"Tesis ini membahas mengenai program penjaminan polis asuransi di Indonesia berdasarkan Undang-Undang Nomor 4 Tahun 2023 tentang Pengembangan dan Penguatan Sektor Keuangan (“UU P2SK”) yang memberikan mandat baru bagi Lembaga Penjamin Simpanan (“LPS”) sebagai Lembaga Penjamin Polis dalam rangka program penjaminan polis. Penelitian ini akan menggali beberapa aspek terkait penjaminan polis sebagai upaya memberikan pelindungan hukum bagi para pemegang polis yang akan efektif pada tahun 2028, dengan membandingkannya dengan penyelenggaraan penjaminan polis di Malaysia dan Singapura. Penelitian ini merupakan penelitian hukum doktrinal. Sumber data yang digunakan untuk menganalisis permasalahan dalam penelitian ini berupa sumber data sekunder yang diperoleh melalui hasil penelaahan kepustakaan dan/atau bahan literatur lainnya yang berkaitan dengan topik penelitian. Hasil dari penelitian ini adalah dalam upaya memberikan pelindungan kepada para pemegang polis, skema penjaminan polis oleh LPS menggunakan metode resolusi Refund Premium dan Payment Claims, Run-off, Likuidasi, dan Bridge Institution terhadap perusaahaan asuransi dan asuransi syariah yang dicabut izin usahanya oleh Otoritas Jasa Keuangan. Selain itu, skema penjaminan polis di Indonesia dapat mengambil inspirasi dari negara tetangga terdekat seperti Malaysia dan Singapura terkait pendanaan lembaga dari iuran awal dan berkala, dasar pengenaan tarif premi berdasarkan risiko, cakupan penjaminan terhadap jenis dan lini usaha perasuransian, nilai maksimal agregat penjaminan, dan lain-lain
This thesis discusses the insurance guarantee scheme programs in Indonesia based on Law number 4 of 2023 concerning the Development and Strengthening of the Financial Sector (“P2SK Law”) which provides a new mandate for Indonesia Insurance Deposit Corporation (“LPS”) as a Indonesia Insurance Guarantee Schemes in order to organize a insurance guarantee schemes program. This research will explore several aspects related to the insurance guarantee schemes program as an effort to provide legal protection for the policy holders which will be effective in 2028, by comparing with the implementation of insurance guarantee scheme in Malaysia and Singapore. This thesis uses doctrinal legal research methods. The data sources which used to analyze the problems in this research are secondary data sources obtained through literature reviews and/or other literature materials that necesarry. The results of this research are that in an effort to provide protection to policy holders, the insurance guarantee scheme by LPS uses resolution methods such as: Refund Premium and Payment Claims, Run-off, Liquidation and Bridge Institution for insurers and Sharia insurers that its license have been revoked by the Indonesia Financial Services Authority. The insurance guarantee scheme in Indonesia could take inspiration from any nearby countries such as Malaysia and Singapore regarding institutional funding by annual and periodic levies, the calcuation premium rates based on risk, coverage of insurance guarantee scheme, maximum aggregate value of guarantees, and etc."

"Salah satu tujuan utama dari hukum asuransi adalah untuk melindungi pemegang polis dari kegagalan bisnis asuransi. Untuk mencapai tujuan ini, sejumlah prosedur legislatif dan pengawasan sering diterapkan untuk mengamankan dan melindungi hak-hak pemegang polis jika terjadi kegagalan perusahaan asuransi. Skripsi ini membahas tentang lembaga perlindungan pemegang polis asuransi sebagai perlindungan bagi nasabah perusahaan asuransi. Lembaga perlindungan pemegang polis berfungsi untuk melindungi kepentingan pemegang polis jika perusahaan asuransi gagal membayar, namun di Indonesia hingga saat ini lembaga tersebut belum terbentuk meskipun telah diamanatkan oleh Undang-Undang Perasuransian. Berdasarkan hal tersebut, pertama-tama penulis akan mengkaji tentang perlindungan pemegang polis sebagaimana diatur dalam Undang-Undang Nomor 40 Tahun 2014 tentang Perasuransian di Indonesia, diikuti dengan peraturan perundang-undangan di Republik Korea. Tesis ini menggunakan metode penelitian yuridis-normatif dimana sepanjang penelitian ini, penulis telah melihat hasil bahwa Korea telah memberlakukan Depositor Protection Act dan membentuk Korea Deposit Insurance Corporation. Sebaliknya, program penjaminan penjaminan yang ditentukan oleh Undang-Undang Perasuransian Indonesia seharusnya sudah terbentuk paling lambat 3 (tiga) tahun sejak ditetapkan, artinya harus sudah dibentuk paling lambat tanggal 17 Oktober 2017, meskipun demikian, belum terbentuk lembaga tersebut.
