"ABSTRAKIndonesia merupakan negara yang rawan akan keadaan bahaya. Untuk itu, perangkat hukum yang ada haruslah memadai agar dapat mengatasi keadaan bahaya tersebut. Namun, kewenangan yang diberikan kepada Pemegang Kekuasaan Eksekutif pada saat negara berada di dalam keadaan bahaya seringkali diiringi dengan kesewenang-wenangan. Skripsi ini akan menjabarkan dan meninjau kembali kewenangan-kewenangan yang diberikan kepada Pemegang Kekuasaan Eksekutif dalam rangka mengatasi keadaan bahaya dari masa ke masa dan mengklasifikasi teori keadaan bahaya yang dianut dari masing-masing masa pengaturan tersebut. Penelitian ini juga akan membandingkan pengaturan konstitusi di Indonesia terkait Keadaan Bahaya dengan konstitusi di negara-negara lainnya. ABSTRACTIndonesia is full of state of emergency hazards. Therefore, it rsquo s law needs to be able to overcome those threats. But the given authority of the Executive in times of emergency could become a tool of abuse. This Thesis will describe and review those power in times of emergency from time to time and determine which theory of exception that it imply. This research will also compare constitutional statutes pertaining state of emergency in Indonesia with other countries. By the end of this thesis, we will be able to know the authority of the Executive of Indonesia in times of emergency which include the matter of individual freedom, places, the use and claiming of material things, freedom of expression, communication, transportation, and in regards of rules. We shall be able to conclude that the authority that are given to the Executive of Indonesia regarding state of emergency are more of a Carl Schmitt rsquo s state of exception view than the Hans Kelsen rsquo s one. This research will also show that the rule in the constitution of Indonesia pertaining state of emergency doesn rsquo t follow the current trend of rulling in many countries."

"Era reformasi ditandai dengan adanya amandemen Undang-Undang Dasar 1945 yang berdampak pada pesatnya perkembangan pembentukan lembaga-lembaga baru utamanya lembaga negara penunjang. Lembaga-lembaga tersebut dibentuk dengan peraturan perundang-undangan mulai dari undang-undang dasar hingga peraturan presiden. Hal ini dilakukan demi menyelenggarakan pemerintahan secara lebih efektif dan efisien apalagi ditambah dengan kompleksitas permasalahan suatu negara yang semakin rumit dan fungsi tersebut tidak dapat lagi dijalankan oleh lembaga yang ada sehingga dibutuhkan lembaga-lembaga baru untuk mengisi kekosongan tersebut. Salah satu dari lembaga-lembaga baru itu adalah Kantor Staf Presiden yang merupakan lembaga yang bertugas untuk mendukung penyelenggaraan pemerintahan oleh Presiden dan Wakil Presiden. Meskipun demikian, pembentukan Kantor Staf Presiden menimbulkan pro kontra dari berbagai kalangan dari mulai adanya indikasi tumpang tindih hingga pemborosan anggaran. Indikasi tumpang tindih ini didasari atas banyaknya lembaga “penasihat” presiden yang sudah terlebih dahulu dibentuk sehingga hal tersebut berpotensi adanya pemborosan anggaran akibat menghabiskan anggaran terhadap lembaga yang sebenarnya fungsinya telah dijalankan oleh lembaga lain. Oleh karena itu, Skripsi ini membahas mengenai kedudukan dan kewenangan Kantor Staf Presiden.: Metode penelitian yang digunakan adalah yuridis normatif. Penelitian ini memberikan jawaban terkait kedudukan dan kewenangan Kantor Staf Presiden dalam sistem ketatanegaraan di Indonesia. Kemudian, potensi tumpang tindih akibat dibentuknya Kantor Staf Presiden dengan Lembaga pemerintah yang lainnya terkait tugas dan fungsi yang melekat pada lembaga-lembaga tersebut

The Reformation era was marked by the amendments of UUD 1945 which had impacts on the rapid development of forming of new institutions, especially state auxiliary bodies. These institutions are formed with regulations ranging from the constitution to presidential regulations. This is done in order to organize government more effectively and efficiently, especially coupled with the complexity of a nation's problems that are increasingly complex and this function can no longer be carried out by existing institutions so that new institutions are needed to fill the gap. One of the new institutions is Presidential Staff Office (Kantor Staf Presiden) which is an institution that tasked to support the administration of government by the President and Vice President. Although, the formation of the Presidential Staff Office raises the pros and cons of various groups ranging from indications of overlapping to wasteful budgets. This overlapping indication is based on the number of presidential "advisory" institutions that have been formed beforehand so that there is potential for a waste of budget due to spending the budget on an institution whose function has been carried out by other institutions. Therefore, this thesis discusses the position and authority of the Presidential Staff Office. This research use normative legal research method. This research provides answers related to the position and authority of the Presidential Staff Office in the constitutional law system in Indonesia. Then, the potential for overlapping as a result of the existence of the Presidential Staff Office with other government institutions related to the tasks and functions attached to these institutions."
