Abstrak :
Indonesia baru saja mengaksesi Konvensi Apostille atau Convention of 5 October 1961 Abolishing the Requirement of Legalisation for Foreign Public Documents yaitu konvensi penghapusan persyaratan legalisasi dokumen publik asing. Konvensi ini merupakan perjanjian internasional untuk menghapuskan proses legalisasi dokumen publik asing dalam upaya pemerintah agar mempermudah masyarakat dalam melakukan hubungan dan kerjasama internasional. Penelitian ini membahas mengenai dokumen-dokumen yang dapat di apostillle, mengetahui kekuatan pembuktian dari surat kuasa yang di apostille sebagai alat bukti di dalam Hukum Acara Perdata serta sikap yang harus dilakukan oleh notaris atas dokumen yang tidak dilegalisasi oleh Kedutaan Besar Republik Indonesia pasca disahkannya Peraturan Presiden Nomor 2 Tahun 2021 Tentang Pengesahan Penghapusan Persyaratan Legalisasi Terhadap Dokumen Publik Asing. Penelitian ini menggunakan penelitian hukum normatif dengan pengumpulan data menggunakan data kepustakaan dan wawancara bersifat yuridis normatif dengan tipologi preskriptif. Hasil dari penelitian ini menjelaskan mengenai dokumen-dokumen yang dapat di apostille, kekuatan pembuktian sertifikat apostille di muka pengadilan perdata dan sikap notaris terhadap akta yang dibuatnya berdasarkan sertfikat apostille. ......Indonesia has just acceded to the Apostile Convention or the October 5, 1961 Convention. This convention is an international agreement to abolish the legalization process of foreign public documents in the government's efforts to facilitate the public in conducting international relations and cooperation. This study discusses documents that can be apostiled, finds out the evidentiary strength of the apostile power of attorney letter as evidence in the Civil Procedure Code and the notary protection of documents that are not legalized by the Embassy of the Republic of Indonesia after the ratification of Presidential Regulation Number 2 of 2021. This study uses normative legal research with data collection using library data and normative juridical interviews with prescriptive typology. The results of this study explain the documents that can be apostiled, the strength of apostile evidence before a civil court and the attitude of the notary towards the deed he made based on the apostile certificate.
