"Skripsi ini membahas mengenai perbandingan isi perjanjian perkawinan di Indonesia dengan Australia. Di Australia, perjanjian perkawinan dikenal dengan istilah binding financial agreements. Perjanjian perkawinan dibuat dengan tujuan untuk mencegah masalah berkepanjangan dikemudian hari antara pasangan suami istri. Oleh karena itu, perlu diberlakukan pengaturan yang jelas mengenai ketentuan hukum mengenai perjanjian perkawinan. Permasalahan yang akan penulis bahas yaitu perihal perbandingan pengaturan mengenai perjanjian perkawinan di Indonesia dengan Australia dan perbandingan terhadap hal-hal yang dapat diatur dari isi perjanjian perkawinan di Indonesia dengan Australia. Bentuk penelitian ini bersifat yuridis normatif. Penelitian ini juga menggunakan metode pendekatan peraturan perundang-undangan dan perbandingan karena mendasarkan pada metode perbandingan hukum terhadap dua negara yang berbeda yaitu Indonesia dengan Australia. Dalam penelitian ini, akan dijelaskan mengenai persamaan dan perbedaan pengaturan mengenai isi dari perjanjian perkawinan di Indonesia dengan Australia.

This research purpose is about to analyze the comparison of the content of prenuptial agreement in Indonesia and Australia. In Australia, Prenuptial Agreement known as the binding financial agreements. Prenuptial agreement made with the purpose to prevent further problems in the future between husband and wife. Therefore, an obvious regulations must be provided. Issues that will be explored by the author are regarding to the comparison regulation about Prenuptial Agreement in Indonesia with Australia and comparison to things that can be set from the contents of the Prenuptial Agreement in Indonesia with Australia. This research form method is normative. This research also uses the comparative approach because based on methods of comparative law against two different countries, Indonesia and Australia. In this research, there will be analyze about the similarities and differences in regulation regarding the content of the prenuptial agreement in Indonesia and Australia.

"Seorang pria dan seorang wanita berhak membuat perjanjian perkawinan yang berlaku bagi perkawinannya. Perjanjian perkawinan pada umumnya bermaksud untuk mengatur mengenai harta kekayaan pasangan suami isteri. Perbedaan peraturan yang berlaku di masing-masing negara yaitu Indonesia, Australia, dan Amerika membuat penulis tertarik untuk mencari persamaan dan perbedaan dalam proses dan syarat sahnya perjanjian perkawinan yang diatur dalam negara-negara tersebut. Sehingga permasalahan yang dikemukakan dalam tesis ini adalah bagaimana persamaan proses dan syarat sahnya perjanjian perkawinan serta bagaimana perbedaan proses dan syarat sahnya perjanjian perkawinan di Indonesia, Australia, dan Amerika.
Metode penelitian yang digunakan dalam tesis ini adalah tipe penelitian normatif, yaitu penelitian yang dilakukan terhadap bahan hukum primer dan bahan hukum sekunder. Simpulan dari penelitian dalam tesis ini adalah terdapat persamaan yang ditemukan antara lain perjanjian perkawinan harus dibuat secara tertulis, dapat dibuat sebelum atau pada saat perkawinan berlangsung, dan dapat dicabut atau diubah kembali. Selain itu terdapat perbedaan antara lain tidak semuanya harus menggunakan independent legal advice, pengungkapan penuh atas harta benda (transparansi) pada saat pembuatan, dan keharusan perjanjian perkawinan untuk didaftarkan ke pengadilan di negaranya.

A man and a woman have the right to make a prenuptial agreement applicable to their marriage. Prenuptial agreement in general intends to regulate the possessions of married couples. Different regulations prevailing in each country, Indonesia, Australia, and the United States make the author interested to find similarities and differences in the process and terms of validation of prenuptial agreement arranged in those countries. So the problem presented in this thesis is how the similarity of the process and terms of prenuptial agreement validation and how the difference of process and terms of prenuptial agreement validation in Indonesia, Australia, and America.
The research method used in this thesis is the type of normative research, namely research conducted on primary legal materials and secondary legal materials. The conclusion of the research in this thesis is that there are similarities found, among others, the prenuptial agreement must be made in writing, can be made before or during the marriage, and can be revoked or changed again. In addition there are differences, among others, not all must use independent legal advice, full disclosure of property (transparency) at the time of manufacture, and the obligation of prenuptial agreement to be registered to the courts in the country.

