"Dalam proses pendaftaran tanah seringkali timbul suatu masalah yang salah satunya adalah terbitnya tumpang tindih sertipikat diatas suatu bidang tanah yang sama. Salah satu contoh kasusnya terdapat pada Putusan Mahkamah Agung Nomor 734 PK/Pdt/2017 yang terjadi di Kota Bandung. Dalam kasus ini, penulis melakukan analisis mengenai bagaimana kesesuaian pertimbangan dan amar putusan majelis hakim dan perlindungan hukum bagi pemegang hak atas tanah pada kasus tumpang tindih dalam putusan Mahkamah Agung Nomor 734 PK/Pdt/2017. Metode penelitian yang digunakan adalah yuridis normatif dengan menggunakan studi dokumen. Berdasarkan analisis Penulis maka ditemukan bahwa penyebab terjadinya tumpang tindih sertipikat adalah adanya ketidaktelitian dari Kepala Kantor Pertanahan Kota Bandung yang melakukan pelanggaran asas-asas umum pemerintahan baik. Simpulan dari penelitian adalah terdapat pertimbangan hakim yang kurang tepat mengenai asal-usul objek sengketa yang merupakan tanah negara dan pemenuhan syarat sah perjanjian serta juga perlindungan hukum pemegang hak berdasarkan Putusan Mahkamah Agung Nomor 734 Pk/Pdt/2017 belum tercapai karena belum diterapkan peraturan perundang-undangan sebagaimana mestinya.

In the land registration process, problems often arise and one which is the issuance of overlapping land certificates on the same plot of land. One example of this issue is the Supreme Court Decision Number 734/PK/Pdt/2017 which occurred in the city of Bandung. In this case, the author analyzes how the considerations and decisions made by the panel of judges match the law and legal protection for the right land holders in overlapping cases in the Supreme Court Decision Number 734/PK/Pdt/2017. The research method used in this thesis is normative juridical using document studies. Based on the author’s analysis, it was found that the cause of overlapping certificates was the inaccuracy of the Head of Bandung City Land Office who violated the general principles of good governance. The conclusion of the research is there is an inappropriate judge’s consideration regarding the origin of the object of dispute which is a state land and the fulfillment of legal requirements of the agreements as well as the legal protection of the right holder based on the Supreme Court Decision Number 734/PK/Pdt/2017 has not been achieved."

"Kepastian hukum atas tanah hak barat dilakukan melalui konversi, ditandai dengan pelaksanaan pendaftaran tanah. Selain itu perlu dilakukan pemeliharaan datanya, salah satunya dengan melakukan perpanjangan jangka waktu bagi hak atas tanah tertentu yang masih dipergunakan oleh bekas pemegang hak tersebut. Tidak dilakukannya perpanjangan jangka waktu atas tanah yang masih dimanfaatkan dapat menimbulkan masalah di tengah masayarakat. Salah satunya kasus antara ONT yang merasa sebagai pihak yang berhak atas tanah milik PT.XXX yang telah habis jangka waktu hak atas tanahnya. Karena itu penulis mengangkat masalah mengenai status kepemilikan atas tanah hasil konversi hak barat (Hak Guna Bangunan) miliki perusahaan di Indonesia sesuai dengan Keputusan Presiden Nomor 32 Tahun 1979 yang tidak dilakukan perpanjangan jangka waktu serta status kepemilikan hak atas tanah dan bangunan milik PT.XXX. Bentuk penelitiannya adalah yuridis normatif dengan tipologi penelitannya yaitu deskriptif analitis. Data yang digunakan adalah data sekunder, terdiri dari bahan hukum primer dan sekunder. Alat pengumpulan datanya studi dokumen dengan metode analisis data kualitatif. Perpanjangan jangka waktu penting untuk kepastian hukum bagi tanah yang masih dimanfaatkan.  Tidak adanya kepastian hukum tersebut dapat menjadi celah bagi oknum untuk mendapatkannya, seperti yang dilakukan ONT atas tanah milik PT.XXX. Pada akhirnya PT.XXX memenangkan perkara karena memiliki hak prioritas sebagai bekas pemegang hak.  Kelalaian PT.XXX dan pemerintah yang tidak menindak bekas pemegang hak yang tidak melakukan perpanjangan namun tetap memanfaatkan tanah tersebut selayaknya yang berhak merupakan sebab sengketa ini. Status kepemilikan atas tanah tersebut menjadi tidak jelas dan pasti.

