"Penelitian ini membahas diversi dalam model Restorative Justice pada tahap Penyidikan yang diatur dalam Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak. Pokok permasalahan penelitian ini adalah sinkronisasi diversi pada tahap Penyidikan dalam Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak dengan United Nations Standard Minimum Rules for the Administration of Juvenile (The Beijing Rules), kekuatan hukum diversi pada tahap Penyidikan dikaitkan dengan kekuasaan kehakiman, dan mekanisme pelaksanaan kesepakatan diversi. Penelitian ini menggunakan metode yuridis-normatif dengan sumber pengambilan data pada studi literatur dan wawancara narasumber. Hasil dari penelitian ini adalah perlunya memperjelas Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak dan segera mungkin membuat Peraturan Pemerintah untuk memberikan kejelasan pelaksaan diversi pada aparat penegak hukum yang berwenang. ......This research disscusses about the diversion of Restorative Justice model in the investigation stage that is set forth in Act Number 11 of 2012 about Juvenile Justice System. The main problem of this research is diversion syncronization between the investigation stage in Act Number 11 0f 2012 about Juvenile Justice System and United Nations Standard Minimum Rules for the Administration of Juvenile (The Beijing Rules), legal force diversion at investigation stage associated with the judicial power, and the implementation mechanism of diversion agreement. This research used normatif juridical methodology with the data collection are by the literature study and interview. The results of this research shows that it is important to clarify Act Number 11 of 2012 about Juvenile Justice System and create Government Regulation as soon as posible in order to give clear on the implementation of diversion to the law enforcement agencies."