"Perjanjian perkawinan belum diketahui secara luas oleh masyarakat Indonesia. Meskipun demikian, perjanjian perkawinan dapat dianggap penting terutama dalam perkawinan campuran mengingat dampak yang dihasilkan dari perkawinan itu sendiri cukup besar. Skripsi ini membahas mengenai pengaturan perjanjian perkawinan dalam perkawinan campuran di Indonesia yakni dalam Kitab Undang-Undang Hukum Perdata dan Undang-Undang No. 1 Tahun 1974 tentang Perkawinan dan membandingkan pengaturan di Texas, Amerika Serikat yakni Texas Family Code dan Uniform Premarital Agreement Act. Penelitian yang digunakan dalam skripsi ini adalah penelitian doktrinal untuk melakukan perbandingan pengaturan antara Indonesia dan Texas, Amerika Serikat. Adapun hasil dari penelitian ini adalah pengaturan mengenai perjanjian perkawinan dalam perkawinan campuran di Indonesia diperlukan adanya kepastian hukum karena dalam prakteknya masih terdapat ketidaksesuaian berkaitan dengan pengaturan perjanjian perkawinan dalam perkawinan campuran. Hal ini dapat dilakukan dengan pemerintah sebagai lembaga yang berwenang untuk lebih memperhatikan pengaturan mengenai perjanjian perkawinan dalam perkawinan campuran agar prosedur, akibat hukum, serta legalitas dari perjanjian perkawinan itu sendiri memiliki kepastian.

Prenuptial agreement is still not widely known by the Indonesian people. However, marriage agreements can be considered important, especially in mixed marriages, considering the significant impact of the marriage itself. This thesis discusses the regulation of prenuptial agreement in mixed marriages in Indonesia namely in the Indonesian Civil Code and the Marriage Law No. 1 of 1974 and compares the with those in Texas, United States namely Texas Family Code and Uniform Premarital Agreement Act. The research used in this thesis is doctrinal research to compare the regulations between Indonesia and Texas, United States. The results of this study are that the regulation of prenuptial agreement in mixed marriages in Indonesia requires legal certainty because in practice there are still inconsistencies related to the regulation of prenuptial agreement in mixed marriages. This can be done by the government as the authorized institution to pay more attention to the regulation of prenuptial agreement in mixed marriages so that the procedures, legal consequences, and legality of the prenuptial agreement themselves have certainty."

"[Penelitian ini membahas perbandingan pengaturan dan isi perjanjian perkawinan menurut hukum Indonesia dan Jerman, dengan melakukan analisis langsung terhadap peraturan di Indonesia yaitu KUH Perdata dan Undang-Undang No. 1 Tahun 1974 Tentang Perkawinan, serta peraturan di Jerman yaitu Bürgerliches Gesetzbuch (BGB) atau yang juga disebut sebagai German Civil Code. Penelitian ini bersifat yuridis normatif dengan metode pengolahan dan analisis data yang menggunakan pendekatan kualitatif. Pada ketiga peraturan ini terdapat beberapa perbedaan yang mendasar dalam hal pembuatan perjanjian perkawinan. Hasil penelitian ini menunjukan bagaimana pengaturan dan penerapan dalam perjanjian perkawinan di Indonesia dan Jerman, yang bertujuan untuk memperbaiki pengaturan terhadap perjanjian perkawinan di Indonesia.

