"Previous efforts at legal development have focused almost exclusively on state legal systems, many of which have shown little improvement over time. Recently, organizations engaged in legal development activities have begun to pay greater attention to the implications of local, informal, indigenous, religious, and village courts or tribunals, which often are more efficacious than state legal institutions, especially in rural communities. Legal pluralism is the term applied to these situations because these institutions exist alongside official state legal systems, usually in a complex or uncertain relationship. Although academics, especially legal anthropologists and sociologists, have discussed legal pluralism for decades, their work has not been consulted in the development context. Similarly, academics have failed to benefit from the insights of development practitioners. This book brings together, in a single volume, contributions from academics and practitioners to explore the implications of legal pluralism for legal development. All of the practitioners have extensive experience in development projects, the academics come from a variety of backgrounds, and most have written extensively on legal pluralism and on development."

"Penelitian ini menganalisis konsep kausa sebagai syarat sah perjanjian dalam sistem hukum Indonesia, Belanda, Prancis, dan Jerman. Penelitian ini bertujuan untuk menganalisis dan membandingkan konsep kausa sebagai syarat sah perjanjian dalam sistem hukum Indonesia, Belanda, Prancis, dan Jerman. Alasan utama dilaksanakannya penelitian ini adalah untuk memahami perbedaan penafsiran dan penerapan kausa dalam hukum perjanjian di keempat negara tersebut, serta memberikan saran bagi pembaruan hukum perdata di Indonesia. Metode penelitian yang digunakan adalah penelitian doktrinal dengan pendekatan komparatif, menggunakan data sekunder yang diperoleh melalui studi kepustakaan. Temuan penelitian menunjukkan bahwa konsep kausa di Indonesia perlu diadopsi dalam aturan lain untuk menghindari ketidakpastian hukum, sebagaimana telah dilakukan oleh Belanda dan Prancis setelah reformasi hukum perdata mereka.

This study analyzes the concept of causa as a valid condition for contracts in the legal systems of Indonesia, the Netherlands, France, and Germany. This study aims to analyze and compare the concept of causa as a valid condition for contracts in the legal systems of Indonesia, the Netherlands, France, and Germany. The primary reason for conducting this research is to understand the differences in interpretation and application of causa in contract law among these four countries, and to provide suggestions for the reform of civil law in Indonesia. The research method used is doctrinal research with a comparative approach, utilizing secondary data obtained through literature review. The findings indicate that the concept of causa in Indonesia needs to be adopted into other regulations to avoid legal uncertainty, as has been done by the Netherlands and France after their civil law reforms."
