"This book brings together foreign investment and investment arbitration in Asia, the fastest growing economic region in the world. It provides a critical analysis of foreign investment, its benefits and the legal regimes of the jurisdictions studied at a time when investor-state disputes are on the rise and investment arbitration is under growing scrutiny. Governments are under greater pressure to balance the promotion of investment with public policy development and interests and calls for a permanent court for investment arbitration are getting louder. To assess future possibilities, this book takes stock of, brings together and analyses the legal regimes on foreign investment in 12 major Asian jurisdictions, namely China, Hong-Kong, India, Indonesia, Japan, South Korea, Malaysia, Myanmar, Philippines, Singapore, Thailand and Vietnam. These constitute paradigmatic examples of what is happening in the legal framework of Asian foreign investment and the impact that the current system of investment arbitration has in all of them. The analysis shows the existence of changing positions and degrees of openness towards foreign investment in the region, as well as a distinct level of exposure to and involvement in investment arbitration. Predictably, their situation will change in the near future, at least in relation to investment arbitration. Proposals for reform have already been made and international institutions are working on the development of an alternative to the proceedings of investment arbitration as it is currently constructed and understood. Consequently, the last two chapters of this book are devoted to the analysis of these developments that will most probably affect the existing situation in the region."

"This is the first comprehensive study of corruption in international investment arbitration. The book considers the limited effectiveness of efforts to combat transnational corruption in international law and the emergence of international investment arbitration as a singular means foreffective control of corruption within the international legal order. The case law on corruption by investment tribunals is studied exhaustively, jurisprudential trends are identified, and reforms aimed at enhancing the effectiveness and fairness of investment arbitration as a mechanism to combatcorruption are proposed. Divided into three parts, part I focus on the phenomenon of corruption in foreign investment and attempts at its control through international law. Part II analyses the available case law in international investment arbitration dealing with corruption. Llamzon identifies nine distinct trendsemerging from the case law and provides a table summarizing the key areas of corruption decision-making and each relevant tribunal's approach, which is an invaluable tool for practitioners engaging in "live" issues of corruption within arbitral proceedings. Part III reflects on the implications ofthese trends for both the "supply" and "demand" sides of corruption in international law, and proposes a integrative framework of decision for corruption issues in international investment arbitration. "

Dalam perkembangannya, tribunal arbitrase seringkali dihadapkan dengan isu korupsi yang dijadikan argumentasi oleh para pihak untuk menolak yurisdiksi tribunal atau meniadakan klaim pihak lain. Kondisi tersebut menimbulkan komplikasi dan ketidakpastian terkait perlindungan investor mengingat sarana terhadap arbitrase merupakan bentuk perlindungan prosedural bagi investor. Sifat dari tindak pidana korupsi yang luas, multi-dimensional dan memiliki sisi pemberi dan penerima juga berperan dalam menambah komplikasi permasalahan ini. Penelitian ini akan membahas komplikasi tersebut serta mengkaji kesiapan hukum investasi Indonesia dalam menghadapi permasalahan tersebut.

As one of a form of protection toward investors, international investment arbitration provides a way for foreign investor to file a lawsuit based on the substantive protection provided to them as a right. In its development, arbitral tribunal often faced with an issue of corruption that serve as a killing argument against the claim of other parties, this condition has the potential to complicate the issue and create uncertainty towards investor protection in which the international investment arbitration itself serves as a procedural protection of investor. The nature of the corruption which is broad, multi-dimensional, and got supply and demand side in it, furtherly complicate the issue. This study will discuss on this complicated issue and review about the readiness of Indonesian Investment Law to deal with the issue."

ABSTRACT
In this study, Caroline Henckels examines how investment tribunals have balanced the competing interests of host states and foreign investors in determining state liability in disputes concerning the exercise of public power. Analyzing the concepts of proportionality and deference in investment tribunals' decision-making in comparative perspective, the book proposes a new methodology for investment tribunals to adopt in regulatory disputes, which combines proportionality analysis with an institutionally sensitive approach to the standard of review. Henckels argues that adopting a modified form of proportionality analysis would provide a means for tribunals to decide cases in a more consistent and coherent manner leading to greater certainty for both states and investors, and that affording due deference to host states in the determination of liability would address the concern that the decisions of investment tribunals unjustifiably impact on the regulatory autonomy of states."

"Third-Party Funding merupakan metode pendanaan di mana penyandang dana memberikan dana kepada salah satu pihak dalam sengketa untuk menggugat atau meminimalkan gangguan arus kas, dan jika kasus dimenangkan, penyandang dana akan mendapatkan bagian dari putusan akhir yang diperoleh. TPF awalnya dipergunakan dalam litigasi di beberapa yurisdiksi, namun kini semakin populer dalam arbitrase investasi internasional. Peningkatan pemanfaatan TPF ini berpotensi menghadirkan dampak yang signifikan. Skripsi ini menggunakan metode penelitian yuridis normatif dengan menganalisis data sekunder dari studi literatur, terutama ICSID Rules and Regulations setelah amandemen keempat. Amandemen ini menghadirkan aturan baru terkait praktik TPF, yakni Pasal 14 dalam ICSID Arbitration Rules tentang Notice of Third-Party Funding. Analisis Skripsi ini terutama difokuskan pada potensi dampak pengaturan baru terhadap praktik arbitrase investasi internasional, bagi Indonesia sebagai host state dalam ICSID, serta sebagai negara pelaksana arbitrase. Skripsi ini diharapkan dapat mendukung implementasi TPF yang lebih mengutamakan akses keadilan berdasarkan prinsip-prinsip Konvensi ICSID, menganalisis hambatan dan tantangan yang mungkin dihadapi oleh Indonesia di kemudian hari, serta dampak yang mungkin dihadirkan terhadap pengaturan arbitrase di Indonesia.

Third-Party Funding is a method in which a funder provides funds to one of the parties in a dispute to initiate a claim or minimize cash flow disruption. If the case is won, the funder will receive a share of the final award obtained. TPF was originally used in litigation in several jurisdictions, but is now increasingly popular in international investment arbitration. The increased use of TPF potentially presents significant implications. This thesis employs a normative legal research method by analyzing secondary data from literature studies, especially the ICSID Rules and Regulations after the fourth amendment. The amendment introduces new rules related to TPF practices, namely Article 14 in the ICSID Arbitration Rules concerning Notice of Third-Party Funding. This thesis analysis mainly focuses on the potential implications of the new regulation on international investment arbitration practices, for Indonesia as a host state in ICSID and a state that implements arbitration. This thesis is expected to support the implementation of TPF that prioritizes access to justice based on the principles of the ICSID Convention, analyze barriers and challenges that Indonesia may face in the future, and the potential impact on arbitration regulations in Indonesia."

ABSTRACT
Signatory States have the right to take action in order to maintain their financial stability, stimulate economic development or further their non-economic interests (such as health, the environment and food security). However, such measures can potentially conflict with the rights of foreign investors. Regulators and policy makers must take States' international commitments toward foreign investors into account when making decisions. They must also avoid resorting to protectionism in drafting new treaties. With this tension in mind, this book offers a balanced reappraisal of bilateral treaties and regional agreements on foreign investments. The sensitive issues are examined in the light of the case law of arbitral investment tribunals and other international courts, and the analysis highlights how cross-fertilisation between trade and investment can assist in resolving conflicts."
