"ABSTRACTThis paper aims to explain the dimensions of inequality power relations and revictimization that occurred in a rape case by seduction in dating violence context. Using the case study of court decisions and radical feminist theory as a tool of analysis, the author argue that the narrative in the name of love used by perpetrators of sexual violence in personal relations is actually another manifestation of the inequality of power relations and become site of female body subjugation. Therefore, forms of exploitation that use a proof of love narrative in cases of forced sexual intercourse should be identified as part of sexual violence."

"ABSTRAKPenelitian ini bertujuan memaparkan kompleksitas pengalaman perempuan yangmengalami tindak pemaksaan hubungan seksual tanpa cara kekerasan fisik atauancaman kekerasan fisik melalui berbagai cara oleh kekasihnya, seperti bujuk rayu,janji palsu, dan tipu muslihat dalam sistem hukum pidana Indonesia, khususnya pasal285 KUHP yang membahas tentang perkosaan. Pengaturan terkait marital rape dalamUU Nomor 23 Tahun 2004 Tentang Penghapusan Kekerasan Dalam Rumah Tanggatidak menjadi fokus analisis mengingat studi kasus penelitian adalah pada relasipacaran. Dalam menganalisis permasalahan kekerasan seksual dalam relasi pacaran,penulis menggunakan teori the continuum of sexual violence dari Liz Kelly dan feministlegal methods dari Bartlett. Metode penelitian adalah studi kasus dengan pendekatankualitatif berperspektif feminis. Melalui penelitian ini, penulis berargumentasi bahwapengalaman perempuan yang mengalami pemaksaan hubungan seksual yang dicapaitanpa cara kekerasan fisik oleh kekasihnya berpotensi untuk tidak terdokumentasikanoleh hukum karena sempitnya definisi hukum tentang perkosaan di Indonesia. Padahal,perempuan yang menjadi korban mendapat dampak yang sangat buruk dari tindakperkosaan tersebut. Sebagai implikasi, akses perempuan untuk mendapat keadilan danpemulihan tidak terjamin dalam kerangka hukum Indonesia. Dengan demikian, rumusantindak pidana terkait perkosaan sudah seharusnya mengalami proses redefinisi yangmemiliki keberpihakan bagi perempuan korban.ABSTRACTThis study aims to describe the complexity of women experience in the rape case by theact of non- physical violent by her lover, such as seduction and false promise. The studysee this problem through the legal system in Indonesia, especially article 285 of theCriminal Code (KUHP) which discusses about rape. Article related marital rape in LawNumber 23 of Year 2004 Regarding Elimination of Domestic Violence is not the focus ofanalysis considering the case study research is on dating relationships. For analyzingthe problem, the author uses the continuum of sexual violence theory by Liz Kelly andfeminist legal methods from Bartlett. The research method is case study with qualitativeapproach with feminist perspective. Through this study, the authors argue that theexperience of women who have forced nonviolent sexual intercourse has the potential tobe undocumented by the law because of the narrowness of the legal definition of rape inIndonesia. As an implication, the fulfillment of the rights of women victims to getprotection is not guaranteed within the framework of Indonesian law. Thus, theformulation of criminal offenses related to rape should have undergone a redefinitionprocess."
