"Usia Pertama menikah yang dilakukan wanita di Kabupaten Bekasi 51,3 % dibawah usia 20 tahun. Ini merupakan salah satu penyebab terjadinya Kekerasan Dalam Rumah Tangga (KDRT). Dari penelitian ini, wanita yang menikah dibawah usia 20 tahun mengalami KDRT selama menikah sebanyak 115 (73,9%). Terdapat hubungan antara responden yang melakukan pernikahan dibawah usia 20 tahun dengan KDRT. Wanita yang melakukan pernikahan di bawah usia 20 tahun berisiko 2 kali mengalami KDRT. Faktor lain yang berhubungan dengan KDRT yaitu Pendidikan suami rendah, Penghasilan rendah, Pengambil keputusan, pemilihan pasangan, suami pengguna alkohol, konflik orang tua dan riwayat suami dengan perilaku kekerasan fisik.

From this study, women who were married under the age of 20 years experience domestic violence during the marriage as much as 115 (73,9%). There is a relationship between the respondents who do marriage under the age of 20 years with domestic violence. Women who perform marriages under the age of 20 years has twice the risk of experiencing domestic violence. Other factors associated with domestic violence are husbands low education, low income, decision makers, mate choice, husband alcohol users, parents conflict and husband with a history of physically violent behavior."

"ABSTRAKSkripsi ini membahas mengenai perkawinan yang tidak dicatatkan akibat kekerasan dalam rumah tangga yang diajukan gugatan perceraian ke Pengadilan Negeri, yang kemudian melewati tahap Pengadilan Tinggi dan Mahkamah Agung. Mengenai sahnya suatu perkawinan yang telah diatur dalam Pasal 2 UU Nomor 1 Tahun 1974 tentang Perkawinan menimbulkan ambiguitas terhadap pandangan para Majelis Hakim dalam tiap tingkat pengadilan. Perbedaan interpretasi atas sahnya suatu perkawinan juga memberi pengaruh terhadap implementasi UU Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga yang tidak diterapkan oleh aparat hukum bagi perempuan dalam perkawinan yang tidak dicatatkan padahal telah seharusnya dapat mengatur seluruh ruang lingkup rumah tangga. Dalam penelitian ini penulis mengajukan pokok permasalahan, yaitu 1 Bagaimana status perkawinan yang tidak dicatatkan menurut Undang-Undang Nomor 1 Tahun 1974 dan Putusan Pengadilan? 2 Bagaimana akibat hukum bagi istri yang mengalami kekerasan dalam rumah tangga dari putusnya perkawinan yang tidak dicatatkan tersebut? dan 3 Bagaimana Hakim Pengadilan memberikan putusan cerai atas perkawinan yang tidak dicatatkan akibat terjadinya kekerasan dalam rumah tangga?. Penelitian ini menggunakan metode penelitian yuridis normatif dengan tipe penelitian deksriptif dan mono disipliner. Berdasarkan hasil analisa penulis, diperoleh kesimpulan bahwa, telah terdapat perbedaan pandangan mengenai sahnya suatu perkawinan yang menyebabkan kekosongan hukum pada prosedur pengajuan gugatan perceraian di Pengadilan Negeri sehingga pada akhirnya Mahkamah Agung menolak gugatan perceraian karena putusan pengadilan tidak dapat dieksekusi untuk dicatatkannya terlebih dahulu perkawinan tersebut.

ABSTRACTThe focus of this thesis is on the unregistered marriage caused by domestic violence, submitted a divorce lawsuit to the Distric Court, which then passes through the stages of the High Court and the Supreme Court. Regarding the marriage legalization that has been regulated on Article 2 Marriage Law 1 1974 raises ambiguity on the opinion of the Judges at each court level. Differences in interpretation of the marriage legalization also gives effect to the implementation of Law 23 2004 on Domestic Violence that is not applied by law officer for women who bounded on unregistered marriage, even it should be able to regulate the entire part of domestic. In this thesis, the writer proposed the main issues, which are 1 How is status of unregistered marriage on Marriage Law and Court Decisions 2 What are the legal consequences for a wife who experienced domestic violence from divorce of unregistered marriage and 3 How did the Judges of the Court give divorce decisions on unregistered marriage caused by domestic violence . This research used normative juridical method with descriptive and mono dicipliner tipology. Based on the result of the writer rsquo s analysis, it can be concluded that there is a difference opinion about marriage legalization between the Judges at each court level that caused legal vacuum in the procedure of submitted the divorce lawsuit in Distric Court then the Supreme Court finally refused the divorce lawsuit because Distric Court rsquo s decision could not be executed for register the marriage first.
