"n this fourth volume of the Legalism series, ownership is defined as the simple fact of being able to describe something as 'mine' or 'yours', and property is distinguished as the discursive field which allows the articulation of attendant rights, relationships, and obligations. Property is often articulated through legalism as a way of thinking that appeals to rules and to generalizing concepts as a way of understanding, responding to, and managing the world around one. An Aristotelian perspective suggests that ownership is the natural state of things and a prerequisite of a true sense of self. An alternative perspective from legal theory puts law at the heart of the origins of property. However, both these points of view are problematic in a wider context, the latter because it rests heavily on Roman law. Anthropological and historical studies enable us to interrogate these assumptions. The articles here, ranging from Roman provinces to modern-day piracy in Somalia, address questions such as: How are legal property regimes intertwined with economic, moral-ethical, and political prerogatives? How far do the assumptions of the western philosophical tradition explain property and ownership in other societies? Is the 'bundle of rights' a useful way to think about property? How does legalism negotiate property relationships and interests between communities and individuals? How does the legalism of property respond to the temporalities and materialities of the objects owned? How are property regimes managed by states, and what kinds of conflicts are thus generated?"

"Pertumbuhan penduduk yang terus meningkat dari tahun ke tahun berbanding lurus dengan peningkatan kebutuhan akan hunian yang layak serta fasilitas pendukungnya yang lengkap namun berbanding terbalik dengan ketersediaan lahan yang dapat dikembangkan sebagai hunian, oleh karenanya pengembangan mixed-use properti merupakan solusi atas permasalahan kurangnya ketersediaan lahan. Bentuk penelitian yang digunakan adalah penelitian hukum normatif dengan metode studi kepustakaan. Peraturan perundang-undangan yang terdapat di Indonesia sebenarnya hanya mengenal istilah Rumah Susun, dan istilah-istilah yang lain merupakan istilah serapan dari bahasa asing yang digunakan oleh para pengembang dalam memasarkan produknya. Pada dasarnya UU 20/2011 sudah mengakomodir adanya konsep mixed-use properti. Hal ini dapat diperhatikan dalam ketentuan Pasal 50 serta penjelasan Pasal 50 huruf b UU Nomor 20 Tahun 2011 tentang Rumah Susun. Dalam setiap tahapan pengembangan mixed-use properti, terdapat aturan-aturan hukum yang tidak boleh dikesampingkan dan harus sangat diperhatikan, mulai dari tahapan pra-pembangunan, tahapan pembangunan, tahapan pasca-pembangunan. Dalam proses pengembangan mixed-use properti ini, terdapat beberapa permasalahan hukum yang perlu diperhatikan.Terkait studi kasus dimana penulis memilih pengembangan mixed-use properti di Daerah Istimewa Yogyakarta, adalah dikarenakan di daerah tersebut telah diterbitkan beberapa Peraturan Daerah, khususnya di Kabupaten Sleman, yang cenderung menambah permasalahan hukum dalam rangka mixed-use properti.

The increase of population growth from year to year and directly proportional to the increase in demand for proper-residential with complete facilities, but inversely proportional to the availability of land that can be developed as residential, therefore the mixed-use development property is a solution to the problem of the lack of land availability. Form of study is a normative legal research with the literature study method. Legislation in Indonesia was only familiar with the term of ?Rumah Susun?. Other terms are term uptake of foreign languages ​​used by developers in marketing their products. Basically Law 20/2011 already accommodate the concept of a mixed-use property. This can be noted in the provisions of Article 50 as well as the elucidation of Article 50 paragraph b of Law No. 20 of 2011 on the ?Rumah Susun?. In every stage of the development of mixed-use properties, there are rules of law that should not be ruled out and should be very concerned, ranging from pre-construction stages, development, stage, and post-development stages. In the process of developing a mixed-use properties, there are some legal issues that need to be noted. Related to the case study in which the authors chose the mixed-use development property in Daerah Istimewa Yogyakarta, is due in the area has issued several Regional Regulation, particularly in Sleman, which tends to add to the legal issues in the framework of a mixed-use development property.

