"[ABSTRAK
Tesis ini membahas tentang bagaimana Kantor Imigrasi Kelas I Khusus Jakarta Barat dalam menjalankan salah satu fungsinya yaitu melakukan pengawasan terhadap orang asing baik itu yang berupa pengawasan administrasi.
Tujuannya adalah untuk mengetahui sejauh mana pengawasan tersebut berjalan dengan baik dan faktor apa saja yang menjadi faktor penghambat sehingga pengawasan terhadap orang asing di Kantor imigrasi Jakarta Barat tidak berjalan dengan baik.
Penelitian ini bersifat deskriptis dengan pendekatan desain kualitatif. Model analisis dengan mengajukan sejumlah pertanyaan yang menjadi dasar dari pengumpulan data. Informan dalam penelitian ini diambil dari pelaksana pengawasan orang asing yang keseluruhan berjumlah 4 orang.
Dari hasil penelitian yang dilakukan, disimpulkan terdapat adanya kelemahan pengawasan orang asing baik pada pengawasan administrasi maupun lapangan yang dapat menyebabkan pengawasan orang asing tersebut berjalan tidak baik. Kemudian didapat pula upaya yang dilakukan untuk meningkatkan pengawasan administrasi guna terciptanya pengawasan orang asing yang sesuai dengan dikehendaki.

ABSTRACT
This thesis discusses how the Special Immigration Office Class I Jakarta Barat in running one of its functions is to supervise the stranger either in the form of administrative oversight.
The goal is to determine the extent of supervision is going well and what factors are the limiting factor so that surveillance of foreigners in West Jakarta immigration office did not go well.
This research is descriptive qualitative design approach. Model analysis by asking a number of questions that form the basis of the data collection. Informants in this study were drawn from implementing the overall supervision of foreigners amounted to 4 people.
From the research conducted, concluded there is a weakness in supervision strangers either on administrative oversight and supervision of the field can cause the runs are not strangers either. "Ketentuan dalam UU Pokok Agraria menyatakan bahwa tanah dengan status hak milik hanya dapat dimiliki oleh Warga Negara Indonesia. Namun sebagaimana yang terjadi dalam Putusan Mahkamah Agung No. 1208 PK/PDT/2022, Orang Asing ternyata menggunakan konsep pinjam nama (nominee arrangement) untuk dapat memiliki tanah hak milik di Gianyar, Bali. Konsep tersebut dituangkan ke dalam bentuk perjanjian yaitu Surat Pernyataan dan Perikatan yang dibuat di hadapan notaris. Penelitian ini dilakukan dengan mengangkat 2 (dua) rumusan masalah, yaitu kedudukan hukum penggunaan pinjam nama (nominee arrangement) yang dibuat dalam bentuk perjanjian di hadapan notaris dan kesesuaian pertimbangan majelis hakim dalam menggunakan Surat Edaran Mahkamah Agung sebagai dasar hukum penggunaan pinjam nama (nominee arrangement). Penelitian ini dilakukan berdasarkan metode doktrinal dengan
menggunakan data sekunder yang didukung oleh data primer. Hasil penelitian menunjukkan bahwa konsep pinjam nama (nominee arrangement) tidak diatur dalam perundang-undangan di Indonesia, sehingga untuk menentukan kedudukan hukumnya menggunakan aspek perikatan dan perjanjian dalam Kitab Undang-Undang Hukum Perdata dan aspek larangan pengasingan tanah dalam UU Pokok Agraria. Berdasarkan kedua peraturan tersebut konsep penggunaan pinjam nama (nominee arrangment) dianggap melanggar Pasal 1337 KUHPerdata dan Pasal 26 ayat (2) UU Pokok Agraria. Sedangkan terhadap notaris yang turut serta membuat akta autentik terkait pinjam nama telah tidak memenuhi kewajibannya dalam UU Jabatan Notaris dan Kode Etik Profesi untuk bersikap cermat dan menjaga kepentingan para pihak. Selain itu, penggunaan Surat Edaran Mahkamah Agung sebagai dasar hukum penggunaan pinjam nama (nominee arrangement) oleh majelis hakim sesuai dengan putusan-putusan pengadilan terdahulu yang memutuskan bahwa kepemilikan hak milik atas tanah tetap menjadi milik WNI sebagai pihak yang namanya tercantum dalam sertipikat. Namun ketentuan dalam Surat Edaran Mahkamah Agung tersebut berbeda dengan akibat hukum yang diatur dalam Pasal 26 ayat (2) UU Pokok Agraria.
......Agrarian Law (UU Pokok Agraria) stated that land with freehold status can only be owned by Indonesian citizens. However, as happened in Supreme Court Decision No. 1208 PK/PDT/2022, foreigners apparently use the concept of nominee arrangement to be able to own freehold land in Gianyar, Bali. This concept made in the form of a notarial agreement. This research was carried out by raising 2 (two) research questions, namely the legal position of nominee arrangements made in the form of a notarial agreement and the suitability of the panel of judges' considerations in using Supreme Court Circular (Surat Edaran Mahkamah Agung) compared to Agrarian Law (UU Pokok Agraria) as the legal basis for nominee arrangements. This research employs doctrinal legal methods using secondary data and alo supported by primary data. The results of the research shows that the concept of nominee arrangement is not regulated in Indonesian law, so to determine its legal position need to use the agreement aspect in the Civil Code (KUHPerdata) and the prohibition aspect of land alienation in the Agrarian Law (UU Pokok Agraria). Based on these two regulations, the concept of using nominee arrangements is considered to violate Article 1337 of the Civil Code (KUHPerdata) and Article 26 paragraph (2) of the Agrarian Law (UU Pokok Agraria). Meanwhile, notaries who participate in making authentic deeds related to nominee arrangements have not fulfilled their obligations in the Notary Law and the Professional Code of Ethics to be careful and safeguard the interests of the parties. Apart from that, the use of Surat Edaran Mahkamah Agung as a legal basis for determining the subject who has the right to own land in a nominee arrangement case by a panel of judges is correct. However, the provisions in the Supreme Court Circular (Surat Edaran Mahkamah Agung) are different from the legal consequences regulated in Article 26 paragraph (2) of the Agrarian Law (UU Pokok Agraria)."

