"The implementation of large scale industrial farming investment involves land deals that
are not only being navigated through regulated practices, but state and non—state actors
also employ a strategy to ‘grip the minds of the masses’ to enable the deals. ‘Gripping the
minds’ involves articulatory practices within the terrain of ideological struggle, which
put land deals always in process. This paper argues that ‘the owner of land’ as a cultural
identity that was constructed historically by determining forces, and not confined
merely as form of rights, is articulated in three competing positionings toward land
deals: rejection, renegotiation and acceptance. The state and non—state actors or NGOs
broker the process of identification toward modernismby constructing representations
of capital as the good and bad Other. These representations of capital provide ‘logic’
which connected meanings of modernism with ‘the owner of land’ identity. ‘Gripping
the mind of the masses’ to smoothen land deals involves correspondences as well as non-
correspondences between modernism and the Marind identity of Anim—ha that render
connected chain of meanings unstable."

"Tesis ini membahas keberadaan hak ulayat adat terkait pembatalan sertipikat hak pakai di wilayah negeri Adat Laha, Maluku dimana kaitan eksistensi masyarakat hukum adat di Negeri Laha, Maluku terhadap penerbitan sertipikat hak pakai diatas tanah adat mereka. Penelitian ini adalah penelitian yuridis-normatif. Hasil penelitian menyarankan bahwa Badan Pertanahan Nasional bersikap lebih hati-hati terhadap setiap warga negara yang hendak memohonkan untuk penerbitan sertipikat hak atas tanah di atas tanah adat, harus dilepaskan terlebih dahulu hak atas tanah adat tersebut dan setiap pertimbangan hakim sebaiknya menerapkan juga aturan dalam pasal 3 Undang-Undang Pokok Agraria nomor 5 tahun 1950.

This thesis discusses the existence of indigenous customary rights to revoke the rights to use certificate of land in the area of Indigenous Laha, Maluku, where the relation of existence of indigenous people in the State Laha, Maluku against publishing certificate use rights over their customary lands. This research is a juridical-normative research. The conslusion of the research suggest that the National Land Department to be more cautious against any citizen who wanted to ask for the issuance of certificate of land rights in customary land, should be released first indigenous land rights and every judge judgment rule should apply also in chapter 3 Basic Agrarian Law No. 5 of 1950."

"Tanah merupakan kebutuhan dasar manusia sejak manusia tersebut lahir sampai dengan meninggal dunia, manusia senantiasa membutuhkan tanah sebagai tempat tinggal hidupnya, oleh karena itu dapat disimpulkan, tanah adalah tempat manusia tinggal, tempat darimana manusia berasal, dan juga tempat kemana mereka akan pergi. Studi kasus yang akan dibahas dalam tesis ini memaparkan tentang apa yang terdapat dalam teori belum tentu sepenuhnya benar, karena dalam Putusan Peninjauan Kembali Mahkamah Agung Republik Indonesia Nomor 582 PK/Pdt/2011 antara Perkumpulan Kelompok Tani Pemberdayaan Masyarakat Tani dan Nelayan Pesisir Pantai Kabupaten Mamuju Utara melawan PT. Unggul Widya Teknologi Lestari berakhir dengan kemenangan Pihak Kelompok Tani. Kelompok Tani ini memiliki tanah tersebut atas dasar lokasi dibuka sendiri maupun secara berkelompok yang berasal dari Tanah Negara seluas kurang lebih 2722 Ha (dua ribu tujuh ratus dua puluh dua hektar) sejak Tahun 1982 (seribu Sembilan ratus delapan puluh dua) yang terletak di Kabupaten Mamuju Utara, Propinsi Sulawesi Barat yang akhirnya dikukuhkan oleh Pemerintah Desa dan Kabupaten Mamuju pada Tahun 1994 yaitu dikeluarkannya SKP (Surat Keterangan Pemilikan Tanah), SKT (Surat Keterangan Tanah) dan Sporadik tentang Pemberian Hak Kepemilikan atas Tanah Negara, sedangkan PT. Unggul Widya Teknologi Lestari memiliki tanah tersebut berdasarkan Sertipikat HGU (Hak Guna Usaha) yang mendapatkan pengakuan dari Pemerintah Negara Republik Indonesia yang dikeluarkan oleh Badan Pertanahan Republik Indonesia Kabupaten Mamuju Utara. Seperti apakah kekuatan dan kepastian hukum yang diberikan oleh Hukum Negara Indonesia terhadap hak prioritas atas tanah bagi masyarakat adat setempat, khususnya dalam Putusan Peninjauan Kembali Mahkamah Agung Republik Indonesia Nomor 582 PK/Pdt/2011 dan apakah putusan Majelis Peninjauan Kembali sudah sesuai dengan kaidah-kaidah hukum yang berlaku.