"Pemerintah Provinsi DKI Jakarta mengeluarkan kebijakan pembebasan pajak bumi dan bangunan perdesaan dan perkotaan (PBB-P2) atas rumah, rusunawa dan rusunami dengan NJOP s.d. Rp. 1 Miliar dalam rangka membantu beban masyarakat golongan ekonomi lemah sebagaimana diatur dalam Peraturan Gubernur Nomor 259 Tahun 2015. Penelitian ini bertujuan untuk menghitung dampak pelaksanaan kebijakan pembebasan PBB-P2 serta menghitung dan menganalisa besaran objek PBB-P2 yang mendapatkan fasilitas pembebasan atau pembebanan kembali atas PBB-P2 ditahun mendatang. Penelitian ini menggunakan metode analisis deskriptif.
Hasil penelitian menunjukkan bahwa kebijakan pembebasan PBB-P2 berdampak pada penurunan jumlah SPPT terbit dan pokok ketetapan PBB-P2 tahun 2016 namun di sisi lain juga meningkatkan collection rate penerimaan PBB-P2. Selain itu terdapat masih banyaknya jumlah objek pajak yang diberikan fasilitas pembebasan PBB-P2 dibandingkan jumlah objek pajak yang dibebankan kembali PBB-P2 pada tahun mendatang dengan asumsi kenaikan NJOP BUMI per tahun sebesar 10% dan asumsi kenaikan NJOP BUMI per tahun berdasarkan kenaikan harga pasar rata-rata maksimum sebesar 20%.

Jakarta Provincial Government issued Land and Property Tax exemption policies for houses, rusunawa, and rusunami that valued up to IDR 1 Billion to help weak economy class society that regulated in Governor Regulation No. 259 Year 2015. The study aims to calculates the impact of Land and Property Tax exemption policies and calculates and analyze the PBB-P2 objects which have to be not imposed or to be imposed PBB-P2 in the coming years. This study using descriptive analysis method.
The results showed that PBB-P2 exemption policies impact to decreased SPPT issued and the tax assessments of PBB-P2 on 2016, but the collection rate of PBB-P2 revenue has been increase. In addition there are still many objects that is granted PBB-P2 exemption compared to the objects that is charged with the PBB-P2 on the upcoming years with the assumptions NJOP rise by 10% per year and the assumptions NJOP based on average market price rise by 20% per year.

"ABSTRAK
Virtual property di dalam suatu permainan online pada umumnya kerap dianggap
sebagai suatu benda dan memiliki nilai ekonomis. Tesis ini membahas mengenai
ketentuan hukum yang mengatur mengenai virtual property dan peralihan atas virtual
property yang terjadi berdasarkan transaksi diantara para pemain. Metode penelitian
tesis ini adalah yuridis normatif. Hasil penelitian ini menyimpulkan bahwa ketentuan
hukum yang mengatur mengenai virtual property dapat ditemukan di tiga aturan
hukum, yaitu hukum Hak Cipta, Hukum Benda, dan Hukum Perikatan. Peralihan
virtual property sebagai akibat dari transaksi atas pemain sifatnya adalah sah dan
enforcable, namun hanya diantara pemain saja, namun tidak enforcable jika terkait
dengan penyedia jasa permainan online.

Abstract
Virtual property in an online game is often regarded as an object and has economic
value. This thesis discusses the legal provisions regulating virtual property and
transfer of virtual property transactions that occur based on among the players. The
research method of this thesis is the normative juridical. The results of this study
concluded that the legal provisions governing virtual property can be found in the
three rules of law, which is Copyright Law, Property law, and Law of material.
Transfer of virtual property as a result of the transaction between players is a valid
and enforcable, but only among players, but not enforcable if associated with the
online game service provider."