Legal certainty over western land is carried out through conversion, marked by the implementation of land registration. In addition, it is necessary to maintain the data, one of which is to extend the period of time for certain land rights that are still used by the former right-holders. Not doing extended periods of land that is still being utilized can cause problems in the community. One of the cases was between the ONT who felt that he were entitled to the land owned by PT. XXX whose land rights had expired. Therefore the author raised the issue of the ownership status of the land converted to western rights owned by a company in Indonesia in accordance with Presidential Decree No. 32 of 1979 which did not extend the period and ownership status of the land and building rights of PT. XXX. The form of the research is normative juridical research with descriptive analytical typology. The data used is secondary data, consisting of primary and secondary legal materials. The tool for collecting data is studying documents with qualitative data analysis methods. An extension of the important period for legal certainty for land that is still utilized. The absence of legal certainty can be a gap for individuals to get it, as did the ONT on land owned by PT. XXX. In the end, PT. XXX won the case because it had priority rights as a former rights holder. PT. XXX's negligence and the government that did not take action against the former rights holders who did not carry out the extension but who still used the land should be entitled to be the cause of this dispute. The status of ownership of the land becomes unclear and certain."

"Pemerintah Kabupaten Serang memberikan Hak Guna Bangunan diatas tanah Negara kepada PT. Genta Kumala selaku developer untuk membangun pusat pembelanjaan modern yang terdiri dari sebuah mall dan beberapa ruko di Kota Cilegon. PT. Genta Kumala menjual ruko kepada masyarakat dengan status Hak Guna Bangunan untuk tiap unit ruko. Jangka waktu Hak Guna Bangunan diberikan selama 20 tahun, dan hak tersebut berakhir pada tahun 2012. Permasalah timbul ketika masyarakat melakukan permohonan perpanjangan jangka waktu Hak Guna Bangunan kepada BPN Cilegon. Permohonan tersebut ditolak oleh BPN Cilegon dengan alasan ruko tersebut berada diatas tanah Hak Pengelolaan atas nama Pemerintah Kabupaten Serang.
Pokok permasalahan yang hendak diangkat, yaitu bagaimanakah status Hak Pengelolaan yang diberikan diatas tanah Hak Guna Bangunan yang berada di kawasan Gedung Matahari Lama dan bagaimanakah kepastian hukum bagi pemegang Hak Guna Bangunan akibat diterbitkannya Hak Pengelolaan diatas tanah Hak Guna Bangunan tersebut. Menurut peraturan yang berlaku, Hak Pengelolaan yang diberikan diatas tanah Hak Guna Bangunan adalah tidak sah, sehingga ketentuan-ketentuan mengenai Hak Pengelolaan tidak dapat diaplikasikan dalam kasus ini. Hak Guna Bangunan ruko berada diatas tanah Negara, karenanya persetujuan pemegang Hak Pengelolaan bukan merupakan syarat permohonan perpanjangan jangka waktu hak.

Serang District's Government give Rights of Building over state land to PT. Genta Kumala as the developer to build a modern shopping center consisting of a mall and shophouse in the city of Cilegon. PT. Genta Kumala sell shophouse to the public with Rights of Building for each unit. Duration of Rights of Building granted for 20 years, and the rights expire in 2012. Problems comes when people make application for extension of their Rights of Building. The petition was rejected by the National Land Agency because the shophouse is located on Management Rights of Serang District?s Government.
The issue of this thesis are status of Management Rights which granted on the Rights of Building in Building of Matahari Lama Cilegon and legal certainty for Rights of Building holders due to the issuance of Management Rights over Rights of Building. According to legal regulations, Management Rights given over Rights of Building is invalid, so that the provisions regarding the Management Rights can not be applied in this case. Rights of Building's shophouse given over state land, hence the approval of the holders of Management Rights is not a requirement for extension of the term of right.