This research studies the comparative analysis on regulation and content of marriage agreement between Indonesia and Germany, by conducting direct analysis pursuant to Indonesian Law namely KUHPerdata and Law No. 1 Year 1974 regarding Marriage, and regulation in German Law namely Bürgerliches Gesetzbuch (BGB) or German Civil Code. "Tesis ini membahas mengenai tinjauan akta perjanjian perkawinan yang dibuat di Indonesia oleh notaris di Indonesia untuk perkawinan campuran beda kewarganegaraan antar Warga Negara Indonesia dengan Warga Negara Australia yang mana perkawinannya itu dilangsungkan di negara bagian New South Wales - Australia berdasarkan hukum perkawinan Australia. Maka timbul permasalahan mengenai kedudukan akta perjanjian perkawinan yang dibuat di Indonesia dalam hukum perkawinan di Australia. Apakah akta perjanjian perkawinan tersebut berlaku dan diakui kedudukannya sebagai perjanjian perkawinan di Australia atau tidak. Permasalahan ini diteliti dengan menggunakan pendekatan metode yuridis normatif dan deskripsi analitis, yaitu berupa kajian terhadap asas-asas dan norma hukum yang terdapat dalam ketentuan perundang-undangan Indonesia yang berkaitan dengan perjanjian perkawinan campuran beda kewarganegaraan dan dilihat dari teori-teori Hukum Perdata Internasional yang terkait dengan masalah perjanjian perkawinan yang bersifat internasional ini. Serta peraturan dan perundang-undangan Australia yang mengatur mengenai perkawinan, perjanjian perkawinan dan pengakuan perjanjian perkawinan yang dibuat di luar Australia. Sebagai hasil dari penelitian ini, bahwa Australia hanya mengakui perjanjian perkawinan asing bilamana segala persyaratan tentang tata cara pembuatan perjanjian perkawinan Bindin Financial Agreement di Australia. Jadi dalam kasus tesis ini akta perjanjian perkawinan yang dibuat oleh notaris di Indonesia tidak diakui dan secara hukum tidak mengikat. Perjanjian perkawinan tersebut hanya dipakai oleh hakim di Pengadilan Keluarga Australia sebagai bahan pertimbangan saja.

This thesis is the review of a prenuptial agreement deed that made in Indonesia by Indonesian Public Notary for a mixed marriage with different nationalities between an Indonesian nationality and an Australian nationality, where the wedding was held in New South Wales - Australia. Is the prenuptial deed above valid and recognise as prenuptial agreement in Australia. The above conflicts, has been reviewed and obsereved by the writer using a yuridis normative method and deskriptive analitic, law principles rules by Indonesian regulation related with mixed marriage prenuptial agreement subject, also using the principles by International Private Law, Australian Acts and regulation that rules international mixed marriage on how foreign prenuptual agreement is recognise in Australia. The result has come up that Australian only recognise foreign prenuptial agreement as long as it meet with all the requirements on how Australian make a binding financial agreement. So in this case, the prenuptial agreement deed made by Indonesian public notary in Indonesia does not recognise and does not binding in Australian. Its use for the judge in Family Court for a concideration only. "

"Perjanjian franchise berperan penting dalam sistem franchise karena sistem franchise didasarkan pada suatu perjanjian sebagai pedoman pelaksanaan. Di Indonesia, mengenai franchise diatur dalam Peraturan Pemerintah No. 42 tahun 2007 tentang Waralaba dan Peraturan Menteri Perdagangan Republik Indonesia Nomor 53/M-DAG/PER/8/2012 tentang Penyelenggaraan Waralaba. Sementara itu, di Australia, franchise diatur dalam Competition and Consumer Industry Codes ndash; Franchising Regulation 2014 Select Legislative Instrument No. 168, 2014 yang dikenal sebagai "Franchising Code of Conduct". Penelitian ini menggunakan metode yuridis normatif, penelitian perbandingan hukum ini menunjukkan bahwa selain terdapat perbedaan dalam pengaturan hukum mengenai perjanjian franchise yang berlaku di Indonesia dan Australia, juga terdapat persamaan.

Franchise agreement has a vital role in the franchise system, because the franchise system based on an agreement as implementation guidance. In Indonesia, franchise is regulated in Government Regulation No. 42 year 2007 on Franchise and Regulation of the Minister of Trade of The Republic of Indonesia Number 53 M DAG PER 8 2012 on Franchising. Meanwhile, in Australia, franchise is regulated in Competition and Consumer Industry Codes ndash Franchising Regulation 2014 Select Legislative Instrument No. 168, 2014 also known as ldquo lsquo Franchising Code of Conduct rdquo . This research is jurisdistic normative research, this legal comparative research shows that other than the difference in the regulation about franchise in Indonesia and Australia, it also has the similarity.

