"Skripsi ini membahas mengenai pengajuan upaya hukum kasasi oleh kreditor separatis terkait dengan rencana perdamaian. Walaupun telah diatur bahwa mengenai putusan penundaan kewajiban pembayaran utang, termasuk putusan pengesahan rencana perdamaian, tidak dapat diajukan upaya hukum apapun, namun pada kenyataannya masih banyak yang mengajukan upaya hukum, terutama kasasi terkait dengan putusan-putusan tersebut. Banyak dari upaya kasasi tersebut apabila diajukan, maka oleh Majelis Hakim Agung, permohonan tersebut akan ditolak ataupun tidak diterima. Namun, terdapat juga upaya kasasi yang dilakukan oleh kreditor separatis mengenai rencana perdamaian tersebut yang diterima dan dikabulkan oleh Majelis Hakim Agung. Hal tersebut dapat menyebabkan pihak debitur serta pihak-pihak kreditor lainnya mengalami kerugian dan dampak hukum yang tidak diinginkan.

This paper discusses the submission of cassation by secured creditors related to the composition plan. Although it has been regulated that regarding the decision to postpone the obligation to pay debts, including the decision to ratify the reconciliation plan, no legal action can be submitted, in reality there are still many who file legal remedies, especially cassation related to these decisions. Many of these cassation efforts, if submitted, will be rejected or not accepted by the Supreme Court of Justice. However, there were also cassation efforts made by secured creditors regarding the composition plan which was accepted and granted by the Supreme Court of Justice. This can cause debtors and other creditor parties to suffer losses and unwanted legal effects."