One of the primary aims of insurance regulation is to protect policyholders from the failure of insurance businesses. To achieve this purpose, a number of legislative and supervisory procedures are frequently implemented in order to secure and protect policyholder rights in the event of an insurance company's failure. This thesis discusses the insurance policyholder protection institution as protection for insurance company policyholders. In the context of protection of policyholders, the policyholder protection institution functions to protect the interests of policyholders if the insurance company fails to pay, however, in Indonesia until now this institution has not been established even though it has been mandated by the Insurance Law. Based on this, first of all the writer will examine the provisions of protection for the insured and the policy holder as regulated in Law No. 40 of 2014 concerning insurance in Indonesia, followed by the legal and regulations in the Republic of Korea. This thesis research uses a juridical-normative research method with a statutory and analytical approach. Throughout this research, the author has reached a result that Korea has enacted the Depositor Protection Act and established a depositor protection scheme, the Korea Deposit Insurance Corporation (KDIC) that can raise additional funds by issuing bonds and borrowing from a variety of sources. On the other hand, the insurance guarantee program specified by the Indonesian Insurance Law should have been formed no later than 3 (three) years after its adoption, meaning it should have been formed no later than October 17, 2017. If the Indonesia Deposit Insurance Corporation intends to increase its role as a policy guarantor, there is currently no legal framework in place."

"Skripsi ini membahas mengenai tata kelola dana jaminan perusahaan asuransi milik PT. Asuransi Jiwa Namura Tata Life sebagai jaminan terakhir untuk perlindungan kepentingan pemegang polis dimana dalam hal ini PT. Asuransi Jiwa Namura Tata Life telah mencairkan dana jaminan perusahaannya bahkan sebelum diputuskan pailit oleh Pengadilan Niaga. Penelitian ini berbentuk yuridisnormatif dengan tipologi penelitian deskriptif analitis. Kemudian berdasarkan hasil analisis, penulis memperoleh kesimpulan bahwa dana jaminan tidak serta merta menjadi jaminan pasti dalam rangka melindungi kepentingan pemegang polis dalam suatu perusahaan asuransi jika suatu perusahaan asuransi tersebut dipailitkan/dilikuidasi.
This thesis mainly focused on the governance of the guarantee fund owned by the insurance company PT. Namura Tata Life Indoensia as last guarantee for the protection of interests of policyholders which in this case PT. Namura Tata Life Insurance has withdraw its guarantee fund even before it was decided bankrupt by the Commercial Court. This research form is juridical-normative research with descriptive analytical typology form. Then based on the analysis, the authors came to the conclusion that the guarantee fund does not necessarily become a firm guarantee in order to protect the interests of policyholders in an insurance company if an insurance company bankrupt/liquidated."

"Skripsi ini membahas mengenai lembaga penjamin pemegang polis asuransi sebagai perlindungan bagi nasabah perusahaan asuransi. dalam rangka perlindungan terhadap pemegang polis, lembaga penjamin pemegang polis berfungsi melindungi kepentingan pemegang polis apabila perusahaan asuransi mengalami kegagalan bayar, meskipun demikian, di Indonesia sampai sekarang belum dibentuk lembaga yang dimaksud meski sudah diamanatkan Undang-Undang Perasuransian. Berdasarkan hal tersebut, pertama-tama penulis akan meneliti bagaimanakah perbandingan ketentuan perlindungan terhadap tertanggung dan pemegang polis yang diatur dalam Undang-Undang No.2 Tahun 1992 tentang Usaha Perasuransian dengan Undang-Undang No 40 Tahun 2014 tentang perasuransian. kemudian juga bagaimanakah lembaga penjamin pemegang polis di Singapura yang telah menjalankan program penjaminan polis seperti yang diamanatkan oleh Pasal 53 UU No. 40 Tahun 2014 tentang Perasuransian.