"Penelitian ini menitikberatkan pada pembahasan sengketa tumpang tindih penguasaan bidang tanah berdasarkan surat pernyataan penguasaan fisik bidang tanah (SPPFBT) dengan sertifikat hak pengelolaan di Desa Kuta, Kabupaten Lombok Tengah. Banyak ditemukan masyarakat Desa Kuta yang menguasai tanah dengan berlandaskan SPPFBT karena belum melaksanakan pendaftaran tanah pertamakali. Dengan demikian, BPN Kab. Lombok Tengah wajib berhati-hati dalam mengumpulkan data fisik dan yuridis tanah dalam hal pelaksanaan kegiatan pendaftaran tanah pertamakali agar kelak terhindar dari adanya konflik pertanahan. Adapun masalah yang timbul dimana BPN Kab. Lombok Tengah lengah dalam menerbitkan Sertifikat HPL No. 73/Kuta, terdapat beberapa prosedur yang terlewati sehingga sebagian bidang tanah dalam Sertifikat HPL No. 73/Kuta dengan tanah SPPFBT No. 05/SKT/I/2000 seluas 20.845 M2 tumpang tindih secara keseluruhan. Permasalahan yang diangkat dalam penelitian ini adalah analisis amar putusan dan pertimbangan hukum Hakim dalam memutus Putusan PTUN Mataram No: 55/G/2016/PTUN.MTR, juncto Putusan PTTUN Surabaya No: 112/B/2017/PT.TUN.SBY, juncto Putusan MA No: 37/K/TUN/2018, serta kedudukan dan perlindungan hukum bagi pemegang SPPFBT Nomor: 05/SKT/I/2000. Penelitian ini menggunakan metode penelitian hukum normatif serta analisis data secara eksplanatoris, sehingga terjawab bahwa, dalam mempertimbangkan suatu perkara, Majelis Hakim seyogianya menimbang dalam aspek kewenangan, prosedur serta kebenaran substansi dari suatu Sertifikat. Dibatalkannya Putusan PTUN Mataram No: 55/G/2016/PTUN.MTR oleh PTTUN Surabaya No: 112/B/2017/PT.TUN.SBY, maka pemegang SPPFBT No. 05/SKT/I/2000 kehilangan tanah yang telah dikuasainya selama lebih dari 16 tahun tanpa diberikan ganti kerugian. Di lain sisi, PP No. 24/1997 memandang SPPFBT sebagai alat pembuktian kepemilikan hak-hak lama dalam rangka pendaftaran tanah, sehingga pemegang SPPFBT wajiblah diberi perlindungan hukum terkait haknya.

This research focuses on discussions related to the overlapping land tenure rights based on the letter of land physical ownership (SPPFBT) with right to use certificate in Kuta Village, Central Lombok District. Kuta Village Citizens are commonly found having SPPFBT as their land tenure evidence. This happens because they have never registered their land to BPN. BPN Central Lombok District needs to be more careful in collecting physical and juridical data on land in terms of carrying out land registration activities for the first time so that in the future there will be less land conflicts. The problems that arise are where BPN Central Lombok District was negligent in issuing HPL Certificate No. 73/Kuta in which several procedures were missed so that some of the land parcels in the HPL Certificate No. 73/Kuta with SPPFBT No. 05/SKT/I/2000 land, which covers an area of ​​20,845 M2, are completely overlapping. The problems raised in this research are related to the analysis of the decisions and legal considerations of the judges in deciding the Mataram Administrative Court Decision Number: 55/G/2016/PTUN.MTR, in conjunction with the Surabaya Administrative High Court Decision Number: 112/B/2017/PT.TUN.SBY and legal status and protection for the holder of SPPFBT Number: 05/SKT/I/2000, in conjunction with the Supreme Court Verdict Number: 37/K/TUN/2018. In answering these problems, normative legal research methods are used. In addition, data analysis carried out in an explanatory approach. This research resulted in an answer which the Judges should consider all the aspects of competency, procedural and substance of a certificate. The cancellation of the Mataram Administrative Court Decision No: 55/G/2016/PTUN.MTR by PTTUN Surabaya No: 112/B/2017/PT.TUN.SBY, the holder of SPPFBT No. 05/SKT/I/2000 lost his land which he had utilized for more than 16 years without being given any compensation. On the other hand, PP No. 24/1997 views SPPFBT as an evidence of old rights land ownership in the context of land registration, so that SPPFBT holders must be given legal protection regarding their rights."

