"Asuransi Allianz Utama Indonesia known as AZINDO established in 1981, has been developing various kind of non-life insurance products both standard and package. There are two product lines that are sold now by AZINDO: Corporate and Retail non-life insurance. In 1999 AZINDO formed Allianz Center (called AZCENTER) that manages retail products. Theproducts are directly sold by sales persons of the company or by agents or brokers. This system has already been known as a cooperation in marketing, franchise or licensed products that aimed to broaden the network.
There were 105 loss insurance companies in Indonesia in year 2001 and they were state-owned, private national, and joint venture. To anticipate the dynamic global competition, the AZCENTER management feels that it is necessary to develop a new marketing system for retail products by cooperating with Distribution Company.
This work has an objective that is to support inputs on strategy in determining Distribution Company and to form maximum compensation that could be given as an extra to the standard commission. Type of Distribution Company will depends on retail product sold and company with salesperson but not an insurance company or Multi Level Marketing system company. A system has been created to decide which Distribution Company performed by Analytical Hierarchy Process and Expert Choice software with other criteria such as potential salesperson, period of time established, location, facility, business-line owned, marketing system, company culture, etc. Based on the above, subjects, cost, benefit and risk of each Distribution Company could be determined to get the best result of rank.
Numbers of Distribution Company to determine here is by consider types of retail product and AZINDO corporations used in the past. Compensation of the extra commission is based on expenses spent by AZINDO for operational cost, building, salary and old data comparison on premium, claim, result and commission ever happened to AZCENTER, AZINDO and competitors' non-life insurance company (with application support of SPSS to calculate the correlation of premium, claim, result and commission) so that the maximum commission is combined with reward and discount rate for the Distribution Company.
Information Technology support is given as an advise in making Distribution Company by using integrated system of Enterprise Resource Planning (ERP) in all parts of internal and external companies and is leading to use Systems-Applications-and-Products-in-DataProcessing (SAP), electronic business (e-business) and electronic commerce (e-commerce). In this case, both internal and external assessment and analysis are supporting target that could be performed in short or long term.
Determination target is performed by consider the target reached by AZINDO or by total Indonesia market shown in Data Asuransi Indonesia (DAI) and from the numbers of product fit to the AZCENTER in Indonesia. The variation is shown up by considering the sensitivity analysis via reward, commission, extra commission for salesperson and Distribution Company, and others that could be given to the Distribution Company, sales and consumer by allocating expense largely for marketing and promotion.
The conclusion in making Distribution Company is to broaden the marketing of retail product that gives advantages for Allianz Center, Distribution Company, salesperson and consumer. Recommendations will be given based on result analysis in facing the obstacles that might happen in the future."

"Skripsi ini membahas tentang karakteristik bentuk Usaha Bersama dan bentuk tanggung jawab hukum dari AJB Bumiputera 1912. Hasil dari penelitian dengan metode penelitian hukum normatif yuridis ini mengungkapkan bahwa Usaha Bersama memiliki karakteristik sebagai badan hukum; perkumpulan orang yang tidak menerbitkan saham; setiap anggotanya juga merupakan tertanggung; diselenggarakan dengan prinsip demokrasi dan solidaritas; dan laba perusahaan dimanfaatkan untuk kepentingan anggotanya. Anggaran Dasar AJB Bumiputera 1912 sebagai perusahaan berbentuk Usaha Bersama tidak menyatakan dengan jelas bentuk tanggung jawab hukumnya dan hanya menentukan bahwa para anggota dapat juga dibebakankan tanggung jawab hukum, dalam kondisi tertentu. Namun berdasarkan Arrest Hoge Raad tanggal 20 Oktober 1865 jo. pasal 1661 KUHPER diketahui bahwa bentuk tanggung jawab Usaha Bersama adalah terbatas (limited).

This thesis discusses the characteristic of a Mutual Insurance and the liability of an insurance company named AJB Bumiputera 1912. By conducting a normative legal research, it reveals that the Mutual Insurance has the characteristic as a legal entity; is an association of people who do not issue shares; each member is also an insured; organized by the principles of democracy and solidarity; and the profits will be used for the benefit of its members. Statutes of AJB Bumiputera 1912 does not clearly state the form of its liability and only determine that, in certain situations, the members can also be held liable. However based on the Hoge Raad Arrest dated October 20, 1865 and Article 1661 of the Civil Code, it is known that the liability of Mutual Insurance is limited."

"Skripsi ini bertujuan untuk menganalisis pengaruh efisiensi alokasi asuransi alat berat (rasio klaim dan waktu penyelesaian klaim) terhadap kinerja perusahaan sewa guna usaha (ROA). Penelitian ini adalah penelitian kuantitatif dengan menggunakan metode Stochastic Frontier Analysis (SFA) dan Regresi Berganda.
Hasil penelitian menyatakan bahwa efisiensi alokasi asuransi alat berat memiliki pengaruh yang signifikan terhadap kinerja perusahaan sewa guna usaha. Semakin tinggi tingkat efisiensi alokasi asuransi alat berat, semakin tinggi pula tingkat kinerja perusahaan sewa guna usaha.
Berdasarkan hasil penelitian ini, peneliti menyarankan kepada perusahaan sewa guna usaha supaya memilih perusahaan asuransi rekanan yang mempunyai tingkat efisiensi alokasi yang tinggi supaya dapat meningkatkan kinerja perusahaan sewa guna usaha tersebut.

