"Dalam kasus kecelakaan lalu lintas, pada dasarnya tidak terlepas untuk menentukan bentuk kesalahan pelaku, apakah hal itu sebagai sebuah kesengajaan atau kelalaian dari si pengemudi. Secara logika, nampaknya menjadi sesuatu hal yang tidak mungkin apabila seseorang memiliki kesengajaan untuk menyebabkan kecelakaan dan menghilangkan nyawa orang lain. Lahirnya Undang-undang Nomor 22 tahun 2009 tentang Lalu Lintas dan Angkutan Jalan memandang kecelakaan tidak lagi sebuah kelalaian tetapi juga memenuhi unsur kesengajaan. Dengan kata lain, bahwa unsur kesengajaan menjadi kemungkinan dalam sebuah kasus kecelakaan. Seperti kasus kecelakaan lalu lintas dengan terdakwa Afriyani Susanti yang dituntut dengan unsur kesengajaan dalam Pasal 338 KUHP. Penanganan terhadap kasus ini kemudian menimbulkan polemik dari berbagai pihak termasuk Jaksa dan Hakim yang mengadili perkara ini. Hal ini dapat dilihat dalam putusan No. 665/Pid.B / 2012 / PN.