"Tesis ini membahas Pluralisme Kebijakan Pemerintah Dalam Penetapan Hak Guna Usaha Perkebunan di Indonesia Studi Kasus Tumpang Tindih Dengan Pertambangan, Kehutanan dan Tanah Ulayat. Penelitian ini bersifat yuridis normatif dan teknik pengumpulan data yang akan digunakan dalam penelitian ini adalah melalui penelitian kepustakaan (library research) dengan pendekatan peraturan perundang-undangan (statue approach). Kebijakan pengaturan sektor pertanahan khususnya dalam penetapan pemberian Hak Guna Usaha dalam implementasi banyak aturan yang mendasarinya.
Tujuan dari penelitian ini untuk mengetahui pluralisme kebijakan pemerintah dalam penetapan Hak Guna Usaha perkebunan di Indonesia dan permasalahan yang diakibatkan pluralisme kebijakan pemerintah dalam penetapan Hak Guna Usaha dan untuk mengetahui sejauh mana pluralisme kebijakan pemerintah dalam penetapan pemberian Hak Guna Usaha di Indonesia mengakibatkan tumpang tindih Hak Guna Usaha perkebunan dengan sektor lain khususnya perizinan pertambangan, perizinan kehutanan dan tanah ulayat beserta dampaknya.
Hasil dari penelitian ini adalah pluralisme kebijakan pemerintah dalam penetapan Hak Guna Usaha tidak dapat terlepas dari kebijakan pemerintah dalam sektor lainnya yaitu sektor pertambangan dan kehutanan, serta tanah ulayat dan pluralisme kebijakan pemerintah dalam penetapan Hak Guna Usaha tersebut menyebabkan tumpang tindihnya Hak Guna Usaha perkebunan dengan sektor lainnya terutama dengan sektor pertambangan dan kehutanan, serta tumpang tindih dengan tanah ulayat penyelesaiannya tidak mudah karena masing-masing sektor berpegang kepada Undang-Undang sektoralnya dan Undang-Undang sektoral itu sama derajatnya.

This thesis focuses on the Pluralism of Government Policy in the Stipulation of Right of Cultivation (hak guna usaha) for Plantation in Indonesia (Study Case on Overlapping of Mining, Forestry and Communal Rights). The research is legal norm in nature and the data collection to be used shall be conducted through library research with a statue approach. Regulation policy in the land sector, in particular the stipulation of Right of Cultivation (hak guna usaha) in practice is based on many regulations.
The objective of this research is to reveal the pluralism of government policy in the stipulation of right of cultivation (hak guna usaha) for plantation in Indonesia and the problems attributable to pluralism of government policy in the stipulation of right of cultivation (hak guna usaha) and to reveal the extent of pluralism of government policy in the stipulation of right of cultivation (hak guna usaha) in Indonesia causing overlapping of right of cultivation (hak guna usaha) for plantation with other sectors, especially with the mining permit, forestry permit and communal rights along with its effects.
The result of this research reveals that the pluralism of government policy in the stipulation of right of cultivation (hak guna usaha) is closely related to the government’s policies in other sectors, namely the mining, forestry and communal rights sectors and therefore causing overlapping of right of cultivation (hak guna usaha) with other sectors, mainly with mining, forestry and communal rights sectors in which the settlement is not easy as each of those sectors has their own law having equal legal force.

