"Tujuan penelitian ini adalah untuk mengetahui hubungan antara Shari'a Governance Structures dengan tingkat pengungkapan Corporate Social Responsibility pada perbankan syariah di Indonesia. Faktor-faktor terkait Shari'a Governance Structures yang diuji dalam penelitian ini adalah mekanisme pengawasan dan struktur kepemilikan. Mekanisme pengawasan diwakili oleh proxy keberadaan Dewan Pengawas Syariah yang diukur menggunakan Islamic Governance Score (IG-Score). Sementara struktur kepemilikan diukur menggunakan rasio dana pihak ketiga (investment account holders) dan ukuran perusahaan. Selain itu, penelitian ini juga menganalisis seberapa besar dominasi laporan sumber dan penggunaan dana zakat serta dominasi laporan sumber dan penggunaan dana kebajikan terhadap tingkat pengungkapan CSR secara keseluruhan. Hasil penelitian ini menunjukkan bahwa investment account holders (IAH) dan ukuran perusahaan memiliki hubungan positif dan signifikan terhadap tingkat pengungkapan CSR. Namun, keberadaan Dewan Pengawas Syariah (DPS) tidak memiliki hubungan yang signifikan terhadap tingkat Pengungkapan CSR pada perbankan syariah di Indonesia.

The purpose of this study was determine the correlations between Shari'a Governance Structures against Corporate Social Responsibility disclosure in Islamic Banking in Indonesia. The factors related to Shari?a Governance Structures tested in this study is monitoring mechanisms, ownership structures, and firm size. Monitoring mechanism represented by proxy the existence of Sharia Supervisory Board is measured using Islamic Governance Score (IG-Score). While the ownership structures measured using the ratio of investment account funds (investment account holders) and firm size measured by natural log of book value of assets. In addition, this study also analyzed how much domination of the sources and uses zakah funds reporting and the domination of the sources and uses qardhul hasan funds reporting of the overall CSR disclosure. These results indicate that the investment account holders (IAH) and firm size has a positive and significant relationship to the level of CSR disclosure. However, the existence of the Sharia Supervisory Board (SSB) has no significant correlations to the level of CSR disclosure in Islamic Banking in Indonesia."

"ABSTRAKPenelitian berbentuk skripsi ini membahas tentang fatwa yang dikeluarkan oleh Majelis Ulama Indonesia MUI terkait mazhab Syiah. Penelitian ini menggunakan teori maq??id syar? lsquo;ah yang dirumuskan oleh Jasser Auda dalam mengupas permaslahan yang ada pada fatwa MUI tentang Syiah. Maq??id syar? lsquo;ah yang dirumuskan oleh Jasser Auda bukanlah sebuah hal yang baru. Jasser Auda melakukan rekonstruksi terhadap maq??id syar? lsquo;ah melalui integrasi antara ushul fiqh dengan teori sistem. Rekonstruksi itu kemudian menghasilkan enam prinsip yang harus diperhatikan agar hukum Islam dapat menekankan sisi maq??id syar? lsquo;ah. Enam prinsip tersebut adalah watak kognitif, holisme, keterbukaan, hierarki saling terkait, multidimensional dan kebermaksudan. Telaah melalui maq??id syar? lsquo;ah menunjukkan bahwa permasalahan fatwa MUI tentang Syiah terdapat pada tahap epistemologi. Epistemologi yang dimaksud berkaitan dengan dasar penetapan fatwa MUI, yaitu sumber hukum dan metode penetapan fatwa. Permasalahan tersebut adalah MUI cenderung menggunakan sudut pandang yang bersifat mazhab-sentris, yaitu sudut pandang yang hanya mengacu pada satu mazhab tertentu. Hasil dari penelitian ini menunjukkan bahwa maq??id syar? lsquo;ah tidak hanya berperan dalam menelaah, melainkan juga berperan dalam merekonstruksi dasar penetapan fatwa MUI tentang Syiah.

ABSTRACTThis research discusses about the fatwa about Shia issued by Indonesian Jurists Council MUI . This study uses maq id syar 39 ah theory formulated by Jasser Auda in exploring the existing problems in the MUI fatwa on Shia. Maq id syar 39 ah formulated by Jasser Auda is not a new thing. Jasser Auda reconstructed maq id syar 39 ah through integration between ushul fiqh and system theory. The reconstruction then produces six principles that must be observed so that Islamic law can emphasize the maq id syar 39 ah. The six principles are cognitive, wholeness, openness, interrelated hierarchy, multidimensional and purposefulness. Studies through maq id syar 39 ah show that the MUI fatwa issue concerning Shias is at the epistemological stage. Epistemology is concerned with the basic determination of MUI fatwa, namely the legal sources and methods of fatwa determination. The problem is that MUI tends to use a school centric perspective, ie a point of view that only refers to a particular school. The results of this study indicate that maq id syar 39 ah not only plays a role in studying, but also play a role in reconstructing the basic determination of MUI fatwa about Shia."