The purpose of this study is to analyze the influence of allocation efficiency of heavy equipment insurance (claim ratio and claim settlement period) to leasing company's performance (ROA). The research is quantitative which using Stochastic Frontier Analysis (SFA) dan Multiple Regression Methods.
The research's result has showed that allocation efficiency of heavy equipment insurance has significant influence to leasing company's performance. If the degree of allocation efficiency of heavy equipment insurance is high, the degree of leasing company's performance will be high too.
Based on the research's result, researcher has suggestion to the leasing company in order to choose the insurance company as its partner which has high degree of allocation efficiency, so that the leasing company can be probably increasing the degree of its performance.

"Perusahaan Y merupakan salah satu nasabah Perusahaan Asuransi X yang telah melakukan klaim persalinan sectio caesarea dengan persentase 35% dari total klaim persalinan pada periode Februari 2011 - Januari 2012. Penelitian ini dilakukan untuk mengetahui faktor-faktor yang berhubungan dengan tindakan sectio caesarea pada produk asuransi kesehatan managed care Perusahaan Asuransi X di Perusahaan Y. Desain penelitian cross sectional, dengan mengambil data sekunder dari transaksi klaim Perusahaan Asuransi X periode Februari 2011 - Januari 2012. Responden 180 peserta Perusahaan Asuransi X yang memanfaatkan pelayanan kesehatan persalinan.
Hasil penelitian menunjukkan proporsi peserta persalinan dengan tindakan sectio caesarea sebesar 63 (35%) dari 180 total peserta persalinan produk asuransi kesehatan managed care Perusahaan Asuransi X. Didapatkan variabel yang berhubungan dengan tindakan sectio caesarea adalah penyakit penyerta. Atas dasar tersebut dianjurkan untuk melakukan evaluasi terhadap proses underwriting pada tahap seleksi risiko.

Y company is one of the customers of Insurance X Company which has sectio caesarea?s childbirth claim with percentage 35% of the total labor claims in February 2011 - January 2012 period. The study conducted to determine the relation factors of the sectio caesarea action in managed care health insurance X products in Y company. Cross- sectional study design, by taking a secondary data from Insurance X Company claims transactions in February 2011 - January 2012 period. Respondents were 180 participans Insurance X Company that utilizes childbirth health care services.
The results showed the proportion of sectio caesarea action participants were 63 (35%) of 180 total participants childbirth managed care health insurance products Insurance X Company. The variable that related with the sectio caesarea action is the comorbid disease. On the basis of it is recommended to evaluate the underwriting process on the risk selection stage.

"Pelanggaran terhadap prinsip utmost good faith seringkali menjadi permasalahan seperti dalam kasus yang terjadi antara Muhammad Idris, seorang ahli waris dari nasabah Bank BRI dan peserta asuransi Bringin Life, Ibrahim Idris, dengan Bank BRI. Bringin Life menolak klaim asuransi terkait dengan alasan pelanggaran terhadap prinsip utmost good faith karena Ibrahim Idris telah menyembunyikan riwayat kesehatannya dalam pengisian surat pernyataan kesehatan, yang diduga diisi oleh pihak Bank BRI. Bringin Life pada akhirnya memberikan pembayaran klaim secara ex gratia sebesar lima ratus juta rupiah melalui Bank BRI dan telah diterima oleh Muhammad Idris. Muhammad Idris kemudian menggugat Bank BRI untuk membayar ganti kerugian karena Bank BRI telah melakukan kelalaian yang menyebabkan kerugian. Penelitian ini dimaksudkan untuk mengetahui dasar pertimbangan hukum dari hakim dalam putusan Nomor 21/PDT.G/2011/PN.KAG terkait dengan prinsip utmost good faith, dasar dalam memberikan ex gratia payment, serta status hak untuk mengajukan klaim setelah pembayaran secara ex gratia dilakukan. Penelitian dilakukan dengan metode penelitian yuridis-normatif dengan menggunakan data sekunder berupa studi pustaka dan wawancara dengan narasumber. Berdasarkan hasil analisis dalam penelitian ini diperoleh kesimpulan bahwa dalam penerapan prinsip itikad paling baik (utmost good faith), pertimbangan hukum dari hakim dirasa kurang tepat mengingat Ibrahim Idris lah yang menandatangani surat pernyataan kesehatan. Dasar pemberian ex gratia payment sendiri bisa bermacam-macam, salah satunya adalah pertimbangan bisnis. Selain itu, setelah mendapatkan ex gratia payment¸ idealnya tidak boleh lagi ada tuntutan terkait klaim tersebut di kemudian hari
Violation of utmost good faith principle often brings up some problems, just like in a case which occurred between Muhammad Idris, the heir of Bank BRI customer and the insured of Bringin Life, Ibrahim Idris, with Bank BRI. Bringin Life rejected the related claim because of the violation of the utmost good faith principle as Ibrahim Idris had hid his health history in filling the health statement, which is allegedly filled by Bank BRI. At the end, Bringin Life gave an ex gratia payment of five hundred million through Bank BRI and it was received by Muhammad Idris. Muhanmad Idris then prosecuted Bank BRI to pay a sum of money due to Bank BRI’s negligence which led to loss. This study aimed to determine the law consideration by the judges in court decision no. 21/PDT.G/2011/PN.KAG related to utmost good faith principle, the basic reasons for giving ex gratia payment, and the status of rights to claim after the ex gratia payment has been paid. Research is conducted by the juridical-normative research methods using secondary data from the study of documents and interviews with sources. Based on the analysis in this study, it can be concluded that in applying the utmost good faith principle, the law consideration by the judge is less appropriate considering that Ibrahim Idris was the one who signed the health statement. The basic reasons for giving ex gratia payment can vary which one of them is business consideration. Moreover, after receiving an ex gratia payment, ideally there should be no more claims related to it in the future."