"[ABSTRAK
Risalah Lelang merupakan akta otentik yang membuktikan telah terjadinya lelang
dan berfungsi sebagai alas hak untuk melakukan balik nama, khususnya dalam hal
objek lelang berupa tanah dan bangunan. Seperti halnya akta notaris, Risalah
Lelang dapat dibuat dalam bentuk minuta, salinan dan grosse. Minuta Risalah
Lelang merupakan arsip negara yang wajib disimpan dan dipelihara secara baik
oleh Juru Lelang/Kantor Lelang. Dalam penelitian ini, permasalahan muncul
sebagai dampak dari diterbitkannya surat keterangan sebagai pengganti salinan
Risalah Lelang oleh Kepala Kantor Lelang Negara, yang tidak memiliki minuta.
Mengenai bidang tanah/bangunan yang telah dijual lelang oleh Kantor Lelang
Negara tersebut, bagaimanapun, telah diterbitkan sertipikat Hak Guna Bangunan
atas nama pihak lain oleh Kantor Pertanahan sebagai tindak lanjut dari adanya
ketentuan konversi tanah berdasarkan UUPA. Selain itu, sertipikat Hak Guna
Bangunan tersebut telah pula ditingkatkan menjadi Hak Milik. Penelitian ini
bertujuan untuk mengetahui kesesuaian antara prosedur lelang dan proses
konversi tanah yang telah dilakukan dengan peraturan-peraturan yang berlaku di
bidang hukum lelang dan pertanahan. Penelitian ini menggunakan bentuk yuridis
normatif dengan tipe diagnostik fact-finding. Jenis data yang digunakan adalah
data sekunder yang dianalis secara kualitatif sehingga menghasilkan laporan yang
bersifat diagnostik analisis. Penulis menyimpulkan bahwa lelang yang telah
dilakukan mengandung beberapa cacat prosedur dan surat keterangan sebagai
pengganti salinan Risalah Lelang tersebut tidak dapat diterima sebagai alat bukti
yang sah dan sempurna, namun hanya sebagai bukti permulaan.

becomes the legal basis the transfer of title from a vendor to a purchaser,
particularly in relation to land and builidng. Similiar to a notary deed, The
Auction Deed may be drawn as a minute, an exemplified copy, and an
engrossment. As state archives, the minute of Auction Deeds must be kept and
maintained well by auctioneers. In this research, problems arise as a result of the
issuance of letters of evidence by the Head of State Auction Office as a substitute
for an exemplified copy of an auction deed, that do not has the minute. With
regard to the property sold by the aforementioned State Auction Office, however,
the Land Office has granted Building Rights Certificate under the name of other
people based on the conversion policy of land titles in conformity with the Basic
Agrarian Law (UUPA). Besides, The Building Rights has been increased into the
Ownership (Freehold) Rights. This study aims to examine the suitability of the
auction procedure, conversion of land rights procedure with the auction and land
regulations. The research uses normative juridical with fact-finding diagnostic.
The type of data used are secondary data were analyzed qualitatively so as to
produce a diagnostic report analysis. The writer concluded that there were flaws in
auction procedure and the letters of evidence could not be accepted as perfect and

"Penelitian ini membahas mengenai adanya kekeliruan penerapan hukum hibah wasiat dalam putusan pengadilan. Hal ini mengakibatkan perbedaan pandangan diantara majelis hakim di berbagai tingkat pengadilan mengenai keabsahan akta wasiat. Pewaris dalam kasus ini menghibahwasiatkan harta kekayaannya dalam akta wasiat dengan memberikan sertipikat hak milik objek wasiat kepada penerima hibah wasiat. Sebelum meninggal dunia pewaris menjual objek wasiat kepada pihak lain yang dituangkan dalam akta jual beli menggunakan sertipikat pengganti yang telah diterbitkan. Penerima hibah wasiat mengajukan gugatan pembatalan perjanjian jual beli atas dasar pewaris tidak cakap melakukan perbuatan hukum serta pewaris tidak berhak lagi atas objek wasiat sejak ditandatanganinya akta wasiat. Adapun permasalahan yang diangkat dalam penulisan ini adalah mengenai perbandingan penerapan hukum hibah wasiat oleh institusi pengadilan dan akibat hukum jual beli terhadap akta wasiat. Untuk menjawab permasalahan tersebut digunakan metode penelitian yuridis normatif dengan tipologi penelitian eksplanatoris. Hasil analisis penelitian ini adalah majelis hakim Mahkamah Agung di tingkat peninjauan kembali membatalkan putusan judex facti yang mengesahkan akta wasiat. Peralihan hak melalui jual beli atas objek hibah wasiat merupakan bentuk pencabutan wasiat secara diam-diam yang mengakibatkan akta wasiat menjadi tidak berlaku lagi bagi penerima hibah wasiat sebagaimana diatur Pasal 996 KUHPerdata. Pencabutan akta wasiat melalui jual beli yang dilakukan pewaris dalam keadaan sakit tidak dapat disimpulkan sebagai perjanjian yang cacat hukum. Dengan dibatalkannya akta wasiat, maka akta jual beli berlaku mengikat secara hukum. Saran dari penelitian ini perlunya perbaikan dalam institusi pengadilan dalam memutus perkara tidak hanya secara gramatikal, tetapi memahami maksud dari undang-undang dan pendapat para ahli.

