Abstrak :
Disertasi ini membahas biaya kompensasi kegiatan pertambangan di hutan lindung dalam rangka mencari biaya kompensasi optimal karena hilangngnya fungsi ekosistem. Penelitian ini merupakan penelitian kuantitatif dengan desain ekploratory dan pengembangan. Pemanfaatan hutan lindung untuk kegiatan pertambangan batubara membawa konsekuensi terhadap keberlanjutan fungsi ekosistem hutan lindung yang mempunyai fungsi pokok sebagai perlindungan sistem penyangga kehidupan. Diperlukan adanya biaya kompensasi yang mempertimbangkan aspek sosial, ekonomi, dan ekologi atas pemanfaatan kawasan hutan untuk kegiatan pertambangan. Hasil penelitian ini menyarankan untuk diterapkannya biaya kompensasi terhadap perusahaan pertambangan batubara atas kerusakan ekosistem. Penggunaan biaya kompensasi, prioritas diberikan kepada masyarakat sekitar tambang dan pemulihan (restorasi) ekosistem.

This dissertation discusses the compensation cost for mining activity in protected forest for the purpose of seeking the optimal compensation cost due to the loss of the ecosystem function. It is a quantitative research with an exploratory and development design. The utilization of protected forest for coal mining activity will have a consequence on the continuity of its ecosystem function, whose primary function is to protect the life support system. Therefore, it is necessary to have a compensation cost scheme that takes into account the social, economy and ecological aspects of the utilization of protected forest for mining activity. This research recommends that coal-mining company should be obliged to disburse some compensation cost for the damage they caused to the ecosystem. The community around the mines and the efforts for restoring the ecosystem shall be given the priority to receive the fund collected.

Abstrak :
Skripsi ini membahas mengenai keterbukaan atas dampak lingkungan. Dengan dibukanya informasi mengenai dampak lingkungan, maka masyarakat dapat terlibat dalam usaha perlindungan lingkungan secara lebih optimal. Hal tersebut diharapkan dapat meningkatkan kualitas lingkungan hidup. Terdapat pembahasan mengenai keterbukaan informasi lingkungan serta penerapannya di Indonesia. Penelitian ini merupakan penelitian hukum doktrinal dengan sifat eksploratoris dengan menggunakan data sekunder. Hasil penelitian ini menunjukkan bahwa informasi lingkungan sudah diatur dan diterapkan di Indonesia. Meskipun demikian, belum terdapat ketentuan yang jelas mengenai keterbukaan informasi dampak lingkungan. Selain itu tindak lanjut dari dampak lingkungan yang dipublikasikan tersebut juga masih belum diatur secara jelas. ...... This thesis discusses the transparency on environmental damage information. The transparency is related to the people?s right on healthy environent. By the disclosure of environmental damage, it is hoped that the protection of environment can be improved. This thesis studies the theories and regulations on the publication of environmental information and its application in Indonesia. The study is an exploratory law doctrinal research which uses secondary data. The result of the research indicates that the transparency of environmental information has been regulated and applied in Indonesia. However, there is no regulation that follows up on the publication of the damage and force the companies to disclose their environmental damage information.
