"Tesis ini membahas mengenai penerapan atas penyelesaian kewajiban bank dalam likuidasi kepada para kreditur ditinjau dari Undang-Undang Republik Indonesia Nomor 24 Tahun 2004 tentang Lembaga Penjamin Simpanan. Penelitian ini adalah penelitian kualitatif dengan metode analisis yuridis normatif. Teori yang digunakan atas penerapan hukum tersebut didasari atas asas hukum lex specialis dimana terdapat antara dua atau beberapa aturan yang saling terkait dalam urutan proses penyelesaian kewajiban bank yang dilikuidasi kepada para kreditur dari hasil proses likuidasi. Sedangkan, analisa dalam penelitian ini dilakukan secara kualitatif dengan memilih pasal-pasal yang terdapat dalam Undang-Undang tentang Lembaga Penjamin Simpanan dan peraturan perundang-undangan terkait sesuai dengan ruang lingkup permasalahan penelitian ini kemudian melakukan penelusuran terhadap teori dan asas-asas hukum sehubungan dengan hal tersebut.

This thesis focuses on the implementation of a bank in liquidation in a settlement obligation to the creditors viewed from the law of Republic Indonesia Number 24 year 2004 concerning Deposit Insurance Corporation. This research is normative juridicial research.The theory that is used for the rule of law is based on the principle of legal lex specialis where there be between two or several the rules of being intertwined in the process of resolving the bank being liquidated. The research is conducted on legal principles and legal synchronization. Whereas, analysis in this research is conducted in a qualitative by selecting articles in the law regarding deposit insurance corporation and prevailing laws, subsequently conducting research over legal theory and legal principle in relation to those matters.

"Penelitian bertujuan mengungkap prinsip-prinsip kesetaraan gender yang diwacanakan dalam berita-berita mengenai rencana tes keperawanan di Indonesia yang muncul di The Jakarta Post versi online. Dalam penelitian ini, ancangan penelitian yang digunakan mengacu pada teori Analisis Wacana Kritis (AWK) yang dikembangkan oleh Norman Fairclough (1993), yang menjelaskan keterkaitan antara wacana dengan konteks sosial. Untuk dapat menemukan prinsip-prinsip kesetaraangender, penelitian ini menggunakan perangkat undang-undang yang berlaku di Indonesia.
Hasil penelitian ini membuktikan bahwa dalam berita dengan tema yang sama, The Jakarta Post versi online menunjukkan penolakan terhadap rencana tes keperawanan karena melanggar prinsip kesetaraan gender. Prinsip-prinsip kesetaraan gender yang diungkapkan oleh The Jakarta Post dalam berita yang muncul tahun 2007, 2010, dan 2013 menunjukkan kesesuaian dengan sejumlah prinsip kesetaraan gender yang ditemukan dalam undang-undang.

The objective of this paper is to analyze the discourse of basic principles of gender equality in news of plans to conduct virginity tests in Indonesia as reported in The Jakarta Post (online version). In this study, the theory of Critical Discourse Analysis developed by Norman Fairclough (1993), which describes the relationship between discourse and its social context, is be applied as core theory. In order to identify these principles of gender equality, this study draws on existing national laws regarding gender equality.
The results of this study reveal that The Jakarta Post (online version) rejects the use of virginity tests on the grounds these would violate principles of gender equality. The principles of gender equality expressed by The Jakarta Post in news articles appearing in 2007, 2010, and 2013 are consistent with principles of gender equality contained in national laws regarding basic principles of equality."