"Skripsi ini membahas mengenai perbandingan hukum antara Indonesia dan Belanda yang mengatur tentang Perjanjian Perkawinan. Perbandingan hukum ini di khususkan untuk membandingkan peraturan Perjanjian Perkawinan di Indonesia yang didasarkan pada Undang-Undang No. 1 Tahun 1974 tentang Perkawinan dengan peraturan Belanda yang didasarkan pada Nieuw Burgerlijk Wetboek. Metode yang digunakan dalam skripsi ini adalah yuridis normatif. Penulis akan membahas teori-teori dasar dari kedua negara, seperti latar belakang pembuatan perjanjian perkawinan, syarat sah, tujuan, larangan-larangan dalam membuat perjanjian perkaiwnan, serta praktek di kedua negara. Penulis juga akan membahas tentang anatomi perjanjian perkawinan dari kedua negara sesuai dengan contoh yang dilampirkan. Kemudian setelah membahas teori-teori dasar dari Indonesia dan Belanda, penulis akan membandingkan keduanya dengan beberapa faktor pembanding yang akan dijelaskan dengan tabel. Perbandingan tersebut akan didasarkan pada hal-hal yang telah diatur dalam peraturan yang berlaku dari kedua negara, yaitu Indonesia dengan Undang-Undang No.1 Tahun 1974 tentang Perkawinan dan Belanda dengan Nieuw Burgerlijk Wetboek.

This undergraduate thesis will emphasize on a comparisson between Indonesian and Dutch law concerning prenuptial agreement. This comparative law will be focused on the comparison between Indonesian law based on Law Number 1 Year 1974 about Marriage and Dutch law based on Nieuw Burgelijk Wetboek. The method used in this thesis is juridist-normative. There will be an explanation about the basic theories from both countries, such as the background of making prenuptial agreement, the legitimate requirements, objectives, restrictions in making prenuptial agreement, as well as the practice in the two countries. There will also be an explanation on the anatomy of the agreement based on the attach example in this thesis. Then, after explaining the basic theories of Indonesia and the Netherlands, the author will compare them with some of the factors that will be explained with a comparison table. The comparison will be based on things that have been set in the regulations of the two countries, namely Indonesia by Law Number 1 Year 1974 about Marriage and the Netherlands with the Nieuw Burgelijk Wetboek.

Penelitian ini bersifat yuridis normatif dengan metode analisis data yang menggunakan pendekatan kualitatif. Pada peraturan dari masing-masing negara ini, terdapat beberapa perbedaan dalam hal pengaturan mengenai perjanjian perkawinan yang dibuat sepanjang perkawinan.
Hasil penelitian ini menunjukan bagaimana pengaturan mengenai perjanjian perkawinan yang dibuat sepanjang perkawinan di Indonesia, Belanda, dan Kanada Ontario, dengan tujuan untuk memperbaiki pengaturan di Indonesia mengenai perjanjian perkawinan yang dibuat sepanjang perkawinan.

This research discusses about comparison of regulation for postnuptial agreement in Indonesia, Netherland and Canada Ontario by doing analysis on Indonesia rsquo s regulation such as Indonesian Civil Code KUHPerdata and Law No. 1 1974 about Marriage, Netherlands rsquo regulation such as Nieuw Burgerlijk Wetboek NBW and Canada rsquo s Ontario regulation such as Family Law Act 1990.
This is a normative juridical research using qualitative approach method. Among those countries rsquo regulations, the Author found some similarities and differences regarding postnuptial agreement among those countries.