This research discusses the application of the law of wills in court decisions. This resulted in different views among the panel of judges at various levels of the court regarding the validity of the testament. The testator in this case bequest his assets in the testament by giving a certificate of ownership of inheritance object of the will to the legatee of the testament. Prior to death, the testator sells the bequest grant object to another party as stated in the deed of sale and purchase using a substitute certificate that has been issued. The legatee of the testament files a lawsuit for the cancellation of the sale and purchase agreement on the basis that the testator is not capable of carrying out legal actions and the testator is no longer entitled to the object of the will since the signing of the testament. The problems raised in this research are the comparison of the legal application of law of wills by court institutions and the legal consequences of the sale and purchase agreement against the testament. To answer these problems, a normative juridical research method is used, with an explanatory research typology. The results of the analysis of this reseacrh are that the panel of judges of the Supreme Court canceled the judex facti decision that ratified the testament. The transfer of rights through the sale and purchase of the object of a testament is a form of revocation of a testament that results in a testament is no longer valid for the legatee as stipulated in Article 996 of the Civil Code. The revocation of a testament through a sale and purchase carried out by the testator in a sick condition cannot be concluded as a legally flawed agreement. With the cancellation of the testament, the sale and purchase deed is legally binding. The suggestions from this research is that the need for improvements in court institutions in deciding cases not only grammatically, but also understanding the intent of the law and the opinions of experts to provide legal certainty."

"Tujuan penerbitan seritpikat hak milik oleh Badan Pertanahan Nasional seharusnya memberikan pengakuan serta kepastian hukum kepada masyarakat atas kepemilikan tanah. Indonesia menganut sistem publikasi negatif, yang berarti terhadap kedudukan sertipikat dan/atau hak atas tanah masih dapat disangkalkan, Pada praktiknya masih ditemukan permasalahan tanah terkait penerbitan sertipikat, meskipun telah melalui prosedur dan/atau regulasi yang ditetapkan, terhadap proses penerbitan suatu sertipikat tanah juga dapat didasarkan atas akta autentik Pejabat Pembuat Akta Tanah, sebagai penegasan suatu perbuatan hukum terkait peralihan hak atas tanah. Adapun permasalahan yang diangkat dalam penelitian ini adalah mengenai bagaimana terjadinya tumpang tindih sertipikat hak milik yang diterbitkan oleh Badan Pertanahan Nasional, yang dibuat berdasarkan akta jual beli Pejabat Pembuat Akta Tanah; dan Bagaimana kepastian hukum atas diterbitkan sertipikat hak milik yang tumpang tindih oleh Badan Pertanahan Nasional. Untuk menjawab permasalahan tersebut digunakan metode penelitian yuridis normatif dengan tipe penelitian Preskriptif. Hasil analisis adalah belum maksimalnya proses penetapan batas bidang-bidang tanah yang berbatasan oleh Badan Pertanahan Nasional, yang disebabkan karena salah satu pemegang hak atas tanah yang berbatasan tidak menguasai tanah tersebut secara fisik, yang dikemudian hari menyebabkan terjadinya tumpang tindih atas sebagian luas tanah yang dimiliki, dengan tanah yang dimiliki pihak lain, yang juga berlandasakan sertipikat hak milik yang diterbitkan oleh Badan Pertanahan Nasional, sehingga untuk mendapatkan kepastian hukum terhadap sertipikat hak milik yang bertumpang tindih tersebut, ditempuh melalui upaya litigasi, yang kemudian terhadap tanah yang tidak diakui secara hukum, diajukan pembatalan produk hukum melalui Kepala Kantor Pertanahan. Adapun saran yang dapat diberikan yaitu memperkuat peran Badan Pertanahan Nasional dalam penerbitan sertipikat serta dibentuknya bidang atau fungsi khusus dari Badan Pertanahan Nasional yang melakukan pengecekan atau validasi atas proses penerbitan sertipikat hak milik, guna memastikan tanah terbebas dari sengketa.