"ABSTRAK
Penelitian ini bertujuan untuk mendeskripsikan implementasi prinsip-prinsip relokasi dalam pelaksanaan relokasi warga di Kawasan Pasar Ikan Luar Batang, Jakarta Utara. Teori yang digunakan adalah prinsip-prinsip relokasi yang dikemukakan oleh Cernea. Penelitian ini menggunakan pendekatan post positivist melalui pengumpulan data studi lapangan wawancara mendalam dan observasi dan studi kepustakaan. Hasil penelitian menunjukkan bahwa dari tiga prinsip relokasi dari Cernea yang menjadi dimensi dalam penelitian ini, yaitu government responsibility, resettler rsquo;s participation dan the host population belum semua indikator dapat terpenuhi dalam pelaksanaan relokasi warga di Kawasan Pasar Ikan Luar Batang Jakarta Utara. Pada dimensi pertama, government responsibility, indikator yang belum terpenuhi di antaranya adalah: penentuan lokasi baru terkait dengan desain dan tata ruang, penentuan lokasi baru terkait dengan fasilitas sarana dan prasarana, kebutuhan finansial untuk membangun kembali kehidupan warga yang terkena dampak relokasi dalam hal soft cost seperti pelatihan. Pada dimensi kedua, resettlers rsquo;s participation, indikator yang belum mampu dipenuhi oleh Pemerintah Provinsi DKI Jakarta di antaranya adalah: sosialisasi dengan warga yang terkena relokasi seperti informasi waktu pelaksanaan relokasi, pemilihan lokasi permukiman baru, prosedur kompensasi, hak-hak pemukim, dan partisipasi melalui pemimpin formal, informal dan organisasi non pemerintah dalam perencanaan dan pelaksanaan relokasi. Pada dimensi ketiga, the host population, dapat disimpulkan bahwa semua indikator di dalamnya telah terpenuhi.

ABSTRACT
This research aims to describe about implementation of the relocation principles in the resident relocation in Pasar Ikan Luar Batang Area North Jakarta. Theory that used in this research is the relocation principles by Cernea. This research uses post positivist approach by field study of collecting data in depth interview and observation and literature study. Based on this research, the three principles of Cernea that become dimensions in this research, government responsibility, resettler rsquo s participation and the host population, cannot be met entirely by the provincial government of DKI Jakarta in the Resident Relocation in Pasar Ikan Luar Batang Area, North Jakarta. The first dimension, government responsibility, indicators that cannot be met are determination of the new location associated with design and layout, determination of the new location associated with facilities and infrastructures, financial needs to rebuild the lives of the residents affected by relocation in terms of soft cost such as training. The second dimension, resettlers rsquo s participation, indicators that can not be met are socialization with residents affected by the relocation as the time information to relocate, the recovery of the new settlement, procedure of compensation, the rights of the settlers, and participation by informal, formal and non government organization leader in the planning and implementation of the relocation. The third dimension, the host population, can be concluded that all indicators have been met."

"Does the law merely contain rules? Or does it also include morality? The debate between H.L.A. Hart and Ronald Dworkin revolved around this very issue. Hart considered the law is nothing more than a set of rules whereas Dworkin believed that the law contains not only the rules but also principles which are morality and justice. This paper is trying to explore the issue of the relationship of law and morality in the context of this debate between Hart and Dworkin. The debate itself is very significant in the study of law. Following their arguments we can learn a lot about how the law should be understood and practiced. By listening to their whole debate we will also know that Hart?s positivistic thought and Dworkin?s tendency towards the natural law are not mutually negating. Hart Positivism is not anti-morality. It is precisely through positivism which he defended Hart aims at safeguarding the law by morality; whereas Dworkin has shown what had previously forgotten by the legal positivistic way of thinking, that is moral principles are integral parts of the law."

Place names play a vital role in human society. Names exist in all languages and place names are an indispensible part of international communication. This has been acknowledged by the establishment of the United Nations Group of Experts on Geographical Names (UNGEGN). One of UNGEGN?s tasks is to coordinate international efforts on the proper use of place names. Indonesia supports this effort and through its National Geospatial Agency (BIG). Place names are also of interest as an object of study in themselves. Academic studies into place names are found in linguistics, onomastics, philosophy and a number of other academic disciplines. This article looks at these two dimensions of place names, standardization efforts under the auspices of international and national bodies, and academic studies of names, with particular reference to the situation in Indonesia."