Penelitian skripsi ini menggunakan metode penelitian yuridis-nomatif dengan pendekatan perundang-undangan, konsep, dan analisis. Hasil penelitian yang didapatkan adalah mekanisme perlindungan pemegang polis antara UU No. 2 Tahun 1992 dengan UU No.40 Tahun 2014 tidak memiliki perbedaan jauh. Hanya terdapat perbedaan dalam hal nomenklatur dan persyaratan formil saja. Kemudian di Singapura lembaga penjamin pemegang polis terlembaga menyatu dengan lembaga penjamin simpanan dengan nama Singapore Deposit Insurance Corporation dengan membentuk PPF Life Fund dan PPF General Fund untuk melindungi pemegang polis.
This thesis discusses policyholder deposit insurance corporation for protection of insurance company customers. in regards to protect the policyholder, policyholder deposit insurance corporation serves to protect the interests of the policyholder if the insurance company fails to pay. however, Indonesia has not been establish institution that previously mentioned despite Insurance Law have already mandated. Based on this, first the author will examine how the comparison of provisions of protection against the insured and policyholders between which set in Law No.2 of 1992 with Law No. 40 of 2014. Second, how institution of policyholder protection in Singapore who has run the policy guarantee program just as mandated by Article 53 of Law no. 40 Year 2014. This thesis research using juridical normative research method with approach of legislation, concept, and analysis. The result of this research is protection mechanism of policy holder between Law no. 2 of 1992 with Law No.40 of 2014 does not have much difference. The differences only in nomenclature and formal requirements. Then in Singapore the institutional policy guarantor institution integrates with the deposit insurance agency under the name Singapore Deposit Insurance Corporation by establishing PPF Life Fund and PPF General Fund to protect policyholders."

"Tesis ini membahas program penjaminan polis asuransi berdasarkan peraturan perundang-undangan perasuransian dan Undang-Undang No. 4 Tahun 2023 tentang Pengembangan dan Penguatan Sektor Keuangan (“UU P2SK”) yang telah memberikan fungsi baru untuk melakukan penjaminan polis nasabah asuransi, yang harus dilaksanakan oleh Lembaga Penjamin Simpanan dalam jangka waktu 5 (lima) tahun sejak diundangkan. Permasalahan yang dibahas dalam Tesis ini adalah bagaimana pengaturan program penjaminan polis asuransi dalam peraturan perundang-undangan perasuransian dan UU P2SK serta bagaimana kesiapan Lembaga Penjamin Simpanan untuk melaksanakan fungsi program penjaminan polis asuransi. Metode penelitian yang digunakan adalah yuridis-normatif dengan bahan hukum primer dan sekunder, dengan teknik pengumpulan data melalui studi kepustakaan dan wawancara dengan analisis data secara kualitatif. Berdasarkan hasil penelitian, diperoleh kesimpulan bahwa sebelum diterbitkannya UU P2SK, pengaturan terkait program penjaminan polis hanya diatur secara singkat berdasarkan Undang-Undang No. 40 Tahun 2014 tentang Perasuransian dalam Pasal 53 ayat (1) sampai ayat (4), namun semenjak diundangkannya UU P2SK, pengaturan program penjaminan polis menjadi semakin lengkap. Kesimpulan lain adalah Lembaga Penjamin Simpanan telah melaksanakan persiapan program penjaminan polis yaitu menyusun roadmap yang memuat hal-hal yang harus dilaksanakan dengan target pelaksanaan dibagi per-tahun; melakukan beanchmark atau studi banding ke negara- negara lain yang telah memiliki lembaga penjamin polisnya sendiri; merancang RPP Program Penjaminan Polis, RPLPS tentang Pelaporan Perusahaan Asuransi, RPLPS tentang Penjaminan Polis Asuransi, dan RPLPS tentang Likuidasi Perusahaan Asuransi untuk selanjutnya akan diterbitkan di awal tahun 2024; melakukan pembentukan grup untuk menangani pelaksanaan program penjaminan polis; melakukan penyesuaian susunan dewan komisioner; dan melakukan program rekrutmen pegawai yang terdiri atas penerimaan lulusan baru dan penerimaan pegawai yang telah memiliki pengalaman kerja minimal 5 (lima) tahun. Saran yang dapat diberikan dalam penelitian ini adalah agar partisipasi dari ahli-ahli di bidang perasuransian dapat ditingkatkan dalam internal Lembaga Penjamin Simpanan melalui pelaksanaan rekrutmen terbuka agar pelaksanaan program penjaminan polis ditangani oleh individu-individu yang berpengetahuan baik di bidang perasuransian. Saran lainnya yakni agar persiapan yang dilaksanakan oleh Lembaga Penjamin Simpanan diawasi dengan baik oleh Otoritas Jasa Keuangan selaku lembaga yang mempunyai fungsi, tugas, dan wewenang pengawasan terhadap lembaga- lembaga keuangan termasuk perasuransian.
