"Regional Comprehensive Economic Partnership (“RCEP”) baru-baru ini telah mulai berlaku pada Januari 2022 setelah melewati masa perundingan selama 9 tahun, dengan ditanda-tanganinya perjanjian tersebut oleh lima belas dari keenam belas negara awal yang terlibat dalam penyusunannya. Lingkup geografis, perwakilan jumlah GDP serta populasi yang besar menegakkan status RCEP sebagai salah satu blok ekonomi terbesar di luar World Trade Organization (“WTO”). Salah satu inisiatif yang diprakarsai oleh RCEP adalah peraturan mengenai Rules of Origin (“ROOs”), sebuah fitur pokok dari Free Trade Agrement (“FTAs”) yang menjabarkan kriteria barang-barang yang memenuhi syarat untuk mendapatkan yang ditawarkan oleh RCEP. RCEP menawarkan ROO-nya sebagai alternatif yang lebih fleksibel dan selaras dari sekian jumlah ROO yang sudah berlaku di kawasan ASEAN dan berbagai FTA di bawah naungannya. Tesis ini bertujuan untuk membahas hal tersebut menggunakan metode yuridis-normatif dengan pendekatan komparatif. Tesis ini akan membandingkan ROO RCEP dengan ROO milik FTA kunci lain, yakni ASEAN-Japan Comprehensive Economic Partnership (“AJCEP”), dan dampak hukumnya pada Usaha Kecil dan Menengah (“UKM”) Indonesia. Dari pendekatan tersebut, tesis ini menemukan bahwa ROO RCEP dibandingkan dengan AJCEP menawarkan lebih banyak fleksibilitas dari segi metode perhitungan alternatif, aturan akumulasi, toleransi de minimis, serta bukti asal barang. Selain itu, tesis ini juga menemukan bahwa UKM Indonesia dapat menuai keuntungan dari persyaratan bukti asal barang RCEP yang telah disederhanakan.
The Regional Comprehensive Economic Partnership ("RCEP") entered into force on January 2022 after multiple negotiations spanning over nine years, with fifteen out of the original sixteen negotiating countries signing its ratification. The agreement's enormous geographical scope and substantial representation of GDP and population have cemented its status as one of the largest trade blocs outside the World Trade Organization ("WTO"). Among many of the initiatives heralded by the RCEP is the agreement's provisions on Rules of Origin ("ROOs"), a staple feature in Free Trade Agreements ("FTAs") which detail the criteria of goods eligible to receive the benefits offered by the agreement. The RCEP proposes its ROOs to be a more flexible and harmonized alternative to existing ROOs within the ASEAN region and the many FTAs it has entered into. This thesis intends to examine using the juridical-normative research method with a comparative approach. This thesis shall compare the RCEP's ROOs with that of another essential FTA, namely the ASEAN-Japan Comprehensive Economic Partnership ("AJCEP"), and evaluate the legal effects of the RCEP's ROOs on Indonesian SMEs. Through the aforementioned approach, this thesis finds that the RCEP's ROOs, compared to the AJCEP, offer more flexibility due to the RCEP's alternate origin calculation methods, cumulation rules, de minimis derogations, and proofs of origin. Additionally, this thesis finds that Indonesian SMEs may benefit from the RCEP's streamlined proof of origin requirements."