"ABSTRAK
Peraturan Presiden Nomor 4 Tahun 2015 tentang Pengadaan Barang/Jasa Pemerintah telah menggantikan peraturan sebelumnya yakni Peraturan Presiden Nomor 54 Tahun 2010. Adanya Peraturan Presiden ini ialah sebagai respon terhadap kondisi pengadaan barang/jasa pemerintah yang memerlukan inovasi dalam pelaksanaannya, yakni dengan cara pemanfaatan teknologi informasi. Studi ini bertujuan untuk menganalisis dampak yang ditimbulkan dari diterapkannya Peraturan Presiden Nomor 4 Tahun 2015. Analisis dampak dilakukan dengan menyelidiki persepsi para pihak-pihak yang terlibat dalam proses pengadaan barang/jasa di Pemerintah Kabupaten Tasikmalaya terhadap prinsip-prinsip yang ada dalam pengadaan barang/jasa secara umum. Penelitian ini menggunakan pendekatan post-positivist dengan metode deskriptif kualitatif melalui studi literatur, observasi langsung, serta wawancara mendalam dengan pihak-pihak yang berperan dalam pengadaan barang/jasa pemerintah di Kabupaten Tasikmalaya baik itu dari sisi pengusaha sebagai klien maupun pemerintah sebagai stakeholder yang memiliki wewenang dalam pelaksanaan pengadaan barang/jasa. Hasil penelitian menunjukkan bahwa Peraturan Presiden Nomor 4 tahun 2015 berdasarkan prinsip-prinsip pengadaan barang/jasa pemerintah memiliki dampak bagi klien maupun stakeholder dalam pelaksanaan pengadaan barang/jasa pemerintah secara elektronik yakni melalui e-Procurement yang terdiri atas e-Tendering juga e-Purchasing dengan memanfaatkan sistem e-catalogue. Kata Kunci: Dampak Kebijakan, Pengadaan Barang/Jasa Pemerintah PBJP , e-Procurement, Prinsip-Prinsip PBJP, e-Tendering, e-Purchasing, e-catalogue, Pemerintah Kabupaten Tasikmalaya.

