"Penelitian ini membahas tentang pemeriksaan Notaris oleh Majelis Pengawas. Kasus yang menjadi pokok permasalahan dalam penelitian ini adalah perihal kerahasiaan pemeriksaan Notaris oleh Majelis Pengawas yang dimuat dalam putusan Putusan No. 513/Pdt.G/2018/PN.Sby. Notaris dalam menjalankan jabatannya sebagai pejabat umum yang berwenang membuat akta Autentik, dituntut untuk memperhatikan prinsip kehati-hatian. Apabila terdapat Kode Etik yang dilakukan oleh Notaris pada saat menjalankan jabatannya, maka masyarakat dapat melaporkan pelanggaran tersebut kepada Majelis Pengawas Notaris. Namun, tidak selalu laporan masyarakat tersebut tidaklah selalu benar. Tidak jarang Notaris dirugikan oleh laporan masyarakat yang tidak terbukti kebenarannya. Adapun permasalahan yang diteliti dalam penelitian ini adalah mengenai perlindungan hukum Notaris terhadap pengaduan masyarakat kepada Majelis Pengawas yang tidak terbukti kebenarannya dan mengenai kerahasiaan pemeriksaan Notaris yang dilakukan oleh Majelis Pengawas. Penelitian ini menggunakan metode penelitian yuridis-normatif, dengan tipologi penelitian  deskriptif-analitis. Hasil analisa menunjukan bahwa Notaris pada dasarnya mendapatkan perlindungan hukum terhadap laporan masyarakat yang tidak berdasar, serta sifat kerahasiaan dari pemeriksaan Notaris yang dilakukan oleh Majelis Pengawas Notaris. Oleh karena itu, Notaris yang menjalankan jabatannya sesuai peraturan yang berlaku, secara otomatis mendapatkan perlindungan hukum dari laporan masyarakat yang tidak berdasar. Selain itu, alangkah lebih baik apabila pihak yang akan melaporkan Notaris kepada Majelis Pengawas terlebih dahulu meminta penjelasan terkait permasalahan tersebut kepada Notaris yang bersangkutan, serta lebih berhati-hati dalam memahami pelaporan terhadap Notaris yang akan dilaporkan tersebut.

This research discusses the notary investigation by the Notary Supervisory Council. The case, which is the main problem in this research is about the confidentiality of the Notary's investigation by the Notary Supervisory Council which is contained in the Court Decision No.513/Pdt.G/2018/PN.Sby. Notary, in carrying out their positions as public officials who have the authority to make authentic deeds, is required to observe the prudential regulations. If there is a malfeasance committed by a notary while carrying out his/her position, the public can report the violation to the Notary Supervisory Council. However, these public reports are not always true. It is often for Notary to be harmed by public reports that are not proven to be true. The problems examined in this research are regarding the legal protection of Notary against public complaints to the Notary Supervisory Council that are not proven to be true and regarding the confidentiality of the examinations of the Notary conducted by the Notary Supervisory Council. This research uses a juridical-normative research method, with a descriptive-analytical research typology. The results of the analysis show that the Notary basically gets legal protection against unfounded public reports, as well as the confidential nature of the Notary's examination conducted by the Notary Supervisory Council. Therefore, the Notary who carries out his/her position in accordance with the applicable regulations, automatically gets legal protection from unfounded public reports. In addition, it would be better if the parties who will report the Notary to the Notary Supervisory Council ask for an explanation first, regarding the matter from the Notary concerned, and be more careful in understanding the reporting of the Notary that will be reported.