The purpose of issuing a series of property rights by the National Land Agency should be to provide recognition and legal certainty to the community for land ownership. Indonesia adheres to a negative publication system, which means that the position of certificates and/or land rights can still be denied, In practice there are still land problems related to the issuance of certificates, even though they have gone through established procedures and/or regulations, to the process of issuing a certificate land may also be based on the authentic deed of the Land Deed-Making Officer, as an affirmation of a legal action related to the transfer of land rights. The issues raised in this study are about how there is an overlap of property rights certificates issued by the National Land Agency, which is made based on the deed of sale and purchase of the Land Deed Making Officer; and How is the legal certainty of the issuance of overlapping certificates of property rights by the National Land Agency. To answer these problems, normative juridical research methods with a prescriptive type of research are used. The result of the analysis is that the process of determining the boundaries of adjacent land plots by the National Land Agency has not been maximized, which is caused by one of the rights holders of the adjacent land not physically controlling the land, which in the future causes an overlap of part of the land area owned, with land owned by other parties, which is also based on the certificate of property rights issued by the National Land Agency, so as to obtain legal certainty against the overlapping certificate of property rights, pursued through litigation efforts, which then against land that is not legally recognized, it is proposed that the cancellation of legal products through the Head of the Land Office. The advice that can be given is to strengthen the role of the National Land Agency in issuing certificates and the establishment of a special field or function of the National Land Agency that checks or validates the process of issuing title certificates, in order to ensure that the land is free from disputes.

"Reformasi pertanahan yang diawali dengan disahkannya Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria seharusnya dilaksanakan secara konsekuen dan konsisten sesuai dengan tujuan dan kepentingan rakyat dan Negara. Reformasi tersebut meliputi pelaksanaan pendaftaran tanah, yang bertujuan untuk mendapatkan sertipikat hak atas tanah. Dalam prakteknya kepemilikan sertipikat hak atas tanah yang berlaku sebagai alat pembuktian yang kuat tidak selamanya lepas dari gugatan/klaim dari pihak lain yang menolak kepemilikan sertipikat tersebut. Penulis dalam penelitian ini menemukan sengketa tumpang tindih overlapping bidang tanah yang telah bersertipikat hak milik dengan bekas tanah KINAG. Sengketa semacam ini sering terjadi di masyarakat, sehingga menimbulkan banyak permasalahan. Untuk menjawab permasalahan yang telah dirumuskan, Penulis menggunakan metode penelitian hukum normatif atau penelitian hukum kepustakaan, yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder.
Berdasarkan penelitian ini, Penulis menyimpulkan bahwa Putusan Pengadilan Tata Usaha Negara Bandung Nomor 13/G/2017/PTUN.BDG jo Putusan Pengadilan Tinggi Tata Usaha Negara Jakarta Nomor 327/B/2017/PT.TUN.JKT dalam memutus kasus tumpang tindih overlapping belum sepenuhnya konsisten. Selain itu terhadap pihak yang memiliki sertipikat yang telah dibatalkan dalam putusan tersebut tidak memperoleh perlindungan hukum sebagaimana mestinya karena perolehan tanahnya tidak dengan itikad baik. Sedangkan dipihak pemilik tanah bekas tanah KINAG yang memperoleh dan menguasai tanah dengan itikad baik, memperoleh perlindungan hukum dengan diterbitkannya sertipikat hak atas tanah mereka setelah memenuhi persyaratan-persyaratan yang telah ditentukan dalam peraturan perundang-undangan.

