"ABSTRAK
Tesis ini membahas konsep justice collaborator dalam praktik sistem peradilan
pidana Indonesia. Metode penelitian yang digunakan adalah penelitian yuridis
normatif. Pada mulanya Justice Collaborator hanya dikenal dalam Praktik Sistem
Peradilan Pidana Indonesia. Analisa penerapan konsep Justice Collaborator atas 3
(tiga) kasus yakni Agus Condro Prayitno, Kosasih Abbas dan dibahas Thomas
Claudius Ali Junaidi sebagai bahan analisis dalam tesis ini. Dari hasil analisis
diperoleh kesimpulan bahwa terdapat ketidakseragaman pemahaman dari para
penegak hukum dalam menerapkan Konsep Justice Collaborator dalam Praktik
Sistem Peradilan Pidana Indonesia. Untuk itu ada beberapa kriteria untuk dapat
dijadikan Justice Collaborator yaitu: tindak pidana yang akan diungkap merupakan
tindak pidana serius dan/atau terorganisir; bukan pelaku utama dalam tindak pidana
yang akan diungkapnya; memberikan keterangan sebagai saksi di dalam proses
peradilan; Jaksa Penuntut Umum dalam tuntutannya menyatakan bahwa yang
bersangkutan telah memberikan keterangan dan bukti-bukti yang sangat signifikan;
inisiatif dari pelaku kejahatan tersebut untuk mengakui perbuatannya dan bersedia
membantu aparat penegak hukum untuk mengungkap perkara dimaksud; Pelaku
kejahatan membuat perjanjian mengenai kedudukan nya sebagai Justice Collaborator
dengan Jaksa Penuntut Umum. Kedepan dibutuhkan formulasi dan konsepsi
pengaturan Justice Collaborator dalam proses hukum pidana sebagai upaya
pembaharuan hukum pidana di Indonesia serta integrasi antar penegak hukum untuk
mewujudkan Sistem Peradilan Pidana yang well-done-integrated dalam menerapkan
Konsep Justice Collaborator

ABSTRACT
This thesis discusses the concept of justice collaborator in the practice of the
Indonesian criminal justice system. The method used is a normative juridical
research. Justice Collaborator at first known only in Indonesia Practice Criminal
Justice System. Analysis of the application of the concept of Justice Collaborator on
three (3) cases namely Agus Condro Prayitno, Kosasih Abbas and Thomas Claudius
Ali Junaidi discussed as material analysis in this thesis. From the analysis we
concluded that there is a variation on the understanding among the law enforcement
officer in applying the concept of Justice Collaborator in Practice Criminal Justice
System. There are several criteria to fullfiled as Justice Collaborator, namely: a
criminal act that will be revealed is a serious criminal offense and / or organized; not
the main offender in the crime that will revealed; testified as a witness in the court;
Prosecution lawsuit alleges that the offender has provided information and evidence
is very significant; initiative of the offender to confess and willing to assist law
enforcement officer to uncover the case; offender made an agreement regarding his
position as Justice Collaborator with the Public Prosecutor. In the future there is
should be a formulation and conception of Justice Collaborator in the process of
criminal law as an effort to reform the criminal law in Indonesia as well as the
integration among law enforcement officer to created the well-done-integrated
Criminal Justice System in applying the concept of Justice Collaborator."