ABSTRACT
The Presidential Regulation No. 4 of 2015 concerning of Government Goods Services Procurement has superseded the previous regulation of Presidential Regulation No. 54 of 2010. The existence of this Presidential Regulation is in response to the condition of procurement of goods services of government that require innovation in the implementation, that is by way of utilization of information technology . This study aims to analyze the impact of the implementation of Presidential Regulation No. 4 of 2015. Impact analysis is done by investigating the perceptions of the parties involved in the procurement process of goods services in Tasikmalaya Regency Government against the principles that exist in the procurement of goods services generally. This research uses a post positivist approach with qualitative descriptive method through literature study, direct observation, and in depth interviews with parties that play a role in the procurement of goods services in Tasikmalaya regency either from the side of employers as clients and government as stakeholders who have authority in the procurement of goods services. The result of the research shows that Presidential Regulation No. 4 of 2015 based on the principles of procurement of government goods services has an impact for clients and stakeholders in the implementation of electronic procurement of goods services by e Procurement consisting of e Tendering and e Purchasing with Utilizing e catalogue system. "ABSTRAK
Penelitian ini meneliti bagaimana urgensi netralitas PNS dalam pilkada untuk
mewujudkan AUPB, dan melihat bagaimana permasalahan penerapan netralitas
PNS dalam beberapa pelaksanaan Pemilihan Kepala Daerah (Pilkada).
Berdasarkan hasil penelitian, terlihat bahwasanya Pilkada di berbagai daerah di
Indonesia beberapa waktu kebelakang masih diwarnai dengan beberapa
permasalahan dan sengketa pasca pilkada dilaksanakan, hal tersebut
dilatarbelakangi berbagai hal dan yang spesifik berkaitan dengan penelitian ini
adalah pelanggaran terhadap netralitas PNS dalam pelaksanaan Pilkada. Pada
hasil penelitian, terlihat dengan jelas bahwa netralitas PNS dalam pelaksanaan
Pilkada merupakan suatu hal yang sangat penting, hal ini termaktub dengan jelas
dalam berbagai aturan yang mengatur secara rinci tentang PNS, antara lain dalam
UU No. 5 Tahun 2014 tentang ASN dimana PNS harus bebas dari pengaruh
golongan maupun parpol, dan netralitas merupakan amanat yang ada didalam
Asas Manajemen ASN. Selanjutnya Netralitas PNS sangat erat kaitannya dalam
mewujudkan AUPB, dimana didalam UU ASN telah disebutkan bahwa PNS
harus netral, dan untuk mewujudkan tata kelola pemerintahan yang baik melalui
AUPB, diatur bahwa PNS harus netral dan tidak boleh berpihak sehingga dengan
pelaksanaan netralitas PNS dapat mewujudkan pelaksanaan AUPB. Selanjutnya
mengenai pelanggaran netralitas PNS diatur sanksi hukuman sedang dan berat
sebagaimana diatur dalam Disiplin PNS PP No. 53 Tahun 2010, dimana ancaman
terberat PNS dapat diberhentikan dengan tidak hormat atas pelanggaran yang
telah dilakukan. Pelanggaran netralitas PNS di daerah marak diwarnai modus,
antara lain Mobilisasi PNS, Mutasi PNS, Penyalahgunaan Anggaran, serta
intimidasi PNS. Pada akhirnya pasca dikeluarkannya UU ASN pengawasan
netralitas ASN menjadi tugas Komisi Aparatur SIpil Negara (KASN), dengan
tugas yang demikian besar, KASN masih memiliki keterbatasan dibidang
kewenangan, SDM dan anggaran. Sehingga kedepannya untuk meningkatkan
pengawasan netralitas PNS diperlukan penguatan KASN dari berbagai aspek
tersebut, kemudian perlu diadakannya sosialiasi secara komprehensif kepada PNS
di seluruh daerah untuk melakukan prevensi terhadap berbagai pelanggaran
netralitas PNS, dan terakhir perlu kiranya memanfaatkan teknologi informasi
untuk membuka pengawasan masyarakat terhadap PNS melalui pengaduan
langsung dengan sistem informasi, sehingga dapat mewujudkan pengawasan
netralitas PNS secara efektif.

ABSTRACT
This research examines how urgency of civil servant neutrality in elections to
realize AUPB, and to see how the problem of civil servant neutrality
implementation in some implementation of Election of Regional Head (Pilkada).
Based on the results of the research, it appears that elections in various regions in
Indonesia some time back are still colored by several problems and post election
disputes implemented, it is motivated by various things and specific related to this
research is a violation of the neutrality of civil servants in the implementation of
elections. In the research results, it is clear that the neutrality of civil servants in
the implementation of Pilkada is a very important thing, it is clearly stated in the
various rules that regulate in detail about civil servants, among others, in Law no.
5 Year 2014 on ASN where civil servants should be free from the influence of
groups and political parties, and neutrality is a mandate that exists within the ASN
Management Principles. Furthermore, the neutrality of civil servants is closely
related to the realization of AUPB, where in the ASN Act has been mentioned that
the civil servants should be neutral, and to realize good governance through
AUPB, regulated that the civil servants should be neutral and should not take
sides so with the implementation of the neutrality of civil servants can realize the
implementation of AUPB . Furthermore, regarding the violation of the neutrality
of civil servants are sanctioned by medium and heavy punishment as stipulated in
the Civil Government Regulation PP. 53 of 2010, where the heaviest threat of
civil servants may be dismissed with disrespect for the offenses committed.
Violations of the neutrality of civil servants in rampant areas are colored by
modes, including Mobilization of Civil Servants, Mutation of Civil Servants,
Budget Abuse, and civil servants intimidation. In the end, after the issuance of
ASN Law, the control of ASN neutrality becomes the task of the State Apparatus
Force (KASN), with such a large task, KASN still has limited authority, human
resources and budget. So in the future to improve the supervision of the neutrality
of civil servants is needed strengthening KASN from various aspects, then need
comprehensive socialization to civil servants across the region to prevent the
prevention of various violations of the neutrality of civil servants, and lastly need
to use information technology to open the public surveillance of civil servants
through a complaint directly with the information system, so as to realize the
supervision of the neutrality of civil servants effectively."

