Tesis ini membahas tentang permasalahan imbalan jasa kurator dari suatu kasus kepailitan yang dihadapkan pada dua peraturan, di mana dua peraturan tersebut memiliki beberapa perbedaan substansi yang saling bertolak belakang. Penelitian ini adalah penelitian normatif dengan tipologi penelitian Preskriptif. Dari hasil penelitian diperoleh kesimpulan bahwa dua peraturan yang memiliki beberapa perbedaan substansi tersebut sama-sama menerapkan sistem hourly sehingga seharusnya penetapan imbalan jasa kurator harus dihitung berdasarkan jam kerja kurator. Sedangkan pihak yang wajib membayar imbalan jasa kurator adalah pemohon pailit dan debitor dan upaya hukum yang dapat dilakukan terhadap penetapan tersebut adalah kasasi.

ABSTRACT
This thesis deals with the curator’s service fee of a bankruptcy which has two different rules and substantial. It uses a normative method and prescriptive. The result of this research conclude that those two different rules use the same method which apply hourly systems so that a curators service fee should be calculated based on how many hours he has worked. The one who has the obligation to pay a curators service fee is the one who filing the petition and debtor. The legal remedy of the judgment is cassation.

Skripsi ini membahas mengenai wanprestasi atas kontrak eksklusif yang dibuat dan ditandatangani oleh rumah produksi atau production house (PH) yaitu MD Entertainment dengan artis Rezky Aditya dalam hal pembuatan sinetron atau serial TV. Analisa dilakukan dengan pembahasan yang bersifat deskriptif terhadap isi perjanjian, gugatan wanprestasi, tuntutan ganti rugi serta putusan hakim. Hal tersebut disesuaikan dengan aturan hokum yang berlaku berdasarkan KUH Perdata, serta teori-teori hokum yang ada, sehingga pada akhirnya diperoleh tanggapan berupa pandangan hokum terhadap isi perjanjian, gugatan dan putusan hakim itu sendiri. ......This study discussed the default of the exclusive contract between Production House (PH) MD. Entertainment and their artist: Rezky Aditya in the process of "Sinetron" or TV series’ shooting. The analysis used was the descriptive study toward the content of the contract, default charge, compensation charge and judge's verdict. The analysis was adjusted with the regulation applied based on KUH Perdata, and also the current law theory, so that the response based on law theory toward the content of the contract, the charge, and the judge’s verdict could be obtained.
