Dengan demikian tidak boleh ada konsentrasi penguasaan tanah dimana sekelompok kecil orang menguasai sebagian besar tanah, sementara sebagian besar orang hanya menguasai tanah yang sempit. Untuk menciptakan keadilan, penataan hak hak atas tanah juga perlu untuk memberikan kepastian hak hak atas tanah.Selama ini, ketidakpastian hak hak atas tanah telah pula menjadi sumber konflik dan sengketa pertanahan yang tidak berkesudahan."

"The article is descriptive and was conducted in the Province of West Sumatra, where ganggam bauntuak exists. The result of research indicated that first, the mechanism for implementing of the conversion of ganggam bauntuak land right is carried out in accordance with Regulation of the Ministry of Agriculture and Agrarian Affairs (PMPA) No 2 of 1962. Second, the major contributing factor to cases of deviation in which ganggam bauntuak right is converted into right of ownership is the existence and nature of ganggam bauntuak right itself, which in an adat right of ownership and not only right of use. Third, the kind of right that is appropriate for ganggam bauntuak land, as perceived by the community, is right ownership, not right of use: this right covers particularly land for housing development, but it can also include agricultural land and the abligation of ganggam bauntuak land-holders when exercising their right to put in a request for conversion is generally payment of cost incurred in writing of a little-deed."

"Tanah memiliki peranan penting dalam kehidupan sehari-hari maka terkait pelaksanaanya perlu untuk memerhatikan Hak-Hak dan serta perlindungan terhadapnya. Undang-Undang Pokok Agraria sendiri memiliki turunan salah satunya membahas terkait Redistribusi Tanah yang diatur dalam Peraturan Presiden Nomor 88 Tahun 2017 tentang Penyelesaian Penguasaan Tanah Dalam Kawasan Hutan Namun setelah disahkannya Peraturan Presiden Nomor 62 Tahun 2023 tentang Percepatan Pelaksanaan Reforma Agraria, maka atas Peraturan Presiden Nomor 88 Tahun 2017 dan Peraturan Presiden Nomor 86 Tahun 2018 tentang Reforma Agraria dicabut dan digantikan dengan Peraturan Presiden Nomor 62 Tahun 2023 tentang Percepatan Pelaksanaan Reforma Agraria. Dalam pengertianya Redistribusi tanah adalah untuk mengatasi ketimpangan penguasaan dan pemilikan tanah bagi petani yang mengantungkan hidupnya di lahan pertanian. Pelaksanaan Landreform dapat menjadi sarana untuk mewujudkan kesejahteraan masyarakat desa yang mayoritas hidup dari usaha pertanian. Landreform dapat berarti juga perombakan struktur pertanahan yang didalamnya termasuk perombakan terhadap hubungan manusia dengan tanah, hubungan manusia dengan manusia berkaitan dengan tanah dalam rangka meningkatkan pendapatan petani. Hal ini dapat terwujud dalam program redistribusi tanah objek Landreform. Penelitian ini menggunakan Pendekatan penelitian perundang-undangan dan pendekatan konseptual, Penelitian ini menggunakan data sekunder berupa bahan hukum primer yaitu peraturan perundang-undangan dan bahan hukum sekunder berupa buku dan jurnal ilmiah Hasil penelitian ini mengungkapkan (a) Redistribusi sebagai perolehan Hak atas Tanah (b) Tanggungjawab dalam Penerapatan Redistribusi (c) Perlindungan hukum bagi Pemegang Hak atas Redistribusi (d) Ganti kerugian (e) Perwujudan keadilan Redistribusi tanah Objek Landreform.

As land plays an important role in everyday life, it is necessary to pay attention to rights and protection regarding its implementation. The Basic Agrarian Law itself has derivatives, one of which discusses Land Redistribution as regulated in Presidential Regulation Number 88 of 2017 concerning Settlement of Land Tenure in Forest Areas. However, after the ratification of Presidential Regulation Number 62 of 2023 concerning the Acceleration of Implementation of Agrarian Reform, Presidential Regulation Number 88 of 2017 and Presidential Regulation Number 86 of 2018 concerning Agrarian Reform are revoked and replaced with Presidential Regulation Number 62 of 2023 concerning Accelerating the Implementation of Agrarian Reform. In its understanding, land redistribution is to overcome inequality in control and ownership of land for farmers who depend on agricultural land for their livelihood. Implementing Landreform can be a means of realizing the welfare of rural communities, the majority of whom live from agricultural businesses. Land reform can also mean an overhaul of the land structure which includes an overhaul of human relationships with land, human relationships with humans related to land in order to increase farmers' income. This can be realized in the land redistribution program for Landreform objects. This research uses a statutory research approach and a conceptual approach. This research uses secondary data in the form of primary legal materials, namely statutory regulations and secondary legal materials in the form of books and scientific journals. The results of this research reveal (a) Redistribution as the acquisition of Land Rights (b ) Responsibilities in Implementing Redistribution (c) Legal protection for Rights Holders of Redistribution (d) Compensation for losses (e) Realization of justice for Redistribution of Land Objects of Landreform."
