"Skripsi ini membahas mengenai pengaturan pencantuman klausula baku dalam kontrak elektronik yang diatur dalam Undang-undang Nomor 8 tahun 1999 tentang Perlindungan konsumen serta Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan atas Undang-undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik, dikaitkan dengan Consumer Rights Act 2015 dan UK eIDAS sebagai peraturan di negara Inggris. Metode penelitian yang digunakan adalah metode yuridis-normatif dengan pendekatan perbandingan hukum dengan penulisan deskriptif analitis. Assessment of fairness dapat diberlakukan sebagai bentuk mitigasi dan perlindungan hukum terhadap pihak yang berpotensi mengalami kerugian terhadap adanya klausula baku dalam suatu kontrak elektronik. Namun, perlu adanya tinjauan kembali terhadap negara yang menerapkan prosedur tersebut, yaitu Inggris.

This thesis discusses the regulation of the inclusion of standard clauses in electronic contracts which are regulated in Law Number 8 of 1999 concerning Consumer Protection and Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Electronic Information and Transactions, associated with Consumer Rights Act 2015 and UK eIDAS as regulations in the UK. The research method used is the juridical-normative method with a comparative law approach with analytical descriptive writing. Assessment of fairness can be applied as a form of mitigation and legal protection for parties who have the potential to suffer losses due to the existence of standard clauses in an electronic contract. However, there needs to be a review of the country that implements the procedure, Which is United Kingdom."
