"ABSTRAKSkripsi ini membahas mengenai kedudukan Bank Indonesia dalamkepailitan bank dari kontruksi hukum Undang-undang No. 37 Tahun 2004Tentang Kepailitan dan Penundaan Kewajiban Pembayaran Hutang. Yangmenjadi pokok permasalahan dalam penulisan ini adalah dimana pada Pasal 2 ayat(3) Undang-Undangn ini menyebutkan hanya Bank Indonesia yang berwenangmengajukan permohonan pailit terhadap bank bermasalah, dan bukan parakreditor bank pada umumnya, maka dibahas juga kewenangan kepailitan bankoleh Bank Indonesia setelah kewenangan pengawasan bank dialihkan kepadaOtoritas Jasa Keuangan. Metode penelitian yang digunakan adalah pendekatanyuridis normatif untuk menghasilkan data yang bersifat deskriptif analitis. Melaluipenelitian ini diharapkan mampu memberikan jawaban mengenai aspek hukumterhadap kedudukan Bank Indonesia dalam kepailitan bank dengan melihatberbagai sudut pandang, terutama Undang-Undang Perbankan dan Undang-Undang Kepailitan
