That these will not always be acceptable references in terms of the governing laws that apply to a particular contract where it is not based upon a common law system buy possibly a civil code system. Industri jasa konstruksi ini harus beradaptasi dengan kontrak internasional yang terbilang masih awam bagi kontraktor lokal, sehingga kontraktor lokal perlu mewaspadai sumber-sumber dispute apa saja yang berpotensi dapat terjadi dengan menggunakan kontrak internasional. Penelitian ini menggunakan metode studi kasus pada proyek dengan menggunakan kontrak internasional, yaitu dengan mewawancarai orang-orang yang memiliki tanggung jawab di proyek tersebut dan dengan menggunakan metode AHP dan pendekatan level resiko. Hasil yang didapat berdasarkan clusternya, sumber dispute yang didapat justru berasal dari faktor manajemen pada proyek tersebut dan faktor ketidakpastian pada internal proyek.

Globalization era has led Indonesia to compete with the international world, construction industry is not an exception. Construction industry must adapt to international contracts that are still relatively unfamiliar to local contractors, so that the local contractors should be aware of the sources of any dispute that can potentially occur with the use of international contracts. This study uses a case study on the project with international contracts, done by interviewing people who have responsibilities in the project and by using the AHP method and the level-ofrisk approach. Results obtained are based on cluster, the source of the dispute is obtained from management factor on the project and uncertainty factors in project's internal."

"Pemerataan pembangunan infrastruktur di Indonesia menjadi salah satu faktor pengembangan jasa konstruksi di Indonesia. Dalam rangka menjawab tantangan gencarnya pembangunan yang sedang dilaksanakan di Indonesia yang mengakibatkan terjadinya peningkatan daya saing dalam industri jasa konstruksi, perusahaan jasa konstruksi BUMN pun dituntut harus menerapkan inovasi standar kontrak konstruksi. Salah satu inovasi yang dilakukan adalah menerapkan pekerjaan berbasis kontrak rancang bangun karena dianggap lebih efisien dibandingkan dengan metode kontrak design bid build yang memisahkan antara kontrak perencanaan dengan pelaksanaan. Namun pada pelaksanaannya, muncul banyak klaim yang diajukan oleh penyedia jasa yang dapat berujung dispute yang seharusnya dapat diminimalkan dengan menerapkan manajemen kontrak yang tepat. Penelitian ini bertujuan untuk melakukan perbaikan standard kontrak rancang bangun pada perusahaan jasa konstruksi BUMN berbasis Contract Management Body of Knowledge (CMBOK) dengan melakukan survey kuesioner dan wawancara pakar. Dari hasil penelitian yang sudah dilakukan diperoleh 19 (sembilan belas) risiko dominan yang berpengaruh terhadap terjadinya dispute pada proyek rancang bangun di Perusahaan Jasa Konstruksi BUMN.

Equitable infrastructure development in Indonesia is one of the factors in the development of construction services in Indonesia. In order to answer the challenges of the incessant development that is being carried out in Indonesia which has resulted in increased competitiveness in the construction service industry, construction service Indonesian state-owned enterprises are also required to implement innovative construction contract standards. One of the innovations made is implementing contract-based work design and build because it is considered more efficient than the contract method design bid build which separates planning and implementation contracts. However, in practice, there have been many claims submitted by service providers that can lead to Disputes which should have been minimized by applying proper contract management. This study aims to improve the design and build contract standard in construction service Indonesian state-owned enterprises based on CMBOK by conducting questionnaire surveys and expert interviews. From the results of the research that has been carried out there are 19 dominant risk factors that affect the occurrence of disputes in design and build projects at construction service Indonesian state-owned enterprises."