Land reform that begins with the enactment of Law No. 5 of 1960 Concerning Basic Regulations on Agrarian Principles should be implemented consistently in accordance with the goals and interests of the people and the state. Such reforms include the implementation of land registration, which aims to obtain a land title certificate. In practice, ownership of a land titling certificate that is valid as a strong evidentiary instrument is not always free from claims from other parties who reject the ownership of the certificate. The author in this study has found the case of overlapping Freehold Title with ex KINAG land. Such disputes often occur in the community, raises many problems. To find out and learn about the problem, the author has used the method of normative legal research or legal research literature, namely the legal research done by examining library materials or secondary data.
Based on this study, the author has concluded that the Decision of Bandung State Administrative Court Number 13 G 2017 PTUN.BDG jo Decision of the State Administrative High Court of Jakarta Number 327 B 2017 PT.TUN.JKT in deciding overlapping cases has not been fully consistent. Furthermore, the party who has the certificate that has been canceled in the decision does not get the legal protection as it should because the acquisition of the land is not in good faith. In the case of former landowners of KINAG land acquiring and controlling the land in good faith, obtaining legal protection by the issuance of a certificate of title to their land after fulfilling the provisions set out in law.

"Undang Undang Nomor 5 Tahun 1960 tentang Undang Undang Pokok pokok Agraria UUPA bertujuan untuk memberikan jaminan kepastian hukum. Dalam tujuan memberikan jaminan kepastian hukum maka dilaksanakan pendaftaran tanah yang hasil akhir kegiatannya berupa Sertipikat. Pelaksanaan pendaftaran tanah diselenggarakan oleh Badan Pertanahan Nasional BPN /Kantor Pertanahan pada tingkat kota yang memiliki tugas pemerintahan di bidang pertanahan. Sertipikat merupakan bentuk keputusan yang bersifat beschikking yang diterbitkan oleh Kepala Kantor Pertanahan sebagai Pejabat Tata Usaha Negara yang berfungsi sebagai alat pembuktian yang kuat. Dalam Pendaftaran di Propinsi Riau khususnya Kota Pekanbaru dikenal alat bukti bawah tangan berupa alas hak Surat Keterangan Ganti Rugi SKGR yang merupakan bukti peralihan hak bagi pemegangnya.
Masalah yang sering terjadi dalam pendaftaran tanah berupa tumpang tindih antara alas hak atas tanah dan Sertipikat dimana dalam penerbitannya terdapat cacat administrasi seperti permasalahan yang diangkat dimana terhadap tanah dengan alas hak Surat Keterangan Ganti Rugi SKGR diatasnya terbit Sertipikat Hak Milik Nomor 566/Desa Umban Sari seluas 17.000 m yang dikeluarkan Kantor Pertanahan Kota Pekanbaru. Permasalahan penulis meneliti masalah tersebut dengan menggunakan metode penelitian yang bersifat yuridis normatif dengan cara studi kepustakaan. sengketa dapat dilihat dari peran tugas dan fungsi dari Badan Pertanahan Nasional BPN serta penyelesaian sengketa administratif pertanahan. Penerbitan sertipikat yang tidak sesuai dengan prosedur yang cermat dan teliti mengakibatkan cacat administrasi dalam penerbitan Sertipikat, yang menyebabkan pembatalan penerbitan sertipikat yang bersangkutan.

Law Number 5 of 1960 regarding the Agrarian Law UUPA aimed at providing legal certainty guarantee. In a purpose to provide the legal certainty guarantee then the land registrasion is performed which its activity final result is in form of a Certificate. Implementation of the land registrasion is performed by the Badan Pertanahan Nasional BPN Head of Land Office on city level having governmnetal duties in land affairs. The certificate represents a form of decision beschikking in nature issued by Land Office as the Official of the State Administration serving as a solid evidence. In the Registration in Riau Province, particularly Pekanbaru Municipality known as a privately made evidence known as privately made evidence in form of the base of right of Surat Keterangan Ganti Rugi SKGR which represents an evidence of transfer of right for its bearers.
The issues is frequently happened in the land registration in form of overlapping between the base of right on land and Certificate where in its issuence there is an administrative defect such as issues raised where toward the land with base of right of Surat Keterangan Ganti Rugi SKGR upon it Property Certificate Right Number 566 Desa Umban Sari was issued of area 17.000 m issued by the Land Office Pekanbaru. The problem dealt by the author in examining the isuse by using reserach method which is normative juridical by library reserach. Dispute can be seen from the role of duties and function of the Badan Pertanahan Nasional BPN and the settlement of land administrative disputes. The issuance of certificate whic is not in compliance with the thorough and careful procedure resulting in the administrative defect in the issuance of Certificate, leading to the cancellation in the issurance of the certificate concerned.
