Skripsi ini membahas mengenai kedudukan antara kreditor konkuren dan kreditor separatis selama menjalankan proses Penundaan Kewajiban Pembayaran Utang (PKPU). Dalam lembaga PKPU, kedudukan antara kreditor adalah sama. Undang-undang secara implisit telah memberikan perlindungan kepada kreditor konkuren sebagai pihak yang memiliki kedudukan yang lemah. Namun dalam prakteknya masih sering ditemukan kecondongan atau dominasi dari kreditor lainnya, khususnya kreditor separatis. Ketimpangan antara kedua kreditor tersebut juga terjadi dalam kasus PKPU PT. Benangsari Indahtexindo. Asas Keseimbangan yang terdapat dalam hukum kepailitan menjadi patokan utama dalam menentukan proses PKPU, karena dengan asas tersebut maka dapat dicapai hasil akhir yang adil. ...... This paper discusses the standing of the unsecured creditor and secured creditor throughout the process of Suspension of Payment. In Suspension of Payment foundation, the standings between all the creditors are same. The law implicitly has been giving protection for the unsecured creditor, as the party which has a weak position. But in practice there are still tendency or dominance of other creditor, especially the secured creditor. Disparities between the two of the creditor also happened in Suspension of Payment of PT. Benangsari Indahtexindo. The principle of balance that was found in bankruptcy law is the first criterion in determining the process of the Suspension of Payment, because of this principle, it can achieved the fair result.