"Sebagai salah satu daerah di Indonesia yang memperoleh titel daerah spesial, Aceh diberikan kewenangan oleh Pemerintah Pusat untuk mengatur dan mengelola urusan daerahnya sendiri, sebagaimana diberikan melalui Undang-Undang No. 11 Tahun 2006 tentang Pemerintahan Aceh. Terkait dengan kewenangan untuk mengatur urusan daerahnya sendiri, terdapat kewenangan yang diberikan kepada Pemerintah Daerah Aceh unuk membentuk dan mengesahkan peraturan daerahnya sendiri yang disebut sebagai Qanun Aceh. Terkait dengan hal ini, Pemerintah Daerah Aceh baru saja mengesahkan Qanun Aceh No. 11 Tahun 2018 tentang Lembaga Keuangan Syariah. Melalui Qanun ini, Pemerintah Daerah Aceh memberikan pengaturan yang komprehensif mengenai implementasi Prinsip-Prinsip Syariah bagi seluruh Lembaga Keuangan yang beroperasi di wilayah Aceh. Pada dasarnya, Qanun ini menimbulkan kewajiban bagi seluruh Lemabga Keuangan di Aceh untuk beroperasi dengan menggunakan dasar Prinsip-Prinsip Syariah. Terkait dengan hal ini, implikasi serta konsekuensi hukum dari keberadaan Qanun ini akan dianalisis lebih lanjut dalam penelitian ini. Penelitian ini menggunakan metodie penelitian hukum normatif dengan tipe analisis deskriptif, yang akan menggunakan data yang diambil dari hasil penelitian dokumen-dokumen terkait dan materi-materi kepustakaan, serta melalui beberapa wawancara terhadap narasumber terkait. Maka dari itu, seluruh Bank di Aceh wajib beroperasi berdasarkan Prinsip-Prinsip Syariah sebelum tanggal 4 Januari 2022, atau dengan kata lain, seluruh kegiatan finansial dan kegiatan perbankan secara konvensional tidak diperkenankan untuk beroperasi lagi di Aceh setelah tanggal 4 Januari 2022. Pada saat ini, terdapat beberapa Bank di Aceh yang masih melaksankan kegiatan perbankannya secara konvensional. Sebagai akibat dari adanya kewajiban bagi seluruh Bank untuk beroperasi berdasarkan Prinsip-Prinsip Syariah sebagaima tertera dalam Qanun Aceh No. 11 Tahun 2018 tentang Lembaga Keuangan Syariah, maka seluruh Bank di Aceh wajib menyesuaikan dirinya dengan peraturan yang ada. Dalam penelitian ini, terdapat beberapa saran dan gagasan yang dapat digunakan oleh masing-masing jenis kegiatan perbankan di Aceh dalam rangka memenuhi kewajiban yang diatur dalam Qanun Aceh No. 11 Tahun 2018 tentang Lembaga Keuangan Syariah ini.

As one of the regions in Indonesia which obtain the title of special region, Aceh is given the authority by the central government to regulate and manage its own regional affairs as given through Law No. 11 Year 2006 regarding the Aceh Government. In regard to the management of its own regional affairs, there is an authority given for the Government of Aceh to promulgate and enact its own regional regulation called Qanun Aceh. In relation to this, the Government of Aceh has recently enacted Qanun Aceh No. 11 Year 2018 regarding Sharia Financial Institutions. Through this Qanun, the Government of Aceh provides comprehensive regulations on the implementation of Sharia Principles for all Financial Institutions operating in Aceh. In essence, the enactment of this Qanun gives rise to the obligation for all Financial Institutions in Aceh to operate in accordance with the Sharia Principles. In regard to this, the implications on the enactment of this Qanun, as well as the legal consequences for Banks operating in Aceh in fulfilling such obligation will be analysed further. This research will use the normative legal research method with a descriptive analysis type of research, which uses data taken from the examinations of relevant documents and library materials, as well as the conduct of several interviews.  In essence, all Banks in Aceh shall be operating based on the Sharia Principles by January 4, 2022, or in other words, no Conventional-Based financial or banking activities shall be operating in Aceh after January 4, 2022. At the moment, there are still several Conventional-Based banking activities conducted by Conventional Banks in Aceh. Due to the obligation set forth in Qanun Aceh No. 11 Year 2018 regarding Sharia Financial Institutions, then those Banks need to adjust themselves with the applicable regulation. In this research, there are several suggestions that might be conducted by each types of Banking activities existing in Aceh in implementing the obligation set forth in Qanun Aceh No. 11 Year 2018 regarding Sharia Financial Institutions.

