Abstrak :
Pandemi COVID-19 yang terjadi pada tahun 2020 silam telah menyebabkan gejolak terhadap keadaan ekonomi dunia. Pandemi COVID-19 tersebut diikuti dengan kejadian-kejadian tak terduga lainnya seperti perang Rusia-Ukraina yang menyebabkan keadaan ekonomi global tidak kunjung stabil. Tingkat kepailitan di berbagai belahan dunia dan tidak terkecuali di Indonesia mengalami kenaikan yang signifikan, perusahaan-perusahaan besar bangkrut akibat gejolak ekonomi global ini. Dewasa ini, Hak Kekayaan Intelektual semakin diperhitungkan sebagai sebuah kekayaan atau aset perusahaan yang memiliki nilai. Hal tersebut ditunjukan dalam keseriusan pemerintah Indonesia dalam menerapkan kebijakan mengenai Hak Kekayaan Intelektual sebagai objek jaminan utang. Perusahaan-perusahaan yang memiliki hak kekayaan intelektual sebagai asetnya tentu tidak terlepas dari pengaruh krisis ekonomi global yang mungkin akan semakin parah di tahun-tahun kedepan. Hal ini menimbulkan masalah apabila perusahaan-perusahaan tersebut pada akhirnya mengalami Kepailitan. Bagaimana jika ada lisensi terhadap Hak Kekayaan Intelektual yang mereka miliki sedangkan Hak Kekayaan Intelektual tersebut menjadi Harta Pailit dan berstatus objek sengketa. Apa akibatnya terhadap pihak-pihak yang memiliki lisensi atas Hak Kekayaan Intelektual tersebut. Melalui penelitian ini akan dibahas permasalahan-permasalahan yang akan timbul jika benar hal tersebut terjadi. ......The COVID-19 pandemic that occurred in 2020 has caused turmoil in the world economy. The COVID-19 pandemic was followed by other unexpected events such as the Russia-Ukraine war which caused the global economy to remain unstable. Bankruptcy rates in various parts of the world including Indonesia has experienced a significant increase, large companies went bankrupt as a result of this global economic turmoil. Today, Intellectual Property Rights are increasingly considered as a company's property or assets that have value. This is shown in the seriousness of Indonesian government in implementing policies regarding Intellectual Property Rights as objects of debt guarantees. Companies that have intellectual property rights as their assets are certainly not free from the effects of the global economic crisis which could get worse in the coming years. This creates a problem if these companies eventually go bankrupt. What if there is a license to their Intellectual Property Rights while the Intellectual Property Rights becomes a Bankruptcy Asset and in a status of dispute object. What are the consequences for the parties who have licenses for these Intellectual Property Rights. Through this research, these problems will be analized should this matter eventually occur.