This group of farmers have land on the basis of such a location was opened and in groups originating from the State land covering an area of approximately 2263 Ha (two thousand seven hundred twenty-two acres) since 1982 (one thousand nine hundred eighty-two) located in North Mamuju Regency of West Sulawesi Province, which was eventually confirmed by the Government of the village and Mamuju Regency in 1994, namely the promulgation of the SKP (Affidavits Landholdings), SKT (Ground Clearance) and Sporadic on Granting ownership of State land, while PT Widya Superior Sustainable Technologies have the land based on the certificate HGU (Business use rights) are getting recognition from the Government of the Republic of Indonesia issued by the Agency of the Republic of Indonesia Land North Mamuju Regency. Such is the power and legal certainty afforded by State law rights against Indonesia's top priority lands for indigenous peoples, especially in the Review Decision of the Supreme Court of the Republic of Indonesia No. 582 PK/Pdt/2011 and whether the verdict of the judicial review is in accordance with the rules applicable law."

"Hibah mengenai benda tidak bergerak seperti tanah harus dinyatakan dalam bentuk akta yang dibuat oleh pejabat yang berwenang dan didaftarkan pemindahan haknya. PPAT bewenang dalam pembuatan akta hibah sebagai alat bukti yang secara sah menyatakan telah dilakukannya perbuatan hukum hibah mengenai suatu hak atas tanah. Hibah merupakan pemberian secara sukarela yang dilakukan dengan cuma-cuma dan tidak memuat syarat maka tidak dapat dicabut atau ditarik kembali. Akan tetapi, hibah dapat diberlakukan suatu kebatalan jika ada cacat yuridis yang mengakibatkan perbuatan hukumnya menjadi tidak berlaku. Permasalahan dalam tesis ini adalah status hukum akta hibah yang memuat syarat dan tanggung jawab PPAT terhadap akta yang telah dibuatnya. Penelitian ini menggunakan metode penelitian yuridis normatif dengan tipe penelitian eksplanatoris dan preskriptif. Jenis data yang digunakan dalam penelitian ini adalah data sekunder dianalisa secara kualitatif. Hasil penelitian yang diperoleh yaitu status hukum akta hibah yang memuat syarat adalah batal demi hukum sehingga kembali pada keadaan semula atau berlaku surut (ex tunc). Hal ini karena hibah yang dilakukan bertentangan dengan undang-undang maka tidak memenuhi syarat objektif dari syarat sahnya perjanjian menurut Pasal 1320 KUHPerdata yaitu sebab yang halal. PPAT yang membuat Akta Hibah harus bertanggungjawab karena secara materiil akta tersebut bertentangan dengan undang-undang.

Grants regarding immovable objects such as land must be stated in the form of a deed made by an authorized official and registered for the transfer of rights. PPAT has the authority to make a grant deed as evidence that legally states that a legal grant act has been carried out regarding a land right. A grant is a voluntary gift made free of charge and does not contain conditions, so it cannot be revoked or withdrawn. However, a grant can be canceled if a juridical defect causes the legal action to become invalid. The problem with this thesis is the legal status of the grant deed, which contains the terms and responsibilities PPAT had to the deed he had made. This study uses a normative juridical research method with explanatory and prescriptive research types. The type of data used in this research is secondary data, which is analyzed qualitatively. The results obtained are the legal status of the grant deed, which contains the condition that it is null and void so that it returns to its original state or applies retroactively (ex tunc). This is because the grant made is contrary to the law, so it does not meet the objective requirements of the agreement's validity according to Article 1320 of the Civil Code, which is a legal cause. The PPAT who made the Deed of Grant must be responsible because materially, the deed is contrary to the law."