"Notaris dalam melaksanakan profesinya wajib menerapkan Prinsip Mengenali Pengguna Jasa sebagaimana yang diatur dalam Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 9 Tahun 2017. Prinsip Mengenali Pengguna Jasa berfungsi untuk melindungi Notaris yang rentan terhadap pelaku Tindak Pidana Pencucian Uang. Tindak Pidana Pencucian merupakan perbuatan kejahatan menghasilkan uang yang berasal dari tindak kejahatan dengan maksud untuk menyembunyikan atau menyamarkan asal-usul uang tersebut yang dapat meruntuhkan sendi-sendi ekonomi negara. Adapun permasalahan yang diangkat dalam penelitian ini adalah mengenai pengaturan Prinsip Mengenali Pengguna Jasa oleh Notaris dalam mencegah dan memberantas Tindak Pidana Pencucian Uang di Indonesia; dan implementasi Prinsip Mengenali Pengguna Jasa oleh Notaris dalam mencegah dan memberantas Tindak Pidana Pencucian Uang di Indonesia. Untuk menjawab permasalahan tersebut digunakan metode penelitian doktrinal dengan menggunakan tipe penelitian eksplanatoris, dengan hasil penelitian dianalisis secara kualitatif. Bahan analisis bersumber pada data sekunder berupa peraturan perundang-undangan, studi dokumen, dan mewawancarai narasumber untuk memperkuat hasil penelitian. Berdasarkan pengaturan yang berlaku, Prinsip Mengenali Pengguna Jasa oleh Notaris dilakukan dengan tiga tahapan, yaitu dengan mengidentifikasi pengguna jasa, verifikasi pengguna jasa, dan pengawasan pengguna jasa. Notaris diperlukan dapat berperan aktif dalam menerapkan Prinsip Mengenali Pengguna Jasa untuk dapat membantu pencegahan dan pemberantasan tindak pidana pencucian uang di Indonesia agar terwujudnya salah satu program nasional yang menjadikan Indonesia sebagai anggota Financial Action Task Force On Money. Notaries in carrying out their profession must apply the Principles of Recognizing Service Users as stipulated in the Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 9 Tahun 2017. The Principle of Recognizing Service Users serves to protect Notaries who are vulnerable to perpetrators of Money Laundering Crimes. Laundering is the crime of making money derived from crime with the intention to hide or disguise the origin of the money that can collapse the joints of the country's economy. The issues raised in this study are regarding the regulation of the Principles of Recognizing Service Users for Notaries in preventing and eradicating Money Laundering in Indonesia; and implementation of the Principles of Recognizing Service Users for Notaries in preventing and eradicating Money Laundering in Indonesia. To answer these problems, doctrinal research methods are used using explanatory research types, with the results of the research analyzed qualitatively. Analysis materials are sourced from secondary data in the form of laws and regulations, document studies, and interviewing resource persons to strengthen research results. Based on applicable regulations, the Principles of Recognizing Service Users for Notaries are carried out in three stages, namely by identifying service users, verifying service users, and supervising service users. Notaries are required to play an active role in implementing the Principles of Recognizing Service Users to be able to help prevent and eradicate money laundering in Indonesia in order to realize one of the national programs that make Indonesia a member of the Financial Action Task Force On Money Laundering (FATF)."
