"ABSTRAKSkripsi ini membahas mengenai adanya perjanjian franchise antara Muhaerul dengan PT. Wadha Artha Abadi. yang akan ditinjau berdasarkan Peraturan Perundang-undangan khususnya Peraturan Pemerintah nomor 42 tahun 2007 tentang Waralaba Terdapat berbagai persoalan terkait dengan unsur-unsur perjanjian franchise dalam Peraturan Pemerinth Nomor 42 tahun 2007 tentang Waralaba yang tidak terpenuhi oleh perjanjian franchise oleh Muhaerul dengan PT. Wadha Artha abadi sehingga apakah perjanjian franchise ini dapat dikatakan sebagai perjanjijan franchise atau tidak, Peneliti mengajukan pokok permasalahan, yaitu: 1. Bagaimanakah perjanjian franchise antara Muhaerul dengan PT. Wadha Artha Abadi menurut Peraturan Pemerintah Nomor 42 Tahun 2007 tentang Waralaba dengan ketentuan peraturan lainnya yang mengatur mengenai franchise atau waralaba. 2. Bagimanakah akibat hukum dari perjanjian franchise antara Muhaerul dengan PT. Wadha Artha Abadi apabila tidak memenuhi aspek-aspek perjanjian franchise menurut ketentuan Peraturan Pemerintah Nomor 42 Tahun 2007 tentang Waralaba. 3. Bagaimanakah upaya hukum dan perlindungan hukum bagi para pihak dari perjanjian franchise

ABSTRAKThis thesis discusses the existence of the franchise agreement between Muhaerul with PT. Wadha Artha Abadi. which will be reviewed based on the legislation in particular Government Regulation No. 42 of 2007 on Franchise There are many problems associated with the elements of his government's franchise agreement in Regulation No. 42 of 2007 on Franchise are not met by the franchise agreement by Muhaerul with PT. How does the franchise agreement between Muhaerul with PT. How does legal consequences of franchise agreements between Muhaerul with PT. Wadha Artha Abadi if it does not meet aspects of the franchise agreement under the provisions of Government Regulation No. 42 Year 2007 on Franchise? 3. How are laws and legal protection for the parties to the franchise agreement is Muhaerul with PT. Wadha Artha Abadi."

"Tesis ini membahas tentang penerapan peraturan perundang-undangan mengenai waralaba dalam perjanjian waralaba antara pihak PT Imperium Happy Puppy dengan Pihak X dan menganalisis bagaimana bentuk perlindungan hukum bagi para pihak yang terlibat dalam perjanjian waralaba antara pihak PT Imperium Happy Puppy dengan Pihak X. Penelitian ini bersifat Normatif dengan pendekatan sinkronisasi hukum vertikal dan juga didukung dengan pendekatan kasus.Berdasarkan hasil penelitian diperoleh hasil Perjanjian Waralaba antara Pihak PT imperium Happy Puppy dengan Pihak X telahmemenuhi syarat dan ketentuan seperti yang diatur dalam peraturan perundang-undangan. Dalam penelitian ini ditemukan adanya beberapa klausula perjanjian yang memberatkan Pihak X sebagai penerima waralaba (franchisee).

This reseach uses normative law methods, a research method based on normative law stated in the Indonesian Law. This thesis discusses on the application of the law on franchise system in Indonesia based on the agreement between two parties. The first party is PT Imperium Happy Puppy and the second party is X and the agreemeent was then analyzed on how the law protection for both parties are being applied.

The results of the research showed that the agreement between both prties has fulfilled the requirements and closures as stated in the Indonesian Law. However, it was found out that there several agreement clauses that are burdening the second party in this case the X as the franchisee."
