"The authors address the rights and duties of States in preventing and mitigating disasters, in facilitating access to their territory for humanitarian relief actors, as well as issues related to liability and compensation. Due attention is paid to European Union law governing disaster response (and to its reform in the light of the Lisbon Treaty) and to the main trends in domestic legislation. Human rights obligations are thoroughly examined and the potential relevance of international criminal law is assessed. Additional topics such as the status of relief personnel, the hindrances to the delivery of relief consignments by customs and excise administration, the use of civilian and military defence assets in emergency situations, the mechanisms and procedures available to offer financial support for recovery and rehabilitation, risk insurance, and the issue of corruption during disaster-related activities are specifically addressed."

"Asia Tenggara secara statistik merupakan wilayah yang paling rawan bencana di dunia, menyumbang lebih dari 50% kematian akibat bencana global. Dengan latar belakang ini, the ASEAN Agreement on Disaster Management and Emergency Response (AADMER) berdiri sebagai instrumen terkait manajemen risiko bencana yang mengikat secara hukum pertama di dunia yang telah diratifikasi oleh semua negara anggota ASEAN dan mulai berlaku pada tahun 2009. Menggunakan metode penelitian hukum kualitatif dan normatif, skripsi ini bertujuan untuk menganalisis implementasi AADMER sebagai kerangka kerja yang mengikat secara hukum di ASEAN dengan menggali, pertama, kekuatan mengikat perjanjian tersebut terhadap negara-negara anggotanya; kedua, mekanisme kerja AADMER, khususnya melalui mesin operasionalnya AHA Centre; dan ketiga, implementasinya dalam rezim manajemen risiko bencana domestik masing-masing negara anggota. Kemudian, skripsi ini akan mengevaluasi implementasi AADMER pada kasus Topan Haiyan yang melanda Filipina pada tahun 2013. Disimpulkan bahwa, pertama, kekuatan mengikat AADMER sebagai kerangka manajemen risiko bencana regional pada negara-negara anggota ASEAN bertumpu pada kewajiban bagi negara-negara anggota untuk menerjemahkan ketentuan AADMER ke dalam hukum domestik, dan meskipun negara-negara anggota secara umum sudah menerapkan ketentuan AADMER, hukum domestik mereka belum memperjelas peran AADMER atau AHA Centre; kedua, bahwa mekanisme kerja AADMER sangat bergantung pada Negara Terdampak, sehingga diperlukan persetujuan dan permintaan Negara Terdampak untuk memobilisasi AHA Centre; dan ketiga, implementasi AADMER pada saat Topan Haiyan 2013 belum memadai karena kurangnya koordinasi selama fase tanggap darurat bencana dan kurangnya sumber daya manusia dan finansial.

Southeast Asia is statistically the most disaster-prone region in the world, contributing to more than 50% of global disaster mortalities. Against this backdrop, The ASEAN Agreement on Disaster Management and Emergency Response (AADMER) stands as the world’s first legally binding disaster risk management-related instrument that was ratified by all ASEAN member states and entered into force in 2009. Using qualitative and normative legal research, this thesis aims to analyze the implementation of AADMER as a legally binding framework in ASEAN by delving into, first, the treaty’s binding force upon its member states; second, the working mechanism of AADMER, particularly through its operational engine AHA Centre; and third, its implementation in each member state’s domestic disaster risk management regime. Then, this thesis will evaluate AADMER’s implementation during Haiyan Typhoon that hit the Philippines in 2013. From the analysis, it was concluded that, first, AADMER’s binding force as a regional disaster risk management framework upon ASEAN member states rests in the obligation for member states to translate AADMER provisions into domestic law, and while member states have generally applied AADMER provisions, none of their municipal law acknowledge AADMER or AHA Centre; second, that the working mechanism of AADMER is heavily reliant on the Affected State, so the Affected State’s consent and request is required to mobilize AHA Centre; and third, the implementation of AADMER during Haiyan Typhoon 2013 was inadequate due to the lack of coordination during the disaster response phase and the lack of financial and human resources.