"Proses penerbitan sertipikat hak milik seharusnya dilakukan untuk mewujudkan tujuan pendaftaran tanah, yakni tertib administrasi pertanahan. Namun faktanya, dengan diterbitkannya sertipikat hak milik nomor 10XXX tujuan pendaftaran tanah pada proses penerbitan sertipikat tersebut gagal terwujud, hal ini dikarenakan ukuran dari sertipikat ini beririsan dengan batas tanah untuk pelebaran jalan yang didasari oleh Surat Keputusan Gubernur Kaltim No 212 Tahun 1987. Pokok  permasalahan dalam penelitian ini adalah Bagaimanakah proses penerbitan sertipikat hak milik Nomor 10XXX dikaitkan dengan SK Gubernur Kepala Daerah Tingkat I Kalimantan Timur Nomor 212 tahun 1987 dan Bagaimanakah pertanggung jawaban Kantor pertanahan kota Samarinda terhadap penerbitan sertipikat  hak milik nomor 10XXX yang beririsan dengan tanah untuk pelebaran jalan sesuai SK Gubernur Kepala Daerah Tingkat I Kalimantan Timur Nomor 212 Tahun 1987. Metode penelitian yang digunakan adalah  doktrinal. Hasil penelitian dalam tesis ini adalah Pada  proses penerbitan Sertipikat Nomor 10XXX telah terjadi kesalahan ukur karena tidak dilakukan koordinasi sebagaimana diatur dalam Peraturan Presiden nomor 10 Tahun 2006, akibatnya  ukuran tanah SHM tersebut beririsan dengan badan jalan dengan lebar 4 meter persegi. maka tujuan pendaftaran tanah yakni tertib administrasi pertanahan tidak terwujud dalam pelaksanaanya. Kantor Pertanahan atas kesalahannya mempunyai kewajiban untuk bertanggung jawab, dalam pasal 63 PP pendaftaran tanah terdapat sanksi administratif bagi Kepala kantor pertanahan atas pengabaian terhadap aturan yang berlaku saat melakukan tugasnya, lalu bertanggung jawab memberi penyelesaian atas dasar aduan dari masyarakat, dan ketika hal tersebut tidak berhasil maka pada tahapan litigasi Kantor pertanahan sebagai tergugat bertanggung jawab untuk melaksanakan isi putusan Pengadilan Tata Usaha Negara.

The process of issuing certificates of ownership should be carried out to realize the objectives of land registration, namely orderly land administration. But in fact, with the issuance of certificate of title No. 10XXX the purpose of land registration in the process of issuing the certificate failed to materialize, this is because the size of this certificate overlaps with the land boundary for road widening based on East Kalimantan Governor Decree No. 212 of 1987. The subject matter of this research is how the process of issuance of certificate of title No. 10XXX is associated with the Decree of the Governor of the East Kalimantan Level I Region No. 212 of 1987 and how is the responsibility of the Samarinda City Land Office for the issuance of certificate of title No. 10XXX which intersects with the land for road widening in accordance with the Decree of the Governor of the East Kalimantan Level I Region No. 212 of 1987. The research method used is doctrinal. The result of the research in this thesis is that in the process of issuing Certificate Number 10XXX there has been a measurement error because coordination was not carried out as stipulated in Presidential Regulation number 10 of 2006, as a result the size of the SHM land intersects with the road body with a width of 4 square meters. hen the purpose of land registration, namely orderly land administration, is not realized in its implementation. The Land Office for its mistakes has an obligation to take responsibility, in article 63 of the Government Regulation on land registration there are administrative sanctions for the Head of the land office for neglecting the applicable rules when performing its duties, then it is responsible for providing a settlement on the basis of complaints from the public, and when this does not work then at the litigation stage the Land Office as the defendant is responsible for implementing the contents of the decision of the State Administrative Court."

