"The performance of a bad bureaucracy indicates a bureaucracy is riddled with problems; a pathology which arose not always coming from outside the bureaucratic body but pathology that has been flourishing and will be exerting in¬fluence when the bureaucracy is unhealthy. This research article would like to give an overview of the incidence of the pathological bureaucracy which argumentation pathology can prevent. The phenomenon occurs that the bureaucracy could not deliver good public services and bureaucracy is a den of disease. The specific purpose of this research is fo¬cused on finding ways of preventing the pathology of the bureaucracy that comes from a variety of scientific literature. The method in this research article is systematic reviews technique that tries to identify all the written evidence exists regarding research themes. The results of this study reveal that the pathology of the bureaucracy is something to be prevented if we want the bureaucracy to run the task properly one of the ways that can be done is to do a bureaucratic innovation (an innovation on structure, systems, culture]. The innovation of bureaucracy will not only make changes to the organization to prevent the pathology of the bureaucracy but also as an ingredient to do discretion for a government policy especially regional government."

Bagaimana kebutuhan PNS di lingkungan Kementerian Sosial penggunaan SOP sebagaimana diatur dalam Peraturan Menteri Sosial Nomor 32 Tahun 2012 serta bagaimanakah hukuman yang sebaiknya diterapkan terhadap pelanggaran SOP berdasarkan Peraturan Pemerintah Nomor 53 Tahun 2010? Keberadaan SOP bagi PNS merupakan pedoman dan panduan dalam melaksanakan kegiatan secara lebih efektif dan efisien. Keberadaan SOP tersebut membuat pelaksanaan kegiatan yang dilakukan oleh PNS menjadi lebih terukur dan dapat dilakukan evaluasi terhadap pelaksanaannya. SOP yang telah disusun dan ditetapkan tersebut juga sebagai pelindung bagi aparatur bagi terhadap kemungkinan-kemungkinan adanya tuduhan melakukan penyelewengan. Hukuman yang diterapkan terhadap pelanggaran SOP adalah hukuman disiplin yang mengacu kepada Peraturan Pemerintah Nomor 53 Tahun 2010 dengan melihat seberapa besar dampaknya terhadap organisasi. Kementerian Sosial perlu menyusun perencanaan yang lebih matang dan terintegrasi lintas sektor. Selain itu Kementerian Sosial juga perlu mengadakan sosialisasi dan internalisasi terkait SOP secara reguler dan periodik.

This thesis discussed bureaucracy reform in Ministry of Social Affairs related to standard operational procedures. This thesis used normative juridicial research. How is the need of civil servants in the Ministry of Social Affairs using SOP as regulated in the Regulation of the Minister of Social Affairs No. 32 of 2012 and how the penalties should be applied to the violation of SOP rsquo s based on Goverment Regulation No 53 of 2010 The existence of SOP is a guide of for more effectivly and efficiently civil servant activities. With the presence of SOP the civil servants acitivies become more measurable and evaluatable. SOP could be protector for civil servant for the posibility of allegations abuse. The penalty could be applied to SOP violation based on the disciplinary punishment which refers to Government Regulation Number 53 of 2010 by seeing how bid its impact to the organization. The Ministry of Social Affairs needs to develope a more mature and integrated plan among sectors. In addition, the Ministry of Social Affairs also needs to hold socialization and internalization related to SOP regularly and periodically."

"ABSTRAKSuap yang dilakukan kepada polisi merupakan upaya masyarakat yang melanggar lalu lintas untuk memotong birokrasi pengadilan pelanggaran lalu lintas. Kerumitan dan tidak seriusnya birokrasi penegakan hukum menimbulkan anggapan bahwa lebih baik memangkas prosedurnya dengan melakukan suap kepada petugas sejak awal pelanggaran diketahui. Suap menjadi pembiasaan yang diketahui melalui proses belajar hingga akhirnya membudaya karena terdapat pemahaman kolektif akan hal tersebut, baik di kalangan pelanggar maupun polisi. Perilaku suap yang dilakukan pelanggar lalu lintas terhadap aparat penegak hukum merupakan bentuk crime in everyday life karena dilakukan secara berulang-ulang setiap kali ada fenomena serupa. Kebiasaan yang terbentuk kemudian dikategorikan sebagai crime as culture karena adanya proses belajar dari pengalaman diri sendiri maupun orang lain, yang mana belajar itu sendiri terdapat dalam definisi budaya dan tindakan suap itu sendiri yang tergolong sebagai kejahatan. Kecenderungan tindakan ini untuk berulang kemudian menjadi collective meaning bagi setiap pelanggar lalu lintas. Pendekatan birokrasi yang personal juga menjadi masalah timbulnya peluang terjadi praktik suap dalam perkara pelanggaran lalu lintas, sehingga suap sebagai alternatif pemangkasan birokrasi akan dapat dikurangi ketika interaksi antara pelanggar dengan polisi tidak lagi bersifat langsung.

ABSTRACTBribery to the police is an effort done by people who have violated traffic laws to cut through the bureaucracy of traffic court. The complexity and the not serious nature of law enforcement bureaucracy resulted in the opinion that it is better to cut the procedures through bribery towards the official since the start of the known violation. Bribery becomes a norm that is known through learning process until it becomes a culture since there is collective understanding about it, both in the violators 39 case and the police itself. The bribery done by the traffic violators to the law enforcement official is a form of crime in everyday life because it is done repeatedly every time there is a similar phenomenon. The habit formed is then categorized as crime as culture because of the existence of learning process from self experience and also others 39 experience, and this learning itself is in the definition of culture and bribery itself is categorized as a crime. The inclination of this act of repeat itself becomes a collective meaning for each traffic violators. The personal approach of bureaucracy becomes an opportunity for bribery in traffic violations, thus bribery as an alternative of cutting through bureaucracy will be reduced when interaction between violators and the police is no longer direct."
