"This article aims to unravel a shift of control / ownership of communal land of the Malays of Deli
in North Sumatra. The commonly well-known communal lands, before the arrival of the Dutch
colonial, was still inherent with the authorities of villages and was evolutionarily taken over by
the foreign planters through concessionary contracts, which were dully signed by the Sultanate
of Deli and the said foreign planters. The Indonesian independence in 1945 and the period that
went beyond had in fact not contributed any improvement of the situation and instead it had
exacerbated social and legal relations between the Malays of Deli and their ancestral lands. The
said successful state laws had been so successful to keep these local natives away from their most
important resource of life, namely their very lands. “Deulayatisasi” through state laws that was
heavily oriented to the interests of capitalization to have seemingly been so successful to curtail
the long journey of communal land rights in this country that seemed to have been pioneered by
Van Vollenhoven during the early period of 20th century. The customary land law, in Indonesia, will
someday become a kind of a beautiful story in the course of historiographical laws of Indonesia.
Artikel ini bertujuan untuk mengungkap tentang peralihan kepemilikan tanah adat Melayu Deli
di Sumatera Barat. Sebelum kedatangan colonial Belanda, tanah adat melekat dengan aparat
desa dan secara perlahan diambil alih oleh pekebun asing melalui perjanjian konsesi yang
ditandatangani antara Kesultanan Deli dengan pekebun asing. Kemerdekaan Republik Indonesia
pada tahun 1945 dan masa setelahnya tidak berdampak pada perbaikan keadaan, dan sebaliknya
memperburuk hubungan social dan hukum antara Melayu Deli dan tanah leluhur mereka.
Undang-undang nasional berhasil menjaga masyarakat adat jauh dari sumber daya hidup yang
paling penting, yaitu tanah.“Deulayatisasi” melalui Undang-undang nasional berorientasi berat
pada kepentingan kapitalisasi tampaknya begitu berhasil untuk membatasi perjalanan panjang
dari hak ulayat di Negara ini yang dipelopori oleh Van Vollenhoven pada awal abad ke-20. Hukum
tanah adat di Indonesia pada suatu hari akan menjadi semacam cerita indah dalam perjalanan
hukum historiografis Indonesia."

"[Tesis ini membahas sengketa tanah ulayat kaum antara Asril (penggugat) dan Rosna (tergugat), terhadap 2 (dua) sertipikat Hak Milik No. 39/1991 gambar situasi tanggal 28 Maret 1991 No. 70/1991 seluas 4500 m2 dan sertipikat hak milik No. 100/1993 gambar situasi tanggal 1 Desember 1992 No. 851/1992 seluas 5250 m2 atas nama
Rosna yang terletak di Pulai Sei Talang Bukik Lurah Kenagarian Gadut, dimana majelis hakim menolak gugatan penggugat untuk seluruhnya. Penelitian ini menggunakan metode yuridis normatif dengan menggunakan data sekunder dan bersifat eksplanatoris. Hasil penelitian menyimpulkan bahwa pemberian hak milik di atas tanah ulayat kaum seperti kasus di atas serta dikuatkan dengan keputusan
Pengadilan maka dapat mengerus nilai kekerabatan di Minangkabau khususnya tentang tanah Pusako Tinggi, sehingga dapat menghilang fungsi dari tanah Pusako Tinggi di Minangkabau yang melahirkan masyarakat Individualis, sehingga sistem kekeluargaan materilineal yang kental sebagaimana tersirat dalam falsafah dasar, tujuan dan cara adalah satu yang memakai prinsip sehina-semalu dan azas kebersamaan tidak terpenuhi lagi.;This thesis discusses the communal land dispute between Asril (plaintiff) and Rosna (defendant), to 2 (two) certificate of Right of Ownership Number 39/1991 dated March 28, 1991 situation No. 70/1991 covering an area of 4500 m2 and a certificate of Right of Ownership Number 100/1993 dated December 1, 1992 situation No. 851/1992 covering an area of 5250 m2 owned by Rosna located in Pulai Sei Bukik Lurah Kenagarian Gadut, where a panel refused the plaintiff's lawsuit entirely. This study uses normative juridical using secondary data and explanatory typology. The research concludes that the granting of property rights over the communal land as the above case and upheld by the Court's decision, it can destroy Minangkabau kinship Pusako Tinggi especially on land, so as to dissipate the function of Pusako Tinggi land at Minangkabau who gave birth Individualist society, so that the system materilineal familial thick as implied in the basic philosophy, objectives and the way is one who wears contemptible principle and the principle of solidarity not fulfilled

"Tesis ini mengkaji perihal tanah masyarakat adat Tengger dalam perspektif komunalitas masyarakat adatnya. Penelitian ini merupakan penelitian yuridis normatif atau kepustakaan dengan pendekatan perundang-undnagan dan pendekatan analisis. Bahan hukum yang digunakan adalah bahan hukum primer, sekunder dan tersier. Prosedur pengumpulan bahan hukum dilakukan dengan studi dokumen dan wawancara. Penelitian ini membahas sifat komunal masyarakat adat Tengger melalui sudut pandang ekonomi, sosial, dan budaya yang dihubungkan dengan kebijakan pertanahan. Sifat komunal masyarakat adat Tengger meyakini tanahnya sebagai tanah suci yang tidak dapat dimiliki oleh pihak luar sehingga menciptakan keunikan serta kesenjangan tersendiri. Keunikan tersebut berupa praktik masyarakat adat Tengger terhadap sertipikat tanah yang dimilikinya, sementara kesenjangan terjadi antara penerapan sertipikat hak komunal masyarakat adat Tengger dengan kebijakan pertanahan. Kajian ini memberikan rekomendasi agar Kementerian Agraria dan Tata Ruang/Badan Pertanahan Nasional agar lebih akurat dalam menyiarkan publikasi persnya kepada masyarakat supaya tidak terjadi kesalahpahaman terhadap praktik pertanahan di lapangan. Serta tidak memaksakan peraturan perundang-undangan kepada masyarakat adat oleh karena terdapat masyarakat adat yang hanya dengan tradisi dan budayanya telah mendapatkan tujuan dari hukum sehingga tercipta masyarakat yang damai dan tentram.

This thesis studies the customary land in Tengger within the community rsquo s perspective. This is a normative juridical study under constitutional and analytical approach. Primary, secondary, and tertiary law materials are used. Law materials are collected through documental review and interview procedure. The communal nature of the indigenes in Tengger is discussed under economy, social, and cultural circumstances, to further find its relationship with land policies. The communal nature of the indigenes in Tengger believes that their lands are sacred, implicating unavailability of land ownership for outsiders, which creates its distinct uniqueness and discrepancy. Uniqueness is shown through the practice of land certificates among the indigenes in Tengger, while discrepancy is performed in the contrary between the certification of communal rights for the indigenes in Tengger and the land policies. The result of this study recommends The Ministry of Agrarian and Spatial Planning National Land Agency to be more accurate in broadcasting their press releases for the community, therefore misunderstanding in land practices could be avoided. Furthermore, it could be better to not enforce regulations to the indigenes in Tengger, for the custom and culture in Tengger rsquo s community are adequate in achieving the purpose of law, creating a peaceful environment accordingly.
