Abstrak :
Tesis ini membahas kedudukan PT PLN (Persero) sebagai Badan Usaha Milik Negara bidang ketenagalistrikan pasca berlakunya Undang-Undang No. 30 Tahun 2009 tentang ketenagalistrikan ditinjau dari hukum anti monopoli dan persaingan usaha tidak sehat sebagaimana diatur dalam Undang-Undang No. 5 Tahun 1999 tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat. Hasil penelitian ini menyimpulkan bahwa berdasarkan kedua undang-undang tersebut, PT PLN (Persero) tidak melakukan praktek monopoli dan persaingan usaha tidak sehat. Dan guna melindungi kepentingan hajat hidup orang banyak sebagaimana\ dinyatakan dalam Pasal 33 Undang-Undang Dasar 1945, maka pemerintah tetap menerapkan Public Service Obligation kepada PT PLN (Persero). ......The thesis discusses about the position of PT PLN (Persero) as State-Owned Enterprises in electricity after the enactment of Law No. 30 Year 2009 concerning Electricity in terms of antitrust law and unfair competition as stipulated in Law No. 5 Year 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition. The conclusion of the thesis shows that based on the laws, PT PLN (Persero) is not practicing monopolistic and unfair competition. And in order to protect the interests of livelihood of the people as stated in Article 33 of the Constitution of 1945, the government continues to implement the Public Service Obligation to PT PLN (Persero).