"[Perkawinan campuran sebagaimana diatur dalam Undang-Undang Nomor 1 Tahun 1974 adalah perkawinan antara dua orang yang di Indonesia tunduk pada hukum yang berlainan, karena perbedaan kewarganegaraan dan salah satu pihak berkewarganegaraan Indonesia. Perkawinan campuran dapat dilaksanakan di Indonesia maupun di luar Indonesia. Dalam hal perkawinan campuran dilaksanakan di luar Indonesia adalah sah bilamana dilakukan menurut hukum yang berlaku di Negara di mana perkawinan itu dilangsungkan dan bagi Warga Negara Indonesia tidak melanggar ketentuan-ketentuan Undang-Undang Perkawinan. Dalam jangka waktu 1 (satu) tahun sejak sekembalinya mereka ke Indonesia, bukti perkawinan mereka harus didaftarkan di Kantor Pencatatan perkawinan tempat tinggal mereka. Pasangan perkawinan campuran yang hendak melangsungkan perkawinan campuran di luar negeri juga dapat membuat perjanjian perkawinan. Perjanjian perkawinan adalah perjanjian tertulis yang dibuat oleh calon suami isteri sebelum atau pada saat perkawinan dilangsungkan untuk mengatur akibat-akibat perkawinan terhadap harta kekayaan mereka. Pentingnya pembuatan perjanjian perkawinan bagi pasangan yang hendak melangsungkan perkawinan campuran adalah terkait dengan perlindungan hukum terhadap hak milik atas tanah di Indonesia yang hanya dapat dimiliki oleh Warga Negara Indonesia, sebagaimana diatur dalam Undang-Undang Pokok Agraria. Penulisan tesis ini menggunakan metode yuridis normatif, yaitu dilakukan dengan menelusuri bahan hukum sekunder berupa norma-norma dari peraturan perundang-undangan yang berkaitan dengan permasalahan. Prosedur pembuatan perjanjian perkawinan dalam perkawinan campuran yang dilangsungkan di luar negeri, tetap mengacu pada ketentuan Undang-Undang Perkawinan yaitu dibuat sebelum atau pada saat perkawinan dilangsungkan dan berdasarkan pada hukum yang berlaku di Indonesia. Dalam hal setelah perkawinan dilangsungkan di luar negeri dan mereka kembali ke Indonesia namun tidak mendaftarkan perkawinannya tersebut dan kemudian mereka membuat perjanjian perkawinan, maka perjanjian perkawinan tersebut menjadi batal demi hukum karena melanggar ketentuan Undang-undang yaitu dibuat setelah perkawinan berlangsung.

