KPPU didirikan sebagai lembaga dengan diterbitkannya Keputusan Presiden No. 75 Tahun 1999 tentang Komisi Pengawas Persaingan Usaha. Sampai saat ini KPPU telah banyak sekali menangani kasus persekongkolan tender secara vertikal yang melibatkan panitia tender sebagai terlapor. Sudah jelas dalam Undang-Undang No. 5 Tahun 1999 tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat menjelaskan bahwa tugas dan wewenang KPPU adalah untuk mengawasi pelaku usaha agar tidak melanggar Undang-Undang No. 5 Tahun 1999. Akan tetapi, panitia tender bukanlah pelaku usaha dan seharusnya bukan wilayah atau yurisdiksi KPPU. Skripsi ini akan membahas kedudukan hukum dari panita tender yang bukan merupakan pelaku usaha menyebabkan panitia tender tidak dapat dihukum layaknya pelaku usaha pada persekongkolan tender secara vertikal di Indonesia. ...... The Business Competition Supervisory Commission (Komisi Pengawas Persaingan Usaha) or as known as KPPU was established as an institution by the issuance of President Decision No. 75 Year 1999 concerning the Business Competition Supervisory Commission. Until now, KPPU had handled a large number of cases concerning vertically collusive tenders which involved tender's committee as the reported. It is clear that Law No. 5 Year 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition elucidated that the duties and authorities of KPPU is to supervise the undertaking in order to not violate Law No. 5 Year 1999. However, the tender committee is not a undertaking and should not be in the scope of authority or jurisdiction of KPPU. This research will be discussing the legal position of the tender committee which is not a business operator that causes the tender committee to be failed to be punished like a business operator should have been on a vertically collusive tender in Indonesia.