"Tesis ini membahas peran hak properti dalam kepemilikan sertifikat tanah terhadap akses pinjaman rumah tangga. Studi ini dilakukan secara kuantitatif dengan desain cross-sectional. Hasil studi menyarankan bahwa implementasi percepatan sertifikasi tanah perlu memperhatikan faktor sosial ekonomi rumah tangga. Dalam konteks meningkatkan inklusi keuangan, sertifikasi tanah lebih efektif dilakukan pada wilayah perkotaan dan rumah tangga miskin. Tidak teratasinya masalah pinjaman bank dengan sertifikasi tanah bagi rumah tangga dengan status ekonomi miskin di perdesaan mendasari munculnya rekomendasi bagi pemerintah untuk mengurangi risiko sektor primer yang mendominasi ekonomi di perdesaan dan perlunya membangun faktor institusi terkait sertifikasi tanah di perdesaan.

This thesis discusses the role of property rights in land ownership on household credit access. This study was conducted quantitatively with a cross-sectional design. The results of the study suggest that accelerating the acceleration program of land certification needs to pay attention to household socio-economic factors. In the context of increasing financial inclusion, land titling is more carried out in urban areas and poor households. Not solving the problem of bank credit with land certification for households with poor economic status in rural areas underlies findings for the government to reduce the risk of the primary sector that dominates economic certification in rural areas and the need to build related institutional factors."

"Tesis ini membahas hak setiap orang mengajukan permohonan hak atas tanahnya untuk mendapatkan jaminan kepastian hukum tetapi dapat terjadi setelah mendapatkan keputusan pemberian hak atas tanah oleh Badan Pertanahan Nasional kemudian dibatalkan karena kurangnya surat bukti peralihan hak. Sebagaimana ternyata dalam Putusan Pengadilan Tata Usaha Negara No.138/G/2007/PTUN.JKT, berdasarkan pertimbangan Hakim dan dari buktibukti yang diajukan diketahui bahwa pembatalan keputusan pemberian hak atas tanah dikarenakan adanya ketidakcermatan dari Badan Pertanahan Nasional dalam meneliti data-data yang ada yang menyebabkan kerugian bagi pemilik tanah. Putusan hakim disini melindungi hak pemohon. Penelitian ini menggunakan pendekatan yuridis normatif dengan tipe penelitian deskriptif. Hasil penelitian menyarankan Badan Pertanahan Nasional lebih cermat dan pemilik tanah menyegerakan pendaftaran tanah miliknya.

This thesis explores the right of every person applying for rights over land to get a guarantee of legal certainty but it could occur after getting the decision on granting of land rights by the National Land Agency (BPN) was later canceled due to lack of proof of right?s transition. As it turns out in the State Administrative Court No.138/G/2007/PTUN.JKT, in consideration of the Judge and of the evidence submitted in mind that the cancellation of the decision to give land rights due to carelessness from the National Land Agency in researching data which is caused loss to the landowner. Judge's decision here to protect the rights of the applicant. This study using a normative juridical approach to the type of descriptive research. The results suggest more accurate National Land Agency and hasten the land owner of its land registration."

"Skripsi ini membahas tentang maladministrasi pelayanan publik dalam penerbitan sertifikat hak atas tanah pada tahun 2018-2020. Dalam skripsi ini penelitian didasarkan pada laporan Ombudsman di tahun 2018-2020, kasus yang dibahas terkait laporan yang diterima Ombudsman yaitu laporan terhadap penerbitan sertifikat hak atas tanah di Pulau Pari dan juga Pembatalan sertifikat hak atas tanah di Bintaro. Skripsi ini juga melihat bagaimana Ombudsman dalam menyelesaikan laporan terhadap kasus penerbitan sertifikat hak atas tanah. Sebagai solusi, skripsi ini memberikan pemahaman kepada pembaca melalui penyajian data penelitian dan juga pemahaman terhadap alur pelaporan maladministrasi.

This thesis discusses the maladministration of public services in the issuance of land rights certificates in 2018-2020. In this thesis the research is based on the Ombudsman's report in 2018-2020, the case discussed regarding the report received by the Ombudsman, namely the report on the issuance of land rights certificates in Pari Island and also the cancellation of land rights certificates in Bintaro. This thesis also looks at how the Ombudsman in completing reports on cases of issuing land rights certificates. As a solution, this thesis provides an understanding to the reader through the presentation of research data and also an understanding of the maladministration reporting flow. "
