"Tesis ini membahas tentang Perlindungan Hukum dan Hak Asasi Manusia Pengungsi dan Pencari Suaka dari Asia yang masuk ke Indonesia untuk transit ke negara ketiga. Indonesia yang belum meratifikasi Konvensi 1951 tentang Penanganan Pengungsi mendapatkan sejumlah permasalahan dalam menghadapi Pengungsi dan Pencari Suaka yang transit di Indonesia. Termasuk di dalamnya upaya pemenuhan Hak-Hak Asasi Pengungsi dan Pencari Suaka. Metode yang digunakan dalam penulisan adalah metode penelitian normatif dengan pendekatan peraturan perundang-undangan, pendekatan historis, pendekatan komparatif, dan pendekatan konseptual. Dari hasil penelitian didapatkan pemahaman bahwa keengganan Indonesia untuk meratifikasi Konvensi 1951 tentang Penanganan Pengungsi menyebabkan Indonesia belum dapat menentukan sendiri status pengungsi. Sehingga harus bekerjasama dengan lembaga internasional yang fokus pada penanganan pengungsi, yaitu United Nation High Commissioner For Refugees UNHCR . Penulis juga menyarankan, Indonesia perlu melakukan ratifikasi terhadap Konvensi 1951 tentang Penanganan Pengungsi, agar dapat lebih leluasa membantu penanganan pengungsi yang transit dan hadir di Indonesia. Indonesia juga diharapkan bisa membantu semaksimal mungkin pemenuhan hak-hak asasi pengungsi dan pencari suaka yang transit di Indonesia dengan peraturan perundang-undangan yang ada.

This thesis discusses the Legal Protection and Human Rights of Refugees and Asylum Seekers from Asia who enter Indonesia for transit to third countries. Indonesia that has not ratified the Convention and Protocol Of Refugee 1951 on the Management of Refugees has received several problems facing Refugees and Asylum Seekers who transit in Indonesia. This includes efforts to fulfill the Refugees 39 and Asylum Refugees 39 Rights. The method used in writing is the normative research method with the approach of legislation, historical approach, comparative approach, and conceptual approach. From the research result, it is found that Indonesia 39 s reluctance to ratify the 1951 Convention on the Management of Refugees has made Indonesia unable to determine its own refugee status, so it must cooperate with international institutions focusing on refugee handling, United Nation High Commissioner For Refugees UNHCR . The authors also suggest that Indonesia needs to ratify the Convention and Protocol Of Refugee 1951 on the Management of Refugees, in order to more freely assist the handling of refugees who transit and present in Indonesia. Indonesia is also expected to help as much as possible the fulfillment of the basic rights of refugees and transit asylum seekers in Indonesia with existing laws and regulations."

"Selama UNHCR beroperasi di Timor Barat untuk menangani pengungsi yang eksodus dari Timor Timur pada tahun 1999, idealnya UNHCR menjalankan mandat utamanya, yaitu melindungi hak-hak dasar pengungsi dan menggalakkan solusi tahan lama bagi pengungsi. Akan tetapi, mandat tersebut tidak mampu UNHCR penuhi sehingga berakibat pada termarjinalisasinya pengungsi dalam kehidupan tanpa kepastian solusi. Melalui kacamata situasi pengungsi berlarut-larut, penelitian ini bertujuan untuk menganalisis faktor-faktor penyebab ketidakmampuan UNHCR memenuhi mandatnya tersebut.
Hasil penelitian menunjukkan empat faktor yang menghambat UNHCR memenuhi mandatnya di Timor Barat, yaitu:
1) kemampuan pendekatan terhadap pengungsi,
2) kepentingan politik negara host,
3) kapasitas organisasi dan
4) kompleksitas relasi antar aktor terkait.

During UNHCR operation in West Timor to deal with the exodus of refugees from East Timor in 1999, ideally UNHCR ran its primary mandate, which is to protect the basic rights of refugees and promote durable solutions for refugees. However, the mandate has not been able to be accomplished resulting in the marginalization of refugee's life without any certainty of solution. Through the lens of protracted refugee situations, this study aims to analyze the factors that cause the inability of UNHCR to fulfill its mandate.
The results show four factors that hinder UNHCR to fulfill its mandate in West Timor, namely:
1) the ability of approach to the refugees,
2) the political interests of host country,
3) the organizational capacity and
4) the complexity of relationships among the relevant actors.
