedisi yang bekerja sama dengan online marketplace.

Rapid advances in technology make the world experience a shift. Currently, technology has played a very large role in human life by providing convenience for humans in various ways, one of which is in the transaction sector. Technological developments gave birth to online marketplaces as a medium for humans to make transactions online. The existence of an online marketplace provides convenience because humans can make transactions anywhere and anytime. One of the transactions that can be made on the online marketplace is a drug transaction. However, it should be noted that drug transactions cannot be carried out haphazardly because Indonesia as a legal state has regulated regulations for the distribution of hard drugs. The online marketplace as a third party in hard drug transactions needs to play a role in regulating hard drug transactions without a distribution permit. This study aims to understand the role of the online marketplace in selling hard drugs without a distribution permit, because until now there are still irresponsible individuals who deliberately sell hard drugs without a distribution permit on the online marketplace platform, using Tokopedia as material for analysis. This research was conducted using normative juridical research methods, namely legal research conducted by examining library materials or secondary materials. After analysis, it can be concluded that the online marketplace plays a role in the products it markets by making regulations regarding terms and conditions that apply to products that are allowed and not sold on its platform and checking products marketed on its platform. In addition, the authors found that Indonesia has established regulations to regulate distribution permits for hard drugs, that hard drugs can only be purchased using a doctor's prescription, and only pharmaceutical service facilities that have a Pharmacy License (SIA). The author also finds that the online marketplace does not play a direct role in drug sales, so the online marketplace will only accept complaints from buyers and forward these complaints to sellers or to expedition parties who work closely with the online marketplace. "
