Abstrak :
Untuk dapat menjalankan fungsinya yang telah diamanatkan dalam Undang-Undang Dasar, sebuah undang-undang tentu harus dirumuskan secara jelas, tidak mengandung kecacatan substansial, dan tidak menimbulkan inkonsistensi dalam penerapannya terhadap sistem hukum secara keseluruhan. Merupakan sebuah tanggung jawab bagi perancang peraturan perundang-undangan dan merupakan fungsi dari Ilmu perundang-undangan untuk mewujudkan hal tersebut. Rumusan sebuah pasal sangat menentukan dapat atau tidak dapatnya hukum memberikan keadilan, kepastian, dan kemanfaatan bagi manusia. Tidak dirumuskannya sebuah undang-undang secara baik akan menimbulkan permasalahan yang pelik, contohnya adalah diterimanya permohonan peninjauan kembali yang diajukan oleh jaksa terhadap putusan bebas yang telah berkekuatan hukum tetap dalam perkara pidana oleh Mahkamah Agung. Ketidakjelasan dalam pasal-pasal yang mengatur tentang peninjauan kembali menimbulkan berbagai macam penafsiran yang sayangnya tidak sesuai dengan hakikat dari peninjauan kembali. Oleh karena itu, terhadap rumusan pasal-pasal tersebut perlu diadakan perbaikan dan karena proses perubahan sebuah undang-undang memakan waktu, tentunya terhadap pasal-pasal yang masih berlaku tersebut perlu diterapkan sebuah metode penafsiran yang tepat.

In order to apply its function as has been mandated under the Constitution of the Republic of Indonesia, an act must be formulated clearly, doesn’t have a substantial defects, and doesn’t cause any incosistency in its implementation at the whole level. It is a duty for a legal drafter to make sure that it is done properly and it is the functions of the legislation theory to implement it. The drafting of each articles in an act is essential towards to ensure its impartiality and its certainty, also its benefit towards the people governed by it. Fraud of act’s legal drafting process will cause a huge consequences. Example given, the approval of a case review requestas has been appealed by Prosecutor to a legal and binding judgment in a criminal case by the Supreme Court of the Republic of Indonesia. The uncertainty in articles that governs about the rights to file a case review will cause a misinterpretation and distorting the basic philosophy of the case revie (herziening) itself. Hence, the drafting of an act’s article must be coordinated together with revision and in such a lengthy time-frame, especially to implement the interpretation of the articles properly.

President Joko Widodo has a clear vision & mission to transform Indonesia to be a maritime axis. He firmly reaffirm that Indonesia is a strong maritime country and its people should enjoy the great benefits from its sea resources. Fisheries is one of the biggest marine living resources that significantly contribute economic benefits to Indonesian people. Nonetheless, the flaws on the laws has created is advantage to Indonesian people, in particular, fisherman. The genuine link obligation under article 91 UNCLOS is intend to ensure a fishing vessel is socially and economically attached to its owner, so that its utilization will bring profits. Ironically, ship registration system under the government regulation number 51 year 2002(GR 51/2002) on shipping give a space for a false document being used in ship registration process. It creates a condition where a foreign fishing vessel owners can operateits vessel in Indonesian waters, under the name of Indonesian people or company, eventhough the transfer of ownership is not done. The result is, the utilization of the vessel is for the greatest benefit of the real owner and not for the Indonesian people. Indonesian government should revise the GR 51/2002 to protect the interest of its people.