"Dalam pembangunan ekonomi di Indonesia, investasi sangat berperan penting dalam menggerakkan ekonomi masyarakat. Pemerintah Indonesia menyadari bahwa investasi merupakan salah satu faktor paling penting dalam meningkatkan pertumbuhan ekonomi, oleh karena itu Pemerintah berupaya keras untuk merangsang minat kalangan investor asing untuk berinvestasi di Indonesia dengan memberi kemudahan bagi para investor yang merupakan WNA untuk memiliki fasilitas hak atas tanah dan rumah tinggal di Indonesia sebagai sarana penunjang investasi. Tesis ini membahas menge nai pemberian Hak Pakai di atas tanah Hak Milik sebagai alternatif bagi WNA untuk dapat memiliki rumah tempat tinggal di Indonesia dalam menunjang kepentingan investasi. Penelitian ini adalah penelitian hukum normatif dengan sifat penelitian deskriptif evaluatif.
Hasil penelitian ini adalah bahwa WNA diperkenankan untuk memiliki rumah tinggal di atas tanah Hak Pakai dengan jangka waktu paling lama 25 (dua puluh lima) tahun. Pemilikan rumah tinggal oleh WNA dilandasi oleh suatu perjanjian pemberian Hak Pakai atas tanah Hak Milik yang berupa Akta Pemberian Hak Pakai Atas Tanah Hak Milik yang dibuat dalam bentuk tertulis oleh Pejabat Pembuat Akta Tanah (PPAT).

In the development of the Indonesian economy, investment plays a vital role in moving the local economy. The Indonesian government realizes that investment is one of the most important factors in enhancing economic growth and therefore strives to stimulate interest among foreign investors. The means that have been taken are among others providing convenience for these foreign investors to own land rights and housing facilities to support their investment. This thesis discusses the provisions of Property usage rights over land as an alternative for foreigners to own homes in Indonesia in supporting investment interests. This is a normative law research with a nature of a descriptive evaluative research.
The result of this research is that foreign citizens are allowed to own houses on these right to use land for a maximum period of 25 (twenty five) years. Residential ownership by foreign citizens are based on a treaty provision of Land usage right of land Ownership in a form of Certificate of Land Usage Right of Land Ownership made in written form by Land Deed Maker Officials (PPAT)."

"This research aimed at getting a description on the effectiveness of application of the law no.9 of 1992 againts foreign citizen working at Bengkulu Province and obstacles of the law application. The result of research proved that the law No.9 of 1992 was basic rules fo foreign workers activities from points of view : (a) data of foreigners visit, temporary stay, permanent residents ; (b) the way of control the foreigners entering Bengkulu ; (c) types of offenenses : imigration permit, missue of working permit. The cases were tackled by government instances, but more obstacles were met at the invloved instances : high public Prosecution office Provincial Police Office, Coordination Board of Local Investment, Manpower Local Office, and imigration office."

"Pemerintah Indonesia pada tanggal 15 April 2015 menerbitkan Peraturan Pemerintah Nomor 103 Tahun 2015 dan peraturan pelaksananya yaitu Peraturan Menteri Agraria Nomor 29 Tahun 2016, yang mengatur ketentuan mengenai syarat-syarat yang harus dipenuhi oleh WNA dalam pemilikan satuan ruamh susun. dengan adanya ketentuan yang memberikan syarat kepada WNA, dalam tesis ini dibahas tentang Kepemilikan tanah dan bangunan atas satuan rumah susun oleh WNA yang berkedudukan di Indonesia dengan mengkaji dan menganalisa PP No. 103/2015 dan Permen No.29/2016 dikaitkan dengan UU No. 5 /1960 tentang Peraturan Dasa Pokok-Pokok Agraria dan peraturan lain yang berkaitan. Sehingga dapat ditarik kesimpulan apakah PP No.103/2015 dan Permen No.29/2016 ini telah sesuai dengan peraturan perundang-undangan yang berlaku di Indonesia ataukah belum.
