"In 1956, ICJ judge Philip Jessup highlighted the gaps between private and public international law and the need to adapt the law to border-crossing problems. Today, sixty years later, we still ask what role transnational law can play in a deeply divided, post-colonial world, where multinationals hold more power and more assets than many nation states. In searching for suitable answers to pressing legal problems such as climate change law, security, poverty and inequality, questions of representation, enforcement, accountability and legitimacy become newly entangled. As public and private, domestic and international actors compete for regulatory authority, spaces for political legitimacy have become fragmented and the state's exclusivist claim to be law's harbinger and place of origin under attack. Against this background, transnational law emerges as a conceptual framework and method laboratory for a critical reflection on the forms, fora and processes of law making and law contestation today."

"ABSTRAK
Gerakan Salafi adalah satu gerakan transnasional yang penting untuk diamati dalam dekade belakangan ini. Tidak hanya pola ekspansinya yang global, namun juga
terkait dengan jaringannya. Salah satu pusat gerakan yang memberikan support
penyebaran ideologi Salafi ke Indonesia adalah Yaman. Dalam catatan sejarah, Salafi
Yaman merupakan gerakan Islam kontemporer yang dimulai dari tokoh besar, yaitu
Muqbil bin Hadi al-Wadi'i. Pada tahun 1979, dia mendirikan Darul Hadits Dammaj
yakni lembaga pendidikan yang terletak di Provinsi Sa'dah, Yaman. Semenjak tahun
1990 Darul Hadits Dammaj terus didatangi oleh pelajar dari Indonesia di samping
banyak dijadikan tempat belajar bagi pencari ilmu agama yang berasal dari berbagi
negara belahan dunia.
Tesis ini menganalisis dua aspek, yakni: pertama, mengapa Salafi Jihadi Darul
Hadits Yaman menjadi gerakan transnasional? Kedua, bagaimana diaspora aktor
dalam melakukan ekspansi gerakan Salafi Jihadi di Indonesia? Adapun tujuan dari
riset tesis ini ialah untuk mengkaji perkembangan gerakan Salafi Jihadi Darul Hadits
Yaman dengan menitikberatkan pada aktor, jaringan, dan strateginya. Aktor
merupakan poin penting untuk dirunut guna mendapat gambaran tokoh yang paling
berperan dalam diaspora gerakan Salafi Jihadi di Indonesia. Selain itu, jaringan dan
strategi dari kelompok Salafi Jihadi alumni Darul Hadits menjadi poin penting yang
akan direkontruksi sehingga memunculkan temuan akademik yang signifikan.
Penelitian ini menggunakan pendekatan teori social movement Sydney Tarrow yang
berkaitan erat dengan tiga elemen penting, yaitu struktur kesempatan politik (SKP),
Framing Process, dan Resource Mobilization atau mobilisasi sumber daya. Pola yang
digunakan adalah melakukan pemetaan terhadap gerakan Salafi Jihadi pada klusterkluster di Indonesia.

ABSTRACT
The Salafi movement is an important transnational movement to observe in the
last decade. Not only its global expansion pattern, but its network must be taken into
account of importance. One of the centers of the movement that are most influential in
the spread of Salafi ideology into Indonesia is Yemen. Based on the historical records,
the Yemeni Salafi is a contemporary Islamic movement that started from a great figure,
namely Muqbil bin Hadi al-Wadi'i. In 1979, he founded Darul Hadits Dammaj, an
educational institution located in Sa'dah Province, Yemen. Since 1990 Darul Hadits
Dammaj has continued to be visited by students from Indonesia as well as being used
as a place of study for seekers of religious knowledge from various countries around
the world.
The thesis analyzes two aspects, namely: first, why did Yemeni Salafi Jihadi
Darul Hadits become a transnational movement? Second, how do the diaspora actors
expand the Salafi Jihadi movement in Indonesia? The purpose of this research is to
study the development of the Yemeni Salafi Jihadi Darul Hadith movement
emphasizing on actors, networks and strategies. Actors are an important point to trace
in order to get a vivid description of the figures who play a role in the diaspora of the
Salafi Jihadi movement in Indonesia. In addition, the networks and strategies of the
Salafi Jihadi group of Darul Hadits alumni are important points that will be
reconstructed so that it may lead to a discovery of significant academic findings. This
study uses the Sydney Tarrow social movement theory approach which is closely
related to three important elements, namely the Political Opportunity Structure, the
Framing Process, and the Resource Mobilization. The pattern being used in this
research is to map the Salafi Jihadi movement in clusters in Indonesia."

"Since the end of the Cold War there has been an explosion of international courts and tribunals that sit apart from domestic legal systems, yet they are often woefully inadequate for their stated purposes. This book explores common problems across these courts, and applies a constructivist theory of international relations to explain their operation. Often established by states as signals of their commitment to moral values and political ideology, once created these courts find themselves trapped between the interests of the Great Powers.