This thesis discusses the insurance policy guarantee program based on insurance laws and regulations and Law no. 4 of 2023 concerning the Development and Strengthening of the Financial Sector ("P2SK Law") which has provided a new function for underwriting insurance customer policies, which must be implemented by the Deposit Insurance Corporation within a period of 5 (five) years from its promulgation. The problems discussed in this thesis are how the insurance policy guarantee program is regulated in insurance laws and regulations and the P2SK Law and how prepared the Deposit Insurance Agency is to carry out the function of the insurance policy guarantee program as regulated in the P2SK Law. The research method used is juridical-normative using primary and secondary legal materials, with data collection techniques through literature study and interviews with qualitative data analysis. Based on the research results, it was concluded that before the issuance of the P2SK Law, regulations related to policy guarantee programs were only briefly regulated based on Law no. 40 of 2014 concerning Insurance in Article 53 paragraph (1) to paragraph (4), but since the promulgation of the P2SK Law, the regulation of policy guarantee programs has become more complete. Another conclusion is that the Deposit Insurance Corporation has carried out preparations for a policy guarantee program, namely preparing a roadmap containing things that must be implemented with implementation targets divided per year; carry out benchmarking or comparative studies to other countries that have their own policy insurance institutions; draft RPP Policy Guarantee Program, RPLPS concerning Insurance Company Reporting, RPLPS concerning Insurance Policy Guarantee, and RPLPS concerning Liquidation of Insurance Companies to be subsequently issued in early 2024; establishing a group to handle the implementation of the policy guarantee program; make adjustments to the composition of the board of commissioners; and carrying out an employee recruitment program consisting of accepting new graduates and recruiting employees who have a minimum of 5 (five) years of work experience. Suggestions that can be given in this research are that the participation of experts in the insurance sector can be increased internally at the Deposit Insurance Agency through open recruitment so that the implementation of the policy guarantee program is handled by individuals who have good knowledge in the insurance sector. Another suggestion is that the preparations carried out by the Deposit Insurance Agency be properly supervised by the Financial Services Authority as an institution that has functions, duties and supervisory authority over financial institutions including insurance."

"Tesis ini membahas mengenai Lembaga Penjaminan Polis Asuransi sebagai perlindungan hukum atas pemegang polis dalam kondisi gagal bayar perusahaan asuransi (mengacu pada Best Practice di Jepang Dan Inggris). Penelitian ini menggunakan metode yuridis-normatif dimana data penelitian sebagian besar berasal dari studi kepustakaan. Hasil penelitian ini adalah 1) Lembaga Penjaminan polis Asuransi Jiwa di Jepang dan di Inggris dapat memberikan perlindungan hukum atas hak pemegang polis dalam kondisi gagal bayar perusahaan asuransi melalui lembaga masing-masing LIPPCJ dan FSCS. 2) Urgensi pembentukan Lembaga Penjaminan Polis Asuransi untuk memberikan kepastian hukum bilamana terjadi kondisi gagal bayar Perusahaan Asuransi. 3) Pembentukan Lembaga Penjaminan Polis di Indonesia sangat bermanfaat untuk melindungi Pemegang Polis dan akan meningkatkan kepercayaan masyarakat terhadap industri perasuransian. Penulis memberikan saran Lembaga Penjaminan Polis di Indonesia sebagai Lembaga Independen yang mempunyai mekanisme kelembagaan tersendiri dan mengikutsertakan produk asuransi yang memiliki risiko gagal bayar paling utama yaitu Asuransi Umum dan Asuransi Jiwa.
