Every year, the state has suffered a loss in the amount of 40 billion rupiah in tax because of the piracy. Due to the economic growth and the buying power the people, approximately 40 million cassettes and CDs are absorbed by the market every month. But of the above mentioned number, only 2 million of cassettes as well as CDs are produced byt he official producers, whereas the rest totaling 38 million cassettes and CDs are supplied by the pirates."

"Musik merupakan suatu karya cipta yang membutuhkan imajinasi, tenaga, ketrampilan, waktu dan biaya untuk menciptakannya. Dengan kemajuan ilmu pengetahuan dan teknologi yang semakin maju telah memungkinkan para pelaku tindak pidana di bidang hak cipta untuk melakukan tindakan pidana, khususnya di bidang perekaman. Hasil rekaman yang berupa karya audio visual dijual secara bebas dan dengan harga yang murah. Tindakan seperti itu telah merugikan para pelaku, produser rekaman suara dan lembaga penyiaran dalam suatu pertunjukan musik. Undang-Undang No. 19 tahun 2002 tentang Hak Cipta belum membawa dampak positif terhadap perlindungan hak cipta karena terbukti bahwa tingkat pembajakan terhadap karya audio visual yang berupa DVD dan VCD musik bajakan semakin menigkat setiap tahunnya. Oleh karena itu dibutuhkan perlindungan yang mengatur secara tegas mengenai hal ini. Penelitian ini menggunakan penelitian yuridis normatif. Hasil penelitian menyarankan sebaiknya diadakan penyuluhan hukum mengenai hak cipta kepada masyarakat, termasuk juga aparat penegak hukumnya; agar karya hak cipta audio visual tidak mudah dibajak, maka setiap keping yang akan diedarkan ataupun dipasarkan, harus ditempelkan sticker PPN dari Direktorat Pajak, yang sebelumnya harus mendapatkan rekomendasi dari ASIRI. Pemberian rekomendasi ini harus diperketat; diperlukan juga adanya kerja sama yang terkoordinasi lebih baik antara sesama aparat penegak hukum dalam menangani pelanggaran hak cipta, khususnya sesama penyidik.

Music is copyrighted work which requires imagination, energy, skill, time and cost. With the progress of science and technology have enabled the perpetrators of criminal offenses in the field of copyright for commiting a crime, especially in the field of recording. The results were videotaped in the form of audio visual works and sold freely at a cheap price. That action have been detrimental the actors, producers of phonograms and broadcasting organizations in musical performance. Indonesian copyright law has not brought positive impact yet on copyright protection because it proves that the level of piracy of audio visual works, such as music DVD and VCD, is increasing every year. Therefore needed protection expressly set against copyright infringement. This research is normative juridical.

The researcher suggest that should be held the information on the law concerning to the community, including the officers; for audio visual copyrighted works are not easily hijacked, then each piece to be distributed, should pasted VAT (Value Added Tax) stickers from the Directorate Tax, which previously had to get recommendation from ASIRI. The provision of this recommendation should be thightened; this also requires the presence of better coordinated cooperation among the law enforcement officers in dealing with copyright violations, especially for fellow investigators."