Mixed marriage as stipulated in Law No. 1 of 1974 is a marriage between two people in Indonesia which subject to different laws, because of differences in nationality and one party is having Indonesian nationality. Mixed marriage can be implemented and held in Indonesia and outside Indonesia. In the case of mixed marriages conducted outside Indonesia is legal if carried out under the applicable law in the State where the marriage was celebrated and for Indonesian citizens do not violate the provisions of the Marriage Act. Within a period of one (1) year since upon their return to Indonesia, evidence of their marriage should be registered in the marriage registration office where they live. Mixed marriage couples who want to hold the marriage abroad can also make a prenuptial agreement. Prenuptial agreement is a written agreement made by the prospective spouses before or at the day of the marriage took place to regulate the effects of marriage on their property. The importance of making prenuptial agreements for couples who want to have a mixed marriage is associated with legal protection of property rights over land in Indonesia that can only be owned by an Indonesian citizen, as stipulated in the Basic Agrarian Law (UUPA). This thesis using normative juridical method, which is carried out by tracing the secondary law in the form of norms of the legislation relating to the cases. The procedure of making the prenuptial agreement in mixed marriages held abroad, still have to refer to the provisions of the Marriage Act is made before or at the day of the marriage took place and according to the laws in force in Indonesia. In the event that after the marriage held abroad and they return to Indonesia but did not register the marriage and then they make a prenuptial agreement, then the prenuptial agreement becomes null and void because it violated the provisions of the Act that is made after the marriage took place. The importance of making prenuptial agreements for couples who want to have a mixed marriage is associated with legal protection of property rights over land in Indonesia that can only be owned by an Indonesian citizen, as stipulated in the Basic Agrarian Law (UUPA). This thesis using normative juridical method, which is carried out by tracing the secondary law in the form of norms of the legislation relating to the cases. The procedure of making the prenuptial agreement in mixed marriages held abroad, still have to refer to the provisions of the Marriage Act is made before or at the day of the marriage took place and according to the laws in force in Indonesia. In the event that after the marriage held abroad and they return to Indonesia but did not register the marriage and then they make a prenuptial agreement, then the prenuptial agreement becomes null and void because it violated the provisions of the Act that is made after the marriage took place.
;Mixed marriage as stipulated in Law No. 1 of 1974 is a marriage between two people in Indonesia which subject to different laws, because of differences in nationality and one party is having Indonesian nationality. Mixed marriage can be implemented and held in Indonesia and outside Indonesia. In the case of mixed marriages conducted outside Indonesia is legal if carried out under the applicable law in the State where the marriage was celebrated and for Indonesian citizens do not violate the provisions of the Marriage Act. Within a period of one (1) year since upon their return to Indonesia, evidence of their marriage should be registered in the marriage registration office where they live. Mixed marriage couples who want to hold the marriage abroad can also make a prenuptial agreement. Prenuptial agreement is a written agreement made by the prospective spouses before or at the day of the marriage took place to regulate the effects of marriage on their property. "Dalam perkembangan ekonomi di dunia, teknologi finansial menjadi salah satu bagian yang mengalami kemajuan pesat. Equity crowdfunding sendiri merupakan salah satu bagian teknologi finansial dengan metode pengumpuan dana untuk mengembangkan usaha dengan reward berupa saham bagi para peserta yang ikut menghimpun dana. Indonesia dan Australia adalah negara yang telah menerapkan aturan mengenai equity crowdfunding. Di Indonesia di atur oleh Peraturan Otoritas Jasa Keuangan Nomor 37 tahun 2018 dan di Australia di atur oleh Corporate Amendment (Crowd-Sourced Funding) Act 2017 dan Corporate Amendment (Crowd-Sourced Funding for propritary company) Act 2018. Dalam pengaturannya terdapat perbedaan dan persamaan dari equity crowdfunding di Indonesia dan Australia.
Skripsi ini pun di tulis untuk menjawab dua pertanyaan.  Yang pertama yaitu apa saja regulasi dan syarat dari equity crowdfunding di Indonesia dan Australia dan yang kedua yaitu apa saja persamaan dan perbedaan dari regulasi dan syarat serta cara kerja dari equity crowdfunding di Indonesia dan Australia. Dengan menggunakan metode penelitian hukum normatif, skripsi ini menunjukan aturan dan syarat equity crowdfunding di Indonesia dan Australia serta perbedaan dan peramaan dari aturan dan syarat serta cara kerja equity crowdfunding di Indonesia dan Australia.
Dari penelitian ini ditemukan bahwa terdapat persamaan dalam cara kerja equity crowdfunding di Indonesia dan Australia dan perbedaan terletak pada syarat untuk menjadi investor, operator, penerbit saham. Australia mempunyai peraturan yang lebih terbuka terhadap investor sehingga membuat angka pertumbuhan equity crowdfunding cukup tinggi. Saran diberikan kepada Otoritas Jasa Keuangan untuk membuat peraturan yang lebih terbuka terhadap investor untuk meningkatkan angka pertumbuhan equity crowdfunding di Indonesa.
In the world economic development, financial technology is one part that is experiencing rapid progress. Equity crowdfunding itself is one of financial technology with methods of raising funds to develop businesses with rewards in the form of shares for participants who participate in raising funds. Indonesia and Australia are among the countries that have implemented rules regarding equity crowdfunding. In Indonesia it is regulated by Financial Services Authority Regulation Number 37 of 2018 and in Australia it is regulated by the Corporate Amendment (Crowd-Sourced Funding) Act 2017 and the Corporate Amendment (Crowd-Sourced Funding for proprietary company) Act 2018. In its regulation there are differences and similarities from equity crowdfunding in Indonesia and Australia.
This thesis was written to answer two questions. The first question is what are the regulations and requirements of equity crowdfunding in Indonesia and Australia and the second  one is what are the similarities and differences of the regulations and terms and ways of working for equity crowdfunding in Indonesia and Australia. Using normative legal research methods, this thesis shows the equity crowdfunding rules and conditions in Indonesia and Australia as well as the differences and similarities of the rules and conditions and the workings of equity crowdfunding in Indonesia and Australia.
From this study it was found that there are similarities in business operation of equity crowdfunding in Indonesia and Australia and the differences lies in the requirements to become an investor, intermediaries, and issuer. Australia has more open regulations on investors, so the equity crowdfunding growth rate is quite high. Suggestions are given to the Financial Services Authority to make regulations more open to investors to increase equity crowdfunding growth rates in Indonesia."