This thesis discusses the Insurance Policy Guarantee Corporation as legal protection for policyholders in state of Insurance Company Default (referring to Best Practice in Japan and UK). This research uses the juridical-normative method, where the research data mostly comes from literature studies. The results of this study are 1) Life Insurance Policy Guarantee Corporations in Japan and the UK can provide legal protection for the rights of policyholders in the state of insurance company default through their respective institutions, LIPPCJ and FSCS. 2) The urgency of establishing an Insurance Policy Guarantee Corporation to provide legal certainty in state of Insurance Company Failure to pay. 3) The establishment of a Insurance Policy Guarantee Corporation in Indonesia is very beneficial to protect policyholders. It will increase public confidence in the insurance industry. The author suggests that the Policy Guarantee Corporation in Indonesia is possible as an independent institution which has independent institutional mechanism and includes all insurance products that have main risk of default namely General Insurance and Life Insurance."

"Hadirnya Corona Virus Disease 2019 (COVID-19), yang telah ditetapkan sebagai pandemi oleh World Health Organization, menimbulkan adanya penurunan pertumbuhan ekonomi dianggap perlu untuk dilakukan mitigasi oleh Pemerintah dan Komite Stabilitas Sistem Keuangan (KSSK) dengan tujuan untuk menjaga stabilitas sistem keuangan. Dengan itu, KSSK diberikan penguatan kewenangan yang ditetapkan dalam UU No. 2 Tahun 2020. Dalam rangka untuk mendukung pelaksanaan kewenangan KSSK menangani permasalahan stabilitas sistem keuangan, kewenangan dari anggota KSSK juga diperkuat dalam undang-undang tersebut, salah satunya adalah Lembaga Penjamin Simpanan (LPS). Metode penelitian penulisan skripsi ini adalah yuridis-normatif dan menggunakan data sekunder, yaitu bahan hukum primer dan sekunder, dan yang didukung dengan wawancara. Hasil penelitian menunjukkan bahwa kewenangan LPS yang diperkuat adalah LPS dapat meningkatkan intensitas bersama dengan OJK, melakukan beberapa tindakan untuk memenuhi likuiditas dalam penanganan bank, penyelamatan bank selain bank sistemik, dan merumuskan dan melaksanakan kebijakan penjaminan. Namun, dengan adanya penguatan kewenangan LPS tersebut ditemukan adanya beberapa permasalahan hukum, yang salah satunya adalah permasalahan terhadap kewenangan LPS untuk menempatkan dana di bank, perlunya kewenangan LPS untuk dapat mengakses data bank setiap saat, dan potensi moral hazard. Penelitian ini diharapkan dapat memberikan informasi baru serta memberikan masukan untuk menguatkan kewenangan LPS dalam melakukan akses data dan/atau informasi Bank dan menentukan batas waktu yang jelas terhadap keberlakuan kewenangan LPS untuk melakukan penempatan dana.
Corona Virus Disease 2019 (COVID-19), which has been declared as a pandemic by the World Health Organization, causes the decline in economic growth is considered necessary for mitigation by the Government and the Financial System Stability Committee (FSSF) with the aim of maintaining the stability of the financial system. Therefore, the FSSF was given authorities stipulated in Law No. 2 of 2020. In order to support the implementation of FSSF's authority to handle the stability issues of the financial system, the authority of FSSF members is also strengthened by the law, one of them is the Indonesia Deposit Insurance Corporation (IDIC). The method used in this research is a juridical-normative method with using secondary data that include primary and secondary legal material, also supported with interview. This research finds that the aforementioned IDIC's authorities are IDIC can improve the preparations and intensify the preparations with Financial Services Authority, initiate actions to manage and/or increase IDIC liquidity, make loans for other parties, and apply for a loan to the government. However, with the strengthening of IDIC’s authority, there are several legal problems that arise, such as issues regarding the fund placement, the need for IDIC to be able to access bank’s data at any time, and the possibilities of moral hazard. This thesis is aimed to provide new information and suggestions to strengthen IDIC's authority over accessing data and/or information of banks and determining the clear headline of the IDIC's enforceability of fund placement."

