"Pada tahun 2013, terdapat sebuah kasus mengenai mekanisme pengangkatan hakim konstitusi oleh Presiden. Penelitian ini bertujuan untuk menganalisa peraturan perundang-undangan yang paling sesuai dengan Pasal 24C UUD 1945, serta mekanisme pengangkatan hakim konstitusi yang secara praktik dapat diterapkan di Indonesia. Metode yang dilakukan dalam penelitian ini adalah studi pustaka yang dilengkapi dengan wawancara terhadap narasumber. Berdasarkan penelitian ini, dapat diketahui bahwa peraturan perundang-undangan yang sesuai dengan Pasal 24C UUD 1945 adalah UU Nomor 24 Tahun 2003 dan UU Nomor 8 Tahun 2011. Sifat transparan dan partisipatif juga sangat menentukan mekanisme pengangkatan hakim konstitusi yang diterima di masyarakat Indonesia.

In 2013, there is a case regarding the constitutional judges appointing mechanism by the President of Indonesia. This research is focused on analyzing the regulations according to Article 24C Constitution of Indonesia, and the most applicable mechanism on appointing a constitutional judge. The method that is used for this research are literature studies and interview with the informants. Through this research, it can be ascertained that regulations according to Article 24C Constitution of Indonesia are Law Number 24 Year 2003 and Law Number 8 Year 2011. Transparancy and participative mechanism are needed to be applied on appointing constitutional judge that can be accepted by the citizens of Indonesia.

"The concepts and values that underpin traditional constitutionalism are increasingly being challenged by political realities that place substantial power beyond the state. Among the few certainties of a global economy is the growing incongruity between the political (the world of things that need to be ordered collectively in order to sustain society) and the state (the major institution of authoritative political decision-making during modern times). The consequences, and possible remedies, of this double disjunction of politics and state and of state and constitution form the centre of an open debate about 'constitutionalism beyond the state'. The essays gathered in this collection explore the range of issues raised by this debate. The effects of recent changes on two of the main building blocks of constitutionalism - statehood and democracy - are examined in Parts I and II. Since the movement of overcoming statehood has, arguably, been advanced furthest in the European context, the question of the future of constitutionalist ideas in the framework of the EU provides the key theme of Part III. The remaining parts consider possible transformations or substitutes. The engagement of constitutions with international law offers one line of transmutation of constitutionalism (Part IV) and the diffusion of constitutionalism into separate social spheres provides an alternative way of pursuing constitutionalism in a new key (Part VI). Finally, the ability of the theory of global administrative law (examined in Part V) to offer an alternative account of the potential of jurisdictional control of global governing processes is examined. Through these explorations, the book offers cross-disciplinary insights into the impact of recent political and economic changes on modern constitutionalism and an assessment of the prospects for constitutionalism in a transnational environment"

"The period from the fifteenth century to the late eighteenth century was one of critical importance to British constitutionalism. Although the seeds were sown in earlier eras, it was at this point that the constitution was transformed to a system of representative parliamentary government. Changes at the practical level of the constitution were accompanied by a wealth of ideas on constitutions written from different - and often competing - perspectives. Hobbes and Locke, Harrington, Hume, and Bentham, Coke, the Levellers, and Blackstone were all engaged in the constitutional affairs of the day, and their writings influenced the direction and outcome of constitutional thought and development. They treated themes of a universal and timeless character and as such have established themselves of lasting interest and importance in the history of constitutional thought. Examining their works we can follow the shaping of contemporary ideas of constitutions, and the design of constitutional texts. At the same time major constitutional change and upheaval were taking place in America and France. This was an era of intense discussion, examination, and constitution-making. The new nation of the United States looked to authors such as Locke, Hume, Harrington, and Sydney for guidance in their search for a new republicanism, adding to the development of constitutional thought and practice. This collection includes chapters examining the influences of Madison, Hamilton, Jefferson, and Adams. In France the influence of Rousseau was apparent in the revolutionary constitution, and Sieyes was an active participant in its discussion and design."
