"Notaris dalam mendirikan Perseroan Terbatas Penanaman Modal Asing (PT PMA) wajib memperhatikan dokumen-dokumen yang diperlukan guna memenuhi ketentuan dari Undang- undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas. Penelitian ini membahas mengenai 1. Implikasi dari diberlakukannya Peraturan Presiden Nomor 2 Tahun 2021 terhadap Pendirian Perseroan Terbatas dan 2. Tanggung jawab Notaris untuk memastikan kebenaran formil atas apa yang dituangkannya dalam akta berdasarkan dokumen yang dilegalisasi oleh Otoritas yang Berkompeten. Penelitian ini merupakan penelitian hukum normatif yang didasarkan pada data sekunder dan bersifat yuridis normatif dengan tipologi preskriptif. Hasil penelitian ini yaitu 1. bahwa terdapat beberapa pengecualian legalisasi dokumen asing yang dibutuhkan Notaris dalam pendirian PT PMA dan 2. bahwa Notaris tetap memiliki kewajiban dalam memastikan kebenaran formil atas dokumen asing yang dilegalisasi oleh Otoritas yang Berkompeten.

In the establishment of Foreign Investment Limited Company (PT PMA), notary must observe to the required documents in order to comply with the provisions of Law Number 40 of 2007 concerning Limited Liability Companies. This research discusses 1. The implications of the enforcement of Presidential Regulation Number 2 of 2021 on the Establishment of Limited Liability Companies and 2. The responsibility of a notary to ensure the formal authenticity of what is stated in a deed based on documents not legalized by the Embassy of the Republic of Indonesia. This research is a normative legal research based on secondary data and is normative juridical with a prescriptive typology. The results of this study are 1. that there are several exceptions to the legalization of foreign documents required by notaries in the establishment of PT PMA and 2. Notaries still have an obligation to ensure the formal authenticity of foreign documents that are not legalized even though these documents have been exempted from the legalization process."