"Penelitian ini membahas mengenai pengaruh program penjaminan simpanan (deposit insurance) oleh LPS terhadap disiplin pasar dengan menggunakan data time series dari 120 bank umum selama kurun waktu Januari 2003 sampai dengan Desember 2013. Dengan menggunakan empat variasi yang menjadi variabel terikat berupa tingkat suku bunga deposito 1 bulan/TD, tingkat suku bunga deposito 3 bulan/TD3, tingkat suku bunga deposito rata-rata 1 dan 3 bulan/MRATE, dan Interbank Call Money, serta dengan variabel bebas berupa : (i) variabel risiko bank yang terdiri dari : NPL, LDR, BOPO, ROA, dan CAR; (ii) variabel kontrol yang terdiri dari Growth GDP dan Inflasi; dan (iii) variabel dummy, diperoleh hasil penelitian Kebijakan program penjaminan simpanan LPS yang di-proxy oleh dummy, efektif menekan tingkat bunga pada lag 4 periode. Dengan kata lain, kebijakan LPS pada saat ini membutuhkan masa tenggang waktu yang relatif lama yaitu 4 triwulan untuk dapat berpengaruh pada kedisplinan pasar.
This research explain about The Impact Analysis of Deposit Insurance Program by The Indonesia Deposit Insurance Corporation to Market Dicipline using the time series data from 120 banks from January 2003 to December 2013. I use Ordinary Least Squares/OLS method with four variations of dependent variables (time deposit rate 1 month, 3 months, average rate in 1 month and 3 months, and interbank call money), as well as the independent variable such as: (i) the bank's risk variables consisting of: NPL, LDR, ROA, ROA, and the CAR Ratios; (ii) the control variables consisting of GDP Growth and Inflation; and (iii) a dummy variable, the result of this research is deposit insurance program by IDIC with proxy by dummy, effectively reduces the interest rate on the lag 4 period. In other words, the policy of IDIC during the grace period requires a relatively long time, that is 4 quarters, to be able to influence the market discipline."

Krisis ekonomi global pada tahun 2008 mengharuskan LPS meningkatkan Nilai Penjamin Simpanan. Penelitian ini bertujuan untuk mengetahui alasan LPS meningkatkan Nilai Penjamin Simpanan berdasarkan Undang-Undang Nomor 24 Tahun 2004 Tentang Lembaga Penjamin Simpanan sebagaimana telah diubah dengan Undang-Undang No. 7 Tahun 2009 dan peraturan perundang-undangan yang berlaku, menganalisis kemungkinan penurunan Nilai Penjamin Simpanan LPS serta hubungannya dengan penerapan risk-based premium di Indonesia untuk menjaga stabilitas sistem keuangan Indonesia. Penelitian ini merupakan penelitian kepustakaan yang bersifat yuridis-normatif. Data yang dikumpulkan dengan studi kepustakaan. Hasil dari penelitian ini adalah berdasarkan Pasal 11 UU LPS dimungkinkan terjadi penurunan terhadap Nilai Penjamin Simpanan LPS. Berdasarkan alasan peningkatan Nilai Penjamin Simpanan pada tahun 2008, yaitu adanya ancaman krisis ekonomi, UU LPS mengatur apabila alasan tersebut telah teratasi maka besaran Nilai Penjamin Simpanan dapat disesuaikan kembali. Maka berdasarkan hal ini, dimungkinkan untuk menurunkan Nilai Penjamin Simpanan LPS.
As one of the important elements in the financial safety net, especially in banking system, Indonesia Deposit Insurance Corporation (IDIC) has a big role to keep the stability of Indonesia?s financial system. The global economic crisis in 2008 requires IDIC increase the Deposit Insurance Coverage. This studies aims to determine the reaseon IDIC increase the coverage based on Law No. 24 of 2004 on the Indonesia Deposit Insurance Corporation (IDIC) as amended by Act No. 7 of 2009, to analyze the possibility to decrease the deposit insurance coverage and its relation to the risk-based premium in Indonesia in order to maintan the stability of the financial system. This research is a normative juridical research. The data were collected by literature study. The results for this study are based Article 11 of IDIC Act, there is a posibility to adjust the Deposit Insurance Coverage. IDIC increased the coverage in 2008 because there is a threat of an economic crisis.
